LVLUP USA LLC – WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

READ CAREFULLY — THIS IS A LEGALLY BINDING DOCUMENT. ALL PARTICIPANTS (OR THEIR LEGAL GUARDIAN IF UNDER 18) MUST SIGN BEFORE PARTICIPATION.

1. ACKNOWLEDGMENT AND ASSUMPTION OF RISK

I understand and acknowledge that the use of LVLUP USA LLC’s skatepark and training facility and participation in activities such as skateboarding, scooter riding, inline skating, roller skating, parkour, and other similar action sports (“Activities”) are inherently dangerous and involve risks of serious injury, permanent disability, or death.

I voluntarily assume all risks, both known and unknown, including, but not limited to: collisions with other participants or structures, equipment failure, lack of supervision, negligent acts of others, or unsafe conditions.

2. MANDATORY HELMET POLICY (FOR MINORS)

I understand and agree that all participants under the age of 18 are required to wear a helmet at all times while engaging in any activities at the facility. LVLUP USA LLC reserves the right to deny participation or remove any participant who fails to comply with this safety policy.

3. RELEASE OF LIABILITY

To the fullest extent permitted by California and U.S. law, I hereby release and discharge LVLUP USA LLC, its owners, officers, directors, employees, contractors, agents, volunteers, sponsors, affiliates, successors, and assigns (“Released Parties”) from any and all claims, demands, losses, damages, or liabilities whatsoever arising from or related to my participation or my child’s participation in the Activities — including claims arising from the negligence of the Released Parties.

4. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, damages, costs, and expenses (including attorney’s fees) arising from my own or my child’s participation, including any third-party claims arising from injuries caused by our actions.

5. INSPECTION OF EQUIPMENT & FACILITY

I agree that I (or my minor child) will inspect all equipment and the facility prior to participation and will immediately inform LVLUP USA LLC staff of any hazardous conditions. I will not participate or allow my child to participate until such hazards are remedied. I understand that safety checks are performed as a courtesy and do not guarantee safety.

6. PROTECTIVE EQUIPMENT

All participants must wear closed-toe shoes and a helmet while participating in activities. Additional safety gear (knee, elbow pads, wrist guards) is strongly recommended. LVLUP USA LLC may refuse entry or participation to anyone not properly equipped.

7. MEDICAL TREATMENT CONSENT

I authorize LVLUP USA LLC to administer or seek emergency medical treatment for me or my child if deemed necessary. I understand I am responsible for all costs resulting from such care.

8. PHYSICAL CONDITION & HEALTH

I certify that I (or my child) am in good physical condition and have no known medical or health conditions that would increase the risk of injury. I understand it is my responsibility to consult a physician before participating.

9. PERSONAL PROPERTY

I acknowledge that I am solely responsible for my own and my child’s personal belongings while on the premises and that LVLUP USA LLC is not responsible for loss or theft.

10. NAME & LIKENESS RELEASE

I grant permission for LVLUP USA LLC to use my or my child’s image, video, or likeness in any promotional or marketing material, without compensation and without prior notice, unless otherwise restricted by law.

11. GOVERNING LAW AND SEVERABILITY

This agreement shall be governed by and interpreted in accordance with the laws of the State of California and the United States of America. If any part of this agreement is found unenforceable, the remainder will remain in effect.
