Rental Agreement Assumption of Risks & Liability Waiver




  • This Rental Agreement and Waiver of Liability entered into by and between In2Scuba Diving Maui Dive Co. LLC (hereinafter “In2Scuba Diving Maui”) and the Undersigned (hereinafter “Participant”), is done so knowingly and voluntarily according to the following terms and conditions (please check box next to each item):
  • Participant represents that he/she is capable of safely operating and handling any and all rented equipment and finds said equipment in good working order and condition. Participant represents that he/she has adequate skills, knowledge, and experience to safely complete the planned activity and that adequate preparations have been made to ensure the participants safety during the rental period.(Required)

  • Participant shall bear all risk and responsibility for damage, loss, or theft of all rented equipment, and shall pay to In2Scuba Diving Maui the cost to repair, if possible, or the full cost for replacement if repair is not possible. Participant also agrees to allow In2Scuba Diving Maui to charge the Participants credit card used to reserve the rental for the cost of the rented equipment if the Participant fails to return the rented equipment (by signing this agreement you authorize such charges) mask $69, snorkel $29, fins $49, paddle $129, bicycle $400, GoPro $300, sup $1,000, sup fin $50, chair $59, umbrella $59, boogie board $89, surfboard $500(Required)

  • Participant shall wash gear free of sand. Participant shall return all equipment by the return date and time indicated on the rental contract and in the same condition as received. $5 is charged for excessively sandy gear.(Required)

  • Participant understands and accepts that there are inherent dangers and risks associated with the use of the equipment. As such, Participant agrees to holdIn2Scuba Diving Maui indemnified against any and all injury or death of the Participant and Participants family or household members in connection or as a result of the use and rental of In2Scuba Diving Maui's equipment. Participant further expressly releases and holds harmless In2Scuba Diving Maui, its employees, owners, and officers, from any liability for negligence, expense or cost, including attorneys fees, arising out of damages to the person or property of the Participant occurring during the course and as a result of the rental of the equipment. Participant is fully responsible for ALL damages that occur while renting from In2Scuba Diving Maui. Damage caused to others property is solely Participants responsibility and releases In2Scuba Diving Maui of all liability. (Required)
