I desire to participate and to allow and authorize my minor child(ren) and any minor child(ren) in my care (collectively, “my child”) to use and enjoy the activities offered by The Block Parties (as defined below), including entering and using the Kids on the Block play area located at The Block Jacksonville (the “Play Activities”). In consideration of The Block allowing me and my child to participate in the Play Activities and in recognition of The Block’s reliance hereon, I agree to all of the following terms and conditions 1. ASSUMPTION OF RISK: I understand that participating and allowing my child to participate in the Play Activities, including but not limited to climbing, running, jumping, sliding, crawling, and use of play structures, is potentially dangerous and involves inherent risks of serious injury, disability, death and/or property damage. I voluntarily participate and authorize my child to participate in the Play Activities with knowledge of the danger involved and hereby agree to accept and assume all risks, both known and unknown, associated with our participation in the Play Activities. 2. RELEASE & WAIVER OF LIABILITY: I hereby expressly waive and release any and all claims, now known or hereafter known, against The Block Parties on account of injury, disability, death, or property damage arising out of or attributable to my or my minor child’s participation in the Play Activities, whether arising out of the negligence of The Block Parties or otherwise. I covenant not to make or bring any such claim against The Block Parties, and forever release and discharge The Block Parties from liability under such claims. This waiver and release does not extend to claims for intentional torts or any other liabilities that Florida law does not permit to be released by agreement. I shall defend, indemnify, and hold harmless The Block Parties against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees, fees, the costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers, incurred by or awarded against The Block Parties in a final judgment, arising out of or resulting from any claim of a third party related to my or my child’s participation in the Play Activities, including any claim related to my or my minor child’s own negligence or the negligence of The Block Parties. I understand that The Block Parties is not the manufacturer or supplier of the equipment or structures used in the Play Activities and therefore is not responsible for such equipment or structures or any defects therein. I understand that I am responsible for any loss, damages or injuries to property or other persons while I or my child is participating in the Play Activities. 3. PARENT / GUARDIAN RESPONSIBILITY: I certify that I am the parent or legal guardian of the child entering the play area, or that I have full authority to act on their behalf. Adult supervision is required at all times while a child is participating in the Play Activities. 4. HEALTH & SAFETY ACKNOWLEDGEMENT: I certify that my child is physically able to participate in the Play Activities and does not have a medical or other condition that would make participation unsafe. 5. PATRONS-ONLY USE POLICY: Kids on the Block is for The Block patrons only. Access is limited to children accompanied by adults actively patronizing The Block Jacksonville. The Block Parties reserve the right to verify patron status and deny access. The Block Parties reserve the right to deny entrance or remove any person without refund whose conduct is creating a hazard or nuisance to other patrons or who is intoxicated or under the influence of drugs or alcohol or is in violation of any of the posted rules, in the sole and absolute discretion of The Block Parties. 6. PHOTO & VIDEO / MARKETING CONSENT: I grant permission for The Block to use photographs or video recordings taken of me and my child in public areas for marketing purposes without any compensation. I authorize The Block to use my personal information below to market additional products, events or services to me. 7. MISCELLANEOUS: This Release is governed by the laws of the State of Florida. For purposes of this Release, the following entities and individuals are defined as “The Block Parties”: Containerland RE Holdings, LLC, The Block Jacksonville, LLC and their members, managers, employees, officers, owners, contractors, and agents and each of their affiliates, successors and assigns. If my signature is electronic, I agree that it was applied in accordance with the requirements of the federal E-SIGN Act (15 U.S.C. § 7001 et seq.), as well as the Florida Electronic Signature Act of 1996 (Chapter 668, Florida Statutes), and is properly attributable to me and my electronic signature was intended. Allowing my signature electronically is a courtesy extended to me by The Block Parties and I shall not make any claim that this Release is unenforceable based on any defect in electronic execution. NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN PURSUANT TO §744.301, FLORIDA STATUTES READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN THE BLOCK PARTIES USE REASONABLE CARE IN PROVIDING THE PLAY ACTIVITIES, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THE PLAY ACTIVITIES BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE PLAY ACTIVITIES WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM THE BLOCK PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE PLAY ACTIVITIES. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND THE BLOCK PARTIES HAVE THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM. Date: March 19, 2026 |
