Three Birds Axe Lounge



In consideration of being allowed to participate in the activity of axe throwing at Three Birds (hereinafter referred to as "the Company"), I, the undersigned participant, agree to the following terms and conditions:

  1. Assumption of Risk: I am fully aware that participating in axe throwing involves inherent risks, including, but not limited to, the risk of injury, property damage, and even death. I understand and acknowledge that these risks cannot be completely eliminated and I voluntarily assume all such risks associated with participating in axe throwing activities.
  2. Fitness to Participate: I hereby declare that I am physically and mentally fit to participate in axe throwing activities. I have not been advised by a medical professional against participating in such activities, and I do not have any medical condition, illness, or injury that may pose a risk to myself or others while participating in axe throwing.
  3. Release of Liability: In consideration of being permitted to participate in axe throwing activities, I, on behalf of myself, my heirs, representatives, executors, and assigns, hereby release, waive, discharge, and covenant not to sue the Company, its officers, directors, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me or to any property owned by me, whether caused by the negligence of the Company or otherwise.
  4. Indemnification: I agree to indemnify and hold harmless the Company, its officers, directors, employees, agents, and affiliates from any loss, liability, damage, or cost they may incur due to my participation in axe throwing activities, whether caused by my negligence or otherwise.
  5. Personal Property: I understand and acknowledge that the Company is not responsible for any loss, theft, or damage to my personal property while participating in axe throwing activities. I agree to be solely responsible for the safety and security of my personal belongings.
  6. Safety Guidelines: I agree to comply with all safety guidelines and instructions provided by the Company's staff regarding axe throwing activities. I understand that failure to follow these guidelines may result in my immediate removal from the premises.
  7. Photographic Release: I grant the Company the irrevocable and unrestricted right to use photographs or videos of me taken during axe throwing activities for promotional purposes without compensation or notification.
  8. Governing Law and Severability: This waiver shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is located. If any provision of this waiver is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
