I, the undersigned participant, on behalf of myself and my minor child/children (collectively, “Participant”), hereby acknowledges and agrees as follows with respect to Participant’s participation in activities and use of all facilities (“Facilities”) at the Turnberry Isle Racquet Club at theJW Marriott Miami Turnberry Resort & Spa (“Racquet Club”), including the use of any Racquet Club equipment and/or other personal property (“Equipment”):

  1. Participant acknowledges pickleball, padel, tennis, and similar activities in which Participantparticipates at the Racquet Club is at my/his/her/their own risk and further acknowledges that the Racquet Club will not lend Equipment or permit use of the Facilities unless I have signed this waiver, release, and assumption of risk agreement (“Waiver”).  
  2. Participant voluntarily accepts and assumes all risks of loss and damage to the Facilities and Equipment from any cause, including all risks and dangers incidental to my/his/her/their use of the Equipment and Facilities or my/his/her/their participation in activities at the Racquet Club. 
  3. Participant acknowledges and agrees that my/his/her/their use of the Equipment and Facilities entails known and unanticipated risks that could result in physical, mental, and/or emotional injury, illness, death, disease, loss, and/or damage to Participant, to Participant’s property, and/or to third parties. 
  4. I, on behalf of Participant, myself and my heirs, successors, and assigns, agree to release and defend, indemnify, and hold harmless TB Isle Resort LP dba Turnberry Isle Racquet Club at theJW Marriott Miami Turnberry Resort & Spa, Fontainebleau Development LLC, and their respective management, officers, directors, owners, employees, and agents (collectively, “Released Parties”) from any and all claims, actions, demands, liabilities, and damages (“Claim(s)”) incidental to Participant’s use of the Equipment and/or the Facilities, including, but not limited to, Claims for bodily injury, illness, death, disease, loss, and/or damage to Participant and/or Participant’s property.
  5. Participant voluntarily agrees to abide by and comply with all applicable laws and the Racquet Club’s terms and conditions attached hereto.
  6. Participant currently has no physical and/or mental condition that would impair my/his/her/their ability and capacity to safely use the Facilities and Equipment as intended.
  7. I have read, acknowledge, understand, and accept the terms of this Waiver. I acknowledge and understand that if Participant is injured and/or my/his/her/their property is damaged during my/his/her/their use of the Equipment or the Facilities, Participant has waived my/his/her/their right to maintain a lawsuit against the Released Parties on the basis of any Claim from which Participant has released the Released Parties herein.
  8. I acknowledge and agree that I am permitting my minor child/children to use the Racquet ClubEquipment and Facilities. I agree and acknowledge that even if Racquet Club uses reasonable care in providing the Facilities and Equipment, there is a risk my child/children may be seriously injured and/or killed by using the Equipment because there are certain dangers inherent in the usage of the Facilities and Equipment that cannot be avoided or eliminated. By signing this form, I agree to waive my right and the right of my child/children to recover from the Released Parties for any and all Claim(s) incidental to my child’s/children’s usage of the Facilities and Equipment, including, but not limited to, Claims for bodily injury, illness, death, disease, loss, and/or damage to my child/children and/or my child’s/children’s property.
  9. I acknowledge and understand that if my minor child/children is injured and/or my child’s/children’s property is damaged during his/her/their usage of the Equipment and/or Facilities, I have waived my right and the right of my minor child/children to maintain a lawsuit against Racquet Clubon the basis of any Claim from which I have released Racquet Clubherein.

NOTICE TO THE MINOR CHILD’S PARENT/NATURAL GUARDIAN PURSUANT TO FLORIDA STATUTE 744.301(3): READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF RACQUET CLUB USES REASONABLE CARE IN PROVIDING THE EQUIPMENT AND FACILITIES, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY USING THE EQUIPMENT AND FACILITIES BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE USAGE OF THE EQUIPMENT AND FACILITIES THAT CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM, YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM RACQUET CLUB IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE USAGE OF THE EQUIPMENT AND FACILITIES. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND RACQUET CLUB HAS THE RIGHT TO REFUSE TO LET YOUR CHILD USE THE EQUIPMENT AND FACILITIES IF YOU DO NOT SIGN THIS FORM.

TERMS AND CONDITIONS

Participant is voluntarily agreeing to use the Racquet Club Facilities and Equipment in a proper and careful manner, and Participant hereby acknowledges and agrees:

 

(1) Participant’s entry into, participation in the activities, and use of the Racquet Club Facilities and Equipment entails known and unanticipated risks that could result in physical, mental, and/or emotional injury, illness, death, disease, loss, and/or damage to Participant, to Participant’s property, and/or to third parties.

(2) To use appropriate footwear, such as tennis shoes. Crocs, flip-flops, and related footwear are expressly prohibited.

(3) To accept and assume all risks and dangers incidental to Participant’s entry into, participation in the activities, and use of the Racquet Club Facilities and Equipment.

(4) No readmission is permitted after the date of entry.

(5) No cameras or other recording devices are permitted without written authorization from Racquet Club management.

(6) Racquet Club is not responsible for any lost property, misplaced, or stolen at Racquet Club.

(7) Racquet Club will provide me with a wristband for entry into, participation in the activities, and use of Racquet Club Facilities and Equipment. My wristband will not be replaced, refunded, or exchanged for any reason. 

(8) I shall return the Facilities and Equipment to the Racquet Club in the same condition and appearance when received. A fee of $150.00 will be charged to the Participant via room or membership, should any Racquet Club Equipment used by Participant not be returned or returned in a damaged condition.

(9) I have read, acknowledge, understand, and accept these Terms and Conditions. I acknowledge and understand that if Participant is injured and/or Participant’s property is damaged during my/his/her/their entry into, participation in the activities, and use of Racquet Club facilities and equipment, I have waived my right and the right of my minor child/children to maintain a lawsuit against the Released Parties on the basis of any Claim from which I have released the Released Parties herein.
