Breaking Point Rage Room 

Participation Waiver, Release of Liability, and Assumption of Risk Agreement

PLEASE READ CAREFULLY BEFORE SIGNING

This is a legally binding agreement. By signing below, you acknowledge that you understand and agree to all terms of this Waiver and Release of Liability.

1. Informed Consent and Assumption of Risk

I understand and acknowledge that participation in activities at Breaking Point Rage Room involves inherent and unpredictable risks, including but not limited to physical exertion, the use of tools, contact with sharp objects, flying debris, broken glass, metal, wood, and other materials that may cause injury.

I voluntarily choose to participate with full knowledge of these risks and assume all risks of injury, illness, permanent disability, death, or property damage, whether known or unknown, foreseeable or unforeseeable, arising from my participation.

2. Release and Waiver of Liability

In consideration for being allowed to participate in activities at Breaking Point Rage Room, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby fully release, waive, and forever discharge Breaking Point Rage Room, its owners, officers, employees, contractors, agents, representatives, and affiliates (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, or liabilities, including those arising from negligence, that may occur as a result of my participation.

I further agree that I will not bring or initiate any lawsuit or legal action against the Released Parties related to my participation in any activity at Breaking Point Rage Room.

3. Indemnification and Hold Harmless Agreement

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

● My participation in activities at Breaking Point Rage Room

● My negligent, reckless, or intentional acts

● Any injury or damage I cause to another participant, staff member, or property

4. Medical Condition and Emergency Treatment Authorization

I certify that I am physically and mentally capable of participating in rage room activities and that I do not have any medical condition that would impair my ability to participate safely or place myself or others at risk.

In the event of an emergency, I authorize the Released Parties to obtain medical treatment on my behalf. I understand and agree that I am solely responsible for any medical costs incurred as a result of such treatment.

5. Safety Equipment and Rules

I agree to wear all required safety equipment, including but not limited to helmets, face shields, gloves, protective clothing, and any other gear provided or required by Breaking Point Rage Room. I agree to follow all posted rules and verbal instructions provided by staff.

I understand that failure to follow safety rules or staff instructions may result in immediate removal from the session without refund.

6. Conduct, Sobriety, and Right to Refuse Service

I certify that I am not under the influence of alcohol, illegal drugs, or any substance that could impair my judgment, coordination, or physical ability.

Breaking Point Rage Room reserves the right to deny or terminate participation at any time, without refund, due to unsafe behavior, intoxication, aggressive conduct, or failure to comply with rules or instructions.

7. Property Damage and Personal Belongings

I understand that I may be held financially responsible for damage to the facility, equipment, or property caused by my negligent, reckless, or intentional behavior.

I further acknowledge that the Released Parties are not responsible for lost, stolen, or damaged personal items while I am on the premises.

8. Video Recording, Purchased Footage, and Media Release

I understand and acknowledge that, for safety and security purposes, Breaking Point Rage Room uses video surveillance inside its rage rooms and other areas of the facility. By entering and participating, I consent to video recording of my session and presence on the premises. I understand that customer session footage may be made available for purchase, when offered, as a personal-use keepsake only. Purchased footage is not guaranteed in the event of technical issues, recording failure, or other circumstances outside the control of Breaking Point Rage Room, and no refund shall be owed if footage is unavailable due to such circumstances.

I further understand that Breaking Point Rage Room may retain, review, and use surveillance footage for safety, security, operational, training, incident review, and legal purposes. Separately, I grant Breaking Point Rage Room permission to use photographs, video recordings, or other media taken during my participation for promotional, marketing, or educational purposes, without compensation or further approval, unless prohibited by law.

9. Minors and Parent/Guardian Consent

Participants under the age of 18 must have a parent or legal guardian sign this Agreement.

I understand that some jurisdictions may limit the enforceability of liability waivers for minors, and I nonetheless knowingly and voluntarily consent to the minor’s participation, accepting all risks on their behalf.

10. Governing Law and Venue

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Illinois. Any legal action arising from this Agreement shall be brought exclusively in the courts located in Cook County, Illinois.

11. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ACKNOWLEDGMENT

I HAVE READ AND FULLY UNDERSTAND THIS WAIVER AND RELEASE OF LIABILITY. I AM SIGNING IT FREELY AND VOLUNTARILY AND ACKNOWLEDGE THAT BY SIGNING THIS DOCUMENT, I AM GIVING UP CERTAIN LEGAL RIGHTS.
