Barbell Palace values and respects the privacy of the people we deal with. Barbell Palace is committed to protecting your privacy and complying with the Privacy Act 1988 (Cth) (Privacy Act) and other applicable privacy laws and regulations.

This Privacy Policy describes how we collect, hold, use and disclose your personal information, and how we maintain the quality and security of your personal information.

Under certain circumstances, Barbell Palace may need to collect sensitive information about you. You do not have to provide us with your personal information. Where possible, we will give you the option to interact with us anonymously or by using a pseudonym. However, if you choose to deal with us in this way or choose not to provide us with your personal information, we may not be able to provide you with our services or otherwise interact with you.

How do we collect your personal information?

We collect your personal information directly from you when you:

      interact with us over the phone;

      interact with us in person;

      interact with us online;

      participate in surveys or questionnaires;

      attend a Barbell Palace event;

      subscribe to our mailing list;

      apply for a position with us as an employee, contractor or volunteer;


Collecting personal information from third parties

We may also collect your personal information from third parties or through publicly available sources, for example from Ezidebit. We collect your personal information from these third parties so that we are able to collect payment for membership.

How do we use your personal information?

We use personal information for many purposes in connection with our functions and activities, including the following purposes:

      provide you with information or services that you request from us;

      deliver to you a more personalised experience and service offering;

      improve the quality of the services we offer;

      internal administrative purposes;

      marketing and research purposes;

We may disclose your personal information to third parties in accordance with this Policy in circumstances where you would reasonably expect us to disclose your information. For example, we may disclose your personal information to:

      our third party service providers (for example, our Direct Debit providers);

      our marketing providers;

Some of the third-party service providers we disclose personal information to may be based in or have servers located outside of Australia.

Where we disclose your personal information to third parties overseas, we will take reasonable steps to ensure that data security and appropriate privacy practices are maintained. We will only disclose to overseas third parties if:

      you have given us your consent to disclose personal information to that third party; or

      we reasonably believe that:

○ the overseas recipient is subject to a law or binding scheme that is, overall, substantially similar to the APPs; and

          ○    the law or binding scheme can be enforced; or

      the disclosure is required or authorised by an Australian law or court / tribunal order.

How do we protect your personal information?

Barbell Palace will take reasonable steps to ensure that the personal information that we hold about you is kept confidential and secure, including by:

      having a robust physical security of our premises and databases / records;

      taking measures to restrict access to only personnel who need that personal information to effectively provide services to you;

      having technological measures in place (for example, anti-virus software, fire walls);

Review Barbell Palace Privacy Policy

I understand that the training may involve weightlifting, gymnastic movements, strenuous bodyweight exercises and other high exertion activities, and that I am not obligated to perform nor participate in any activity that I do not wish to do, and that it is my right to refuse such participation at any time during my training sessions. I understand there are inherent risks in all aspects of physical training and I acknowledge that I have been informed of the possible strenuous nature of the training and the potential for undesirable physiological results including, but not limited to, abnormal blood pressure, muscle soreness, fainting, heart attack and/or death. ​I warrant that I do not suffer from any medical condition that may affect my ability to participate safely in strenuous exercise​.

I understand that should I feel lightheaded, faint, dizzy, nauseated, or experience pain or discomfort, I am to stop the activity and inform my trainer. I give Barbell Palace and the staff of the facilities I train in permission to seek emergency medical services for me should I become injured or ill with the understanding that I am responsible for any expenses incurred. If I am signing on behalf of a minor child, I also give full permission for any person connected with Barbell Palace to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well being of the child.

I agree to ​WAIVE ANY AND ALL CLAIMS​ that I have or may have in the future against the gym, and its directors, officers, employees, agents, volunteers and independent contractors (all of whom are hereinafter collectively referred to as “the Releasees”). I agree to ​RELEASE THE RELEASEES​ from any and all liability for any loss, damage, injury or expense that I may suffer, or that my next of kin may suffer as a result of my participation in the programs, activities and services provided by the gym, due to any cause whatsoever including negligence, breach of contract, or breach of any statutory or other duty of care.

I agree to ​HOLD HARMLESS AND INDEMNIFY THE RELEASEES​ from any and all liability for any damage to the property of, or personal injury to, any third party, resulting from my participation in any program, activity or service provided by the releasees. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.

Use of picture(s)/film/likeness:​ I agree to allow Barbell Palace, its agents, officers, principals, employees and volunteers to use picture(s), film and/or likeness of me. In the event I choose not to allow the use of the same for said purpose, I agree that I must inform Barbell Palace of this in writing.


UNDER 18 MEMBERSHIP

 THE MINIMUM AGE FOR A PERSON TO JOIN BARBELL PALACE IS 12 YEARS OF AGE AND MUST HAVE THE APPROVAL OF THEIR PARENT/GUARDIAN BY WAY OF THE BARBELL PALACE APP WAIVER BEING SIGNED BY THE PARENT/GUARDIAN, GRANTING PERMISSION FOR THE UNDER 18 TO TRAIN. ‍

WAIVER

A WAIVER MUST ALWAYS BE COMPLETED BEFORE ANYONE TRAINS IN OUR FACILITY THIS INCLUDES TRIALS, FRIENDS, AND OF COURSE ALL MEMBERS. THIS PROCESS IS DONE VIA THE SMARTWAIVER LINK.

‍RELEASE OF LIABILITY TERMS AND CONDITIONS FOR THE MEMBER AND/OR THE FOR THE PARENT OR GUARDIAN TO SIGN IF THE MEMBER IS UNDER THE AGE OF 18.


I HAVE READ AND UNDERSTOOD THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS FORM I AM WAIVING CERTAIN LEGAL RIGHTS (INCLUDING THE RIGHT TO SUE) WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTOR, ADMINISTERS AND ASSIGNS MAY HAVE AGAINST THE RELEASEES. ANY QUESTIONS I HAD WERE ANSWERED TO MY FULL SATISFACTION.
