VIP JETSKI ADVENTURES: JET SKI TOUR WAIVER AND RELEASE OF LIABILITY

A tour contract and release of liability, waiver of claims, assumption of risks, and indemnity agreement must be signed by the participant. A valid credit card, photo ID, and full payment of the tour total are required on the date of booking. Participants are responsible for all physical damage to equipment, with a minimum charge starting at $500.

For any consideration of electing and being allowed to participate in the recreational activity of a Jet Ski Tour at VIP JETSKI ADVENTURES the below-named participant and the participant's parent or guardian (if participant is a minor) do hereby (i) acknowledge the inherent risks and assume full responsibility for participating in the activities; and (ii) expressly and forever waive and release any claims, proceedings, or actions for personal injury, death, or any loss or damage whatsoever (the “Damages”) that the participant may suffer arising out of or in connection with their participation in the activities. The participant further releases and agrees to hold harmless **VIP JETSKI ADVENTURES and each of its affiliates, parents, subsidiaries, shareholders, officers, directors, agents, employees, predecessors, and the heirs, successors, and assigns of each from any liabilities related to the activities. Participants also accept financial responsibility for the loss of or damage to any equipment used during the tour.

The participant further acknowledges that the time on the booking is the check-in time, and the tour departs 30 minutes after the scheduled booking time. Participants must arrive on time, as 15 minutes is required for a safety and operations briefing before departure.

This agreement shall be governed by Puerto Rico law and shall be adjudicated in the appropriate forum located in the country.

NOTICE:By executing this WAIVER AND RELEASE, the participant agrees to abide by all rules related to the activities and acknowledges that signing this form constitutes conclusive evidence that they have read and understand this document in its entirety and intend to be bound by its terms and conditions.

AGE AND ELIGIBILITY REQUIREMENTS

The participant is 18 years of age or older and represents that they are in good physical condition with no known reasons that would prevent them from safely participating in the tour. Only participants 18 years or older may operate a jet ski. Children may not drive jet skis but may participate as passengers if they are 12 years or older. Participants must provide a photo ID and confirmation email at check-in. Any additional participants must be at least 18 years old and must be listed on the tour agreement.

DAMAGE DEPOSIT: Every jet ski will undergo an inspection before and after your tour. Participants must be present at the time of inspection. Participants are responsible for all damages sustained to the equipment, persons, or property during the tour period. A tour contract and release of liability must be signed by each participant. The cardholder must be present to sign all necessary waivers and agreements. Participants are responsible for any damages incurred during the tour, with repairs billed at $100 per inch of damage.
CHECK-IN & DEPARTURE: Participants must arrive at least 30 minutes before the scheduled tour departure time**. Check-in begins 15 minutes before the scheduled booking time to complete the safety and operations briefing. Failure to check in on time may result in a cancellation without a refund.
CANCELLATION POLICY:

Cancellations must be made at least 24 hours before the start time for a full refund.
Cancellations for full-day, weekend, or holiday bookings must be made at least one week in advance for a full refund.
Date change requests are subject to availability. VIP JETSKI ADVENTURES reserves the right to cancel any tour due to weather conditions that prevent safe operation.

WAIVER AND RELEASE OF LIABILITY

Jet skiing and activities on the water, have many risks and dangers. There are risks of collisions, falls, injuries to the spine, arms, and legs, pinching, drowning, and even death, which can arise from the negligence of others, weather conditions, acts of God, water conditions, and personal experience and abilities.

ACKNOWLEDGMENT OF RISKS

Participants acknowledge the following potential hazards, including but not limited to:

Changing water depth, currents, wave height and direction, weather changes, wind, and lightning.
Motion sickness, collisions with objects in the water, other watercraft, docks, and shore walls.
Injuries from falls, strain on joints, neck, or spine due to wave impact or collisions.
Risks of capsizing, hypothermia, sun exposure, and falling into the water.

Risks may be influenced by the participant’s physical condition, experience level, fatigue, coordination, balance, and environmental factors. If at any time conditions become hazardous, the tour operator may return to shore for safety reasons.

ASSUMPTION OF RISK AND RESPONSIBILITY

I/We agree to assume responsibility for all risks, including those listed above and any others not specified. My participation in the activity is voluntary, and I assume full responsibility for all members of my party. I am not under the influence of alcohol or drugs, and I do not have any medical conditions that would impair my ability to safely participate in the tour. I understand that VIP JETSKI ADVENTURES may terminate my participation if there are concerns about my competency, safety, or if weather conditions require it.

I also understand that any film, video, photo, or image of me while participating in the tour may be used for promotional or social media purposes.

RELEASE OF LIABILITY

In consideration of the services provided by VIP JETSKI ADVENTURES, I/We, for myself and any minor children under my guardianship, or any guests accompanying me, hereby agree that VIP JETSKI ADVENTURES shall have no liability for any injury, death, or damage however caused during the tour. I/We release and discharge VIP JETSKI ADVENTURES and its insurer from any claims for damages or injuries incurred.

I/We have read the warnings, acknowledgment of risks, assumption of responsibility, and release of liability. I understand that by signing this document, I/We may be waiving valuable legal rights.
