MAPLE VALLEY ADVENTURES
RELEASE OF LIABILITY & ASSUMPTION OF RISK AGREEMENT

PLEASE READ CAREFULLY — THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS

By signing this Agreement, you are waiving certain legal rights, including the right to sue.

This Agreement applies to participation in activities and rental or operation of equipment provided by Maple Valley Adventures (“MVA”), including but not limited to:

  • Jet Skis / Personal Watercraft (PWC)
  • Motorcycles
  • Side-by-Side UTVs
  • Dirt Bikes
  • ATVs / Four Wheelers

1. ACKNOWLEDGMENT OF INHERENT RISKS

I understand that operating or riding motorized recreational vehicles involves inherent and significant risks, including but not limited to:

  • Rollovers, crashes, collisions, or ejection
  • Loss of control
  • Mechanical failure
  • Uneven terrain, mud, rocks, or obstacles
  • Water hazards, waves, submerged objects
  • Changing weather conditions
  • Wildlife encounters
  • Actions of other riders
  • Operator error (my own or others’)
  • Serious bodily injury, drowning, paralysis, or death

I understand that these risks are inherent in motorsports and outdoor recreation activities.


2. VOLUNTARY ASSUMPTION OF RISK

I knowingly and voluntarily assume all risks, known or unknown, inherent or otherwise, associated with participation and use of MVA equipment.

I accept full personal responsibility for any injury, death, or property damage that may result.


3. RELEASE OF LIABILITY (INCLUDING NEGLIGENCE)

In consideration for being allowed to participate, I hereby RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS Maple Valley Adventures, its owners, members, managers, employees, contractors, agents, and affiliates from any and all claims, demands, damages, causes of action, or liability arising out of or related to my participation.

This release specifically includes claims based on the alleged NEGLIGENCE of Maple Valley Adventures.

This release does not apply to gross negligence or willful misconduct as defined under Washington law.


4. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless Maple Valley Adventures from any claims, damages, losses, liabilities, or expenses (including attorney’s fees) arising out of:

  • My participation
  • My operation or use of equipment
  • Injury or damage I cause to others


5. SAFETY COMPLIANCE

I agree to:

  • Follow all verbal and written safety instructions
  • Wear required protective equipment
  • Operate responsibly
  • Comply with all Washington State and local laws
  • Not operate equipment under the influence of drugs or alcohol

MVA reserves the right to terminate participation for unsafe behavior.


6. HELMETS & PROTECTIVE EQUIPMENT

I understand that helmets and protective equipment reduce the risk of injury but do not eliminate the possibility of serious injury or death.

7. HEALTH CERTIFICATION

I certify that I am physically and mentally capable of safely participating and have disclosed any relevant medical conditions that could affect my ability to participate.

8. MINOR PARTICIPANTS

If signing on behalf of a minor:

I certify that I am the parent or legal guardian of the minor participant. I consent to the minor’s participation and agree to indemnify and hold harmless Maple Valley Adventures from any claims brought by or on behalf of the minor.


9. SEVERABILITY

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

10. GOVERNING LAW & VENUE

This Agreement shall be governed by the laws of the State of Washington.

Any legal action arising out of this Agreement shall be brought exclusively in King County, Washington.

PARTICIPANT ACKNOWLEDGMENT

I certify that:

  • I have read this Agreement carefully in its entirety.
  • I understand its contents.
  • I understand that I am waiving certain legal rights, including the right to sue.
  • I sign this Agreement voluntarily and without coercion.
