WAIVER AND RELEASE OF LIABILITY FOR PARTICIPANTS OF RANCHO REPOSO This is a legally binding document. By signing this document, you waive certain legal rights, including the right to file lawsuits against Rancho Reposo, LLC. Please read carefully before signing. 1. Definitions For the purposes of this document: - “Rancho Reposo” refers to Rancho Reposo, LLC, its owners, employees, contractors, volunteers, representatives, agents, and affiliates.
- “Participant” includes any individual who enters the premises of Rancho Reposo, participates in equine activities, or uses common areas.
- “Equine Activities” include, but are not limited to, riding, handling, feeding, training, caring for horses, participating in demonstrations, workshops, and observing horse-related activities.
2. Acceptance of Inherent Risks In compliance with the Florida Equine Activity Liability Act (FEALA): WARNING: Under Florida law, an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities. The Participant understands and accepts that equine activities include inherent risks, including but not limited to: - Unpredictable behavior of horses, such as kicking, biting, tripping, bolting, or reacting unexpectedly.
- Uneven or slippery surfaces.
- Use, misuse, or failure of equipment related to the activities.
- Negligence of other participants or spectators.
The Participant voluntarily assumes these risks and releases Rancho Reposo from any resulting liability. 3. General Risks on the Premises The Participant understands that, in addition to risks associated with equine activities, there are inherent risks in using the premises, including: - Slips, trips, or falls in common areas, parking lots, or trails.
- Contact with maintenance equipment, vehicles, or structures under repair.
- Weather-related risks, such as rain, extreme heat, or lightning.
4. Release of Liability The Participant, on their behalf and on behalf of their heirs, successors, and legal representatives, agrees to release, discharge, and hold harmless Rancho Reposo from any claim, demand, or legal action for: - Personal injuries, death, or property damage sustained during equine activities or use of the premises, including those arising from the ordinary negligence of Rancho Reposo.
- Loss, theft, or damage to personal belongings on the premises.
This release does not apply to claims arising from gross negligence or intentional misconduct by Rancho Reposo or its representatives. 5. Commitment to Safety Rules The Participant agrees to: - Follow all instructions and safety guidelines provided by Rancho Reposo staff.
- Wear required safety equipment, such as helmets and appropriate footwear.
- Disclose any medical condition or physical limitation prior to participating in activities.
Failure to comply with these rules may result in the immediate termination of participation and removal from the premises. 6. Participation of Minors If the Participant is under the age of 18, a parent or legal guardian must sign this document on behalf of the minor and assumes full responsibility for the minor's participation and associated risks. 7. ADA Compliance Rancho Reposo is committed to providing reasonable accommodations for individuals with disabilities, provided such accommodations do not compromise the safety of the activities. The Participant must notify Rancho Reposo in advance of any special needs. 8. Permission for Use of Images The Participant grants Rancho Reposo permission to capture and use images, videos, and recordings taken during their participation in activities. These images may be used for promotional, educational, or marketing purposes without additional compensation to the Participant. If the Participant wishes to limit this permission, they must notify Rancho Reposo in writing prior to participation. 9. Governing Law and Dispute Resolution This agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes related to this document shall be resolved exclusively in the courts of the county where Rancho Reposo is located. 10. Entire Agreement This document constitutes the entire agreement between the parties. Any modifications must be made in writing and signed by both parties. Acknowledgment and Signature I, the undersigned, acknowledge that I have read, understood, and voluntarily agree to the terms of this Waiver and Release of Liability. Date: August 31, 2025 |
