Read Carefully: Waiver & Release of Liability

In consideration of being allowed to participate in any way in the Battenkill Valley Outdoors facility, its related events and activities, I acknowledge, appreciate, and agree that:

1. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

2. I KNOWLINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the Company immediately, and.

4. I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS BATTENKILL VALLEY OUTDOORS, their officers, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used for the activity. (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with my presence or participation, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

The Venue of any dispute that may arise out of this agreement or otherwise between the parties to which the Battenkill Valley Outdoors or its agents as a party shall be the Town of Jackson, New York, Justice Court or the County or State Supreme Court in Washington County.

BY SIGNING THIS WAIVER, I ACKNOWLEDGE THAT I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

Oath of Responsibility

By signing this waiver, I do solemnly swear to:

• Always wear a life jacket while in the boat, and a helmet while bicycle riding

• Treat the equipment with care: Report any maintenance issues

• On the river,

o Be respectful of other river users, be courteous to fishermen and float quietly behind them

o Practice river stewardship: no open containers or unruly behavior, carry in-carry out all trash

o Respect private landowners and privately owned banks of the Battenkill

• Be responsible for the equipment while in my care. I understand Battenkill Valley Outdoors does everything it can to keep the equipment in top shape. Any misuse of the equipment is my responsibility and I will pay for damages, or replacement, at the discretion of the owner or manager.

• Take responsibility for minors in our group to be aware of these responsibilities

To be used for minors only- up to 18 years old

In consideration of being allowed to participate in any way in the Battenkill Valley Outdoors facility, its related events and activities, by signing this waiver, I (as parent / guardian with legal responsibility) acknowledge, appreciate, and agree that:

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all Releasees, and for myself, my child and our heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my child’s involvement or participation in these programs as provided above, EVEN IF ARISING FROM NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.

Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.
