RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT:
I do hereby affirm and acknowledge that I understand there are inherent hazards and risks associated with scuba diving and its training. I fully understand that these risks can lead to severe injury and even loss of life. I understand that diving operations may be conducted at a site that is remote from a recompression chamber and competent medical assistance. Nevertheless, I choose to proceed even in the absence of a recompression chamber and competent medical assistance. Additionally, I understand that there are also risks associated with dive travel, including, but not limited to the possible injury or loss of life as a result of a dive boat accident, as well as travel to and from dive sites. Despite the potential hazards and dangers associated with the activity of scuba diving, I wish to proceed and I freely accept and expressly assume all risk, dangers, and hazards that may arise from diving activities which could result in personal injury, loss of life, and/or property damage to me. In consideration of being allowed to participate in Scuba Diving activities as well as the use of any of the facilities and the use of the equipment of the below listed releasees, I hereby agree as follows:
1. TO WAIVE AND RELEASE ANY AND ALL CLAIMS based upon negligence, active or passive with the exception of intentional, wanton or willful misconduct that I may have in the future against any of the following named persons or entities (hereafter referred to as Releasees): National Association of Underwater Instructors (NAUI): Scuba Diving International (SDI): The Instructor(s) and/or Divemaster(s): Any and All Eight Diving Staff and/or Facilities: 2. To release the releasees, their officers, directors, employees, representatives, agents and volunteers, from liability and responsibility, whatsoever, for any claims or causes of action that I, my estate, heirs executors or assigns may have for personal injury, property damage or wrongful death arising from Snorkeling, Skin and/or Scuba diving activities whether caused by active or passive negligence of the releasees or otherwise with the exception of gross negligence. By executing this document, I agree to hold the releasees harmless for any injury or loss of life which may occur to me during Snorkeling, Skin and/or Scuba diving activities and/or instruction. 3. By entering into this agreement, I am not relying on any oral or written representation or statements made by the releasees, other than what is set forth in this agreement. I further agree that this Agreement shall be governed by and interpreted in accordance with the laws of the State of California, United States of America. 4. If any provision, section, subsection, clause or phrase of this release is found to be unenforceable or invalid, that portion shall be severed from this contract. The remainder of this contract will then be construed as though the unenforceable portion had never been contained in this document. I HEREBY DECLARE THAT I AM OF LEGAL AGE AND AM COMPETENT TO SIGN THIS AGREEMENT OR, IF NOT, THAT MY PARENT OR LEGAL GUARDIAN SHALL SIGN ON MY BEHALF, AND THAT MY PARENT OR LEGAL GUARDIAN IS IN COMPLETE UNDERSTANDING AND CONCURRENCE WITH THIS AGREEMENT.
I HAVE READ THIS AGREEMENT, I UNDERSTAND IT, I AGREE TO BE BOUND BY IT.
PLEASE NOTE THE FOLLOWING EXCERPT FROM THE “WARRANTIES FOR TRAINING” “Each student shall be required to complete a medical history form prior to the beginning of training. The beginning of training is defined as the commencement of in-water training activities. A written release for each student must also be completed prior to the beginning of training.” Failure to complete this required document and/or have the form completed by a doctor if the information I provide suggests a doctors release is necessary does not release me from the nonrefundable cancellation costs. I acknowledge it is my responsibility to complete the appropriate form(s) and to seek a doctors release if necessary, and not completing the forms or being able to get a doctors release does not relieve me from the nonrefundable cancellation costs.
Please initial after each statement, I understand: Due to space limitations and instructor/facility commitments; registration, and tuition fees are nonrefundable, nontransferable, and due in full at the time of registration.
Training dive dates, start times, and locations may need to be rescheduled, canceled, or postponed at the sole discretion of Eight Diving staff and instructors.
Eight Diving requires me to provide my own mask, snorkel, and boots to participate in my Open Water class. I’m responsible for providing my own gear for all other classes. Any necessary rentals must be arranged and paid for in advance of all courses.
I understand that I need to complete several swim tests to be able to participate in the class. I must be be able to swim continuously a minimum of 300 yards, tread water for 10 minutes, and perform a 60-foot underwater breath-hold swim.
I understand that the eLearning materials are required and need to be completed prior to the start of class. If I have issues getting access it is my responsibility to reach out to the staff at Eight Diving (staff@8diving.com / 206.429.3480) for assistance. I also understand if I do not complete these materials in advance of class I may be moved to another class date at my cost.
I understand and agree some dive sites are remote and a recompression chamber may not be readily available and I choose to continue my training and diving and assume the risk in the absence of a recompression chamber. I understand that I am required to have a current DAN Dive Insurance policy and am required to provide a copy of my card in advance of my class. (not applicable for Open Water Students). Not having active DAN Insurance at the start of class will prevent me from participating in the class and I will not be allowed a refund or the ability to reschedule.
In signing I submit that I have read, understand, and agree to the above outlined policies.
