INSTRUCTIONS: Every individual participating in the Event must sign a copy of this form before the start of the Event. Students must also obtain a signature from a parent or legal guardian. Students or faculty advisors without a completed release form on file prior to the Event will not be permitted to participate in any event/activities. 

In signing this waiver, you agree to all terms for Laulima Charitable Foundation and Hawaii Pacific Model United Nations outlined below.

Event: November 20-22, Pacific Model United Nations Conference

Locations: Waikiki Beach Marriott Resort

I, the undersigned, either on my own behalf or as the parent or legal guardian of the minor child named below, (collectively referred to as “Participant”) hereby acknowledge and agree as follows:

1. I understand and agree that participation in the Event organized by The Laulima Charitable Foundation and Hawaii Pacific Model United Nations (PacMUN) is voluntary and that the Participant assumes all risks and hazards associated with participation in the Event. I desire to participate in such Event, including, without limitation, to be a passenger in any vehicles providing Event transportation, whether the vehicle is owned by Organization or any other party, and otherwise to enter any area where the Event take place, in whole or in part. In consideration of being permitted to participate in the Event and in recognition of the Organization’s reliance hereon, I hereby agree to all the terms of this Liability Waiver and Publicity Release Agreement (this "Agreement").

2. I hereby fully release, waive, and forever discharge The Laulima Charitable Foundation, Hawaii Pacific Model United Nations, and each of their respective affiliates, directors, officers, employees, staff, volunteers, and any agents (collectively, the “Organization”) from and against any and all injuries (including death), claims, losses, costs, damages, lawsuits, demands, expenses, obligations, or liabilities of any kind, of or to me, my property, or any other person, directly or indirectly arising out of or in connection with my participation in the Event, even if they are due to the ordinary negligence, omission, or other fault of the Organization. This waiver and release does not extend to liability for injury, death, or damage caused solely by gross negligence, intentional misconduct, or any other actions that applicable law does not permit to be released by agreement.

3. I will defend, indemnify, hold harmless, and reimburse Organization from and for all damages, losses, costs, or expenses (including legal fees) incurred by Organization or paid by them to any person (including me or my insurers) in respect of any accident, injury (including death), loss, or property damage, however caused or resulting from, arising out of, or otherwise in connection with my participation in the Event. I will reimburse Organization if anyone makes a claim against Organization in connection with my participation in the Event, including, without limitation, any accident I may be involved in or any injury, loss, damage to me, other parties or property however caused.

4. I grant consent for Participant to be photographed, videotaped, recorded, and/or interviewed at and in connection with the Event (“Event Content”).

5. To the extent Participant’s name, image, likeness, voice, and statements (“Participant’s Content”) appear in or are incorporated into Event Content, I grant to the Organization the right and license to publish, copy, display, distribute, and otherwise use Participant’s Content in any format and medium including, but not limited to, on social media, worldwide, to advertise, promote, and publicize the Organization, and for related internal and archival purposes.

6. I represent and warrant to Organization that I have full right, power, and authority to enter into this Agreement and grant the rights granted hereunder and that the rights and license granted hereunder do not, and will not, violate any right (including without limitation copyright, trademark, trade secret, right to privacy, or right of publicity) of, or conflict with or violate any contract with or commitment made to, any person or entity, and that no consent or authorization from, or any payment to, any third party is required in connection herewith.

7. I understand that as a condition of participating in the Event, Participant agrees to abide by the rules of the Organization and any additional rules established by the Organization in connection with the Event before and during the Event, all of which are established for the Participants’ safety and will be strictly enforced.

8. I agree that this agreement is enforceable to the fullest extent of the law, and that any provisions herein found invalid, as a matter of law will be deemed severable from the balance of the agreement.

BY SIGNING, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT YOU ARE GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE ORGANIZATION.
