Read thoroughly before signing Parental authorization for children under 18 I hereby acknowledge that I have voluntarily agreed to participate in the Mazewood’s Combat Laser Tag and/or Axe Throwing activity located at Campark Resorts in Niagara Falls, Ontario known as ”Combat Laser Tag ”, or “Mazewood Axe Throwing”, on signed date, and I understand and assume all risks associated with laser tag and axe throwing activities. All minor participants (under 18 years of age) must provide written authorization from their parents in order to participate in Campark Resorts & Mazewood Activity Zone, Axe Throwing, Laser Tag, and/or Entertainment areas. It is possible to send the authorization form online or to complete it on site, provided that the signer is the child’s legal parent or guardian. We will not be able to allow a minor to participate without authorization. Axe Throwing and/or Laser Tag and/or Entertainment areas, are hereinafter referred to as "activity". I, the undersigned, understand the risks inherent in axe throwing, laser tag, and entertainment zones including, but not limited to, the possibility of property damage, bodily injury, even death, etc., resulting from equipment breaking or being defective, the playing field, the participant’s physical condition, and all other foreseeable causes related to the activities listed above. I hereby, as the legal parent or guardian of the undersigned, who is under 18 years of age give my child authorization to participate in the activity or activities checked above, and release Campark Resorts & Mazewood from all liability should an accident occur during his/her participation in one of these activities. · I have read ALL the specific instructions in this document and on the Mazewood website or its subsidiaries including Campark.com website related to the activity or activities in which my child is allowed to participate. · I have specifically explained to my child ALL the instructions related to this activity, and have made sure that he/she has understood them. · I consider him/her to be sufficiently mature to follow and respect them. For the valuable consideration of being permitted to participate in Combat Laser Tag, Axe Throwing and Mazewood activities on site, I and each of my heirs, personal representatives, guardians, conservators, agents, successors and assigns, HEREBY RELEASE AND HOLD HARMLESS the following persons and entities (these entities are collectively referred to herein as ”the Company”): (1) Combat Laser Tag/Mazewood Axe Throwing and its owner and operator, Campark Resorts, MazeWood., an Ontario Limited corporation and Canada Limited corporation, and its shareholders, officers, owners, employees, insurers, agents, volunteers, successors and assigns, and any of their subsidiaries, respective members, shareholders, directors, officers, and related persons and entities, in their official and individual capacities; (2) City of Niagara Falls and Niagara Region and its employees and agents: and (3) the landowner who leases the property to MazeWood and its activities. I specifically release these entities from any and all liability, claims, demands, actions, causes of action (including but not limited to negligence), claims of relief, or injuries related to or arising from my being a participant in the Combat Laser Tag/Axe Throwing or my presence at the Company's facilities. I, and each of my heirs, personal representatives, guardians, agents, conservators, successors and assigns, agree; a) not to make a claim against or sue the Company or attach property of the Company; b) to waive any and all claims against the Company; and c) to defend, indemnify. and hold harmless the Company for injury, death, or property damage caused by, resulting from or in any way related to my being a participant in the Combat Laser Tag/MazeWood Axe Throwing or otherwise resulting from my presence at the Company's facility, whether or not such injury, death, or property damage was caused by the negligence of the Company or Company's staff. In the event I, or a representative on my behalf, take any legal action against the Company that is contrary to the terms of this Release, I agree to be responsible for all attorney fees and costs the Company incurs in defending such legal action, including any ultimate verdict or settlement. I HAVE CAREFULLY READ THIS RELEASE AND FULLY UNDERSTAND ITS CONTENTS. ACCEPTANCE OF RISKS: 1. Risk of injury from the activity and equipment utilized is significant, with the potential for permanent disability and death. 2. I may collide with another participant or employees which may result in risk of death, paralysis, or serious injury; 3. I may re-injure a previous injury; 4. This is an indoor and outdoor activity and therefore includes risks associated with exposure to the elements, wild animals and insects, as well as heat exhaustion, hypothermia, and related conditions; the facility is located in an area without medical facilities, and delay may occur in treating health conditions; 5. This is an indoor and outdoor activity and therefore includes risks associated with exposure to varying terrain, uneven ground, ramps, metal laser tag equipment, axes, wood particles and all types of barriers and props in the areas used during play; 6. I may become sick from motions resulting in nausea, vomiting, dizziness, or other illness, and such conditions may decrease reaction time resulting in injury. 7. I am aware of the nature of the events and activities and accept and acknowledge, freely and voluntarily, that there are risks inherent to participation in the activity, in particular the risk of property damage, non-monetary damage and/or physical harm, even death, resulting from, among other things, possible defects in the equipment used during the course of the activity, falls caused by obstacles, ramps or openings located on the trails or course or mazes, physical exertion while participating in the activity, an accident caused by or brought about by a collision between one or more running, moving, and entering and circulating in the dedicated areas for whatever reason and with authorization; and 8. In spite of exposure to these risks, in particular those listed above, I wish to participate in the activity and thereby assume the risks I expose myself to in so doing; and 9. I hereby attest that I am in good health and that I am not suffering from any illness or injury that could be aggravated by engaging in the activity; and 10. Equipment, protective clothing and all necessary or useful accessories allowing me to engage in this activity were provided to me upon my arrival, are in good condition, and appropriate for these uses; and 11. The safety instructions have been explained to me, namely but not limited to: I must not be under the influence of drugs or alcohol when I participate in Axe Throwing and/or Laser Tag and /or Entertainment areas, I must not run on the field or staircases, slide under vehicles or props, enter under railings or blocked areas, fight with others, climb and/or jump on obstacles, fire aimlessly and/or use equipment other than those provided by Campark Resorts & Mazewood; I must keep my barrel pointed down on my laser tag gun when I am off the field; I must not be holding a telephone when I am participating in Laser Tag, Axe Throwing, or in Entertainment zones, I must not be under the influence of drugs or alcohol, I must avoid wearing coats, scarves, loose clothing, open-toe or high-heeled shoes, flip-flops and I must remain in safety zones of facility at all times until given permission to enter axe lane/laser tag area after all players have thrown or played, I must avoid all contact with anything not part of the designated game target or game arena, I must avoid contact between players, I must stop and listen when an employee of Campark Resorts and/or Mazewood indicates, I must tie my hair back if it is long and avoid getting into a fight; and 12. I have read any and all notices posted in the entrances stipulating that Campark Resorts & Mazewood is exempt from liability resulting from nonmonetary damage, bodily harm or property damage, and I understand that this notice serves as a warning of the danger in participating in the activity; 13. I completely understand that all of the rules related to participation in the activity must be strictly followed and that I will be solely responsible for my personal safety at all times; and 14. I understand that it is my responsibility to remove myself immediately from the activity and advise Campark Resorts & Mazewood representatives if, at any time, a dangerous or unsafe situation presents itself or my protective clothing, accessories and equipment are damaged; and 15. I attest that I am at least 18 years old or that I am the legal parent or guardian of the participant. I UNDERSTAND AND ACKNOWLEDGE THAT SIGNING THIS DOCUMENT CONSTITUTES: 16. ACCEPTANCE AND ASSUMPTION OF ALL THE RISKS associated with or inherent to my participation in the activity, including non-monetary damages, property damage and/or bodily harm; and 17. A WAIVER OF LIABILITY AND RELEASE FROM ANY CLAIM OR CAUSE OF ACTION implicating in any way Campark Resorts & Mazewoodand/or any person acting on its behalf for all bodily harm, property damage and/or non-monetary damages resulting from my participation in the activity; and 18. ACKNOWLEDGEMENT that this commitment must be interpreted pursuant to applicable laws of the province in which the commitment is signed; 19. Acknowledgement that I HAVE READ THIS DOCUMENT IN ITS ENTIRETY. I HAVE READ THIS DOCUMENT AND UNDERSTAND THAT BY SIGNING IT, I AM GIVING UP SUBSTANTIAL RIGHTS THAT I WOULD OTHERWISE HAVE TO RECOVER DAMAGES FOR LOSSES RESULTING FROM PARTICIPATION IN THE ACTIVITY, AND I AM SIGNING IT VOLUNTARILY AND IN FULL KNOWLEDGE OF THE FACTS. This list is provided for illustrative and informative purposes only and is not intended to be exhaustive or to in any manner limit the intended broad reach of this release. This agreement is governed by the laws of the Province of Ontario; if any provision is held invalid, it is agreed that the remaining provisions shall remain in full force and effect. I AM AWARE OF THE INHERENT AND OTHER RISKS ASSOCIATED WITH LASER TAG/AXE THROWING ACTIVITIES AND l UNDERSTAND THAT BY PARTICPATING IN THE COMBAT LASER TAG or AXE THROWING, I ASSUME FULL RESPONSIBILITY I ASSUME FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE AND I EXPRESSLY AGREE THAT THE ABOVE RELEASE, WAIVER AND INDEMNITY AGREEMENT IS INTENDED TO BE AS BROAD AND INCLUSIVE AS POSSIBLE. I UNDERSTAND THAT I MAY CHOOSE NOT TO PARTICIPATE IN THE COMBAT LASER TAG or AXE THROWING, AND IN SUCH CASE, I WILL IMMEDIATELY NOTIFY THE STAFF OF MY DECISION. I HAVE READ THIS RELASE OF LIABILITY AGREEMENT AND I UNDERSTAND THAT I AM GIVING UP LEGAL RIGHTS BY SIGNING IT, AND I AM FREELY AND VOLUNTARILY SIGNING IT WITHOUT ANY INDUCEMENT.
