LIABILITY WAIVER


Participants Release of Liability and Assumption of Risk Agreement

 

In consideration of being allowed to participate in activities provided by Soulsalt Yoga, Bodysoundspirit, or to other organizations, including the Luminary House, and Steve M. Watkins III Revocable Trust, owner of 41 Commerce St Apalachicola, FL 32320 I, for myself,   

1. ACKNOWLEDGE, agree, and represent that I understand the risks and nature of the activities related thereto (collectively, the "Activities"), confirm that I am physically and mentally capable of performing the Activities and participating in the activities, and agree to comply with the terms and conditions of the Contract as well as any rules regarding participation in such Activities.

2. HEREBY RELEASE, WAIVE, DISCHARGE, COVENANT NOT TO SUE, AND INDEMNIFY SAVE, AND HOLD HARMLESS FROM ANY LITIGATION EXPENSES, ATTORNEYS' FEES, LOSS, DAMAGE OR COST INCURRED, THE ORGANIZATION AND OTHER RELEASEES FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, INJURIES, DAMAGE TO PROPERTY, WRONGFUL DEATH, LOSS OF SERVICES, LOSS PROFITS, CONSEQUENTIAL, EXEMPLARY, INDIRECT, PUNITIVE, OR OTHER DAMAGES WHICH MAY ARISE OUT OF OR OCCUR AS A RESULT OF MY PARTICIPATION IN THE ACTIVITIES, INCLUDING, BUT NOT LIMITED TO NEGLIGENT RESCUE AND/OR FIRST-AID OPERATIONS, TO THE GREATEST EXTENT ALLOWED BY LAW.

3. MY SIGNATURE ON THIS LIABILITY WAIVER OR THE CORRESPONDING AGREEMENT INDICATES THAT I HAVE, ON THE DATE SHOWN, READ AND UNDERSTOOD THIS DOCUMENT, THE. AGREEMENT AND THE TERMS AND CONDITIONS, THAT HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND I ACKNOWLEDGE THAT IT AFFECTS MY LEGAL RIGHTS AND AGREE TO BE BOUND BY ITS TERMS. I SPECIFICALLY UNDERSTAND THAT I AM RELEASING, DISCHARGING AND WAIVING ANY CLAIMS OR ACTIONS THAT I MAY HAVE PRESENTLY OR IN THE FUTURE FOR THE NEGLIGENT ACTS OR CONDUCT OF THE ORGANIZATION AND OTHER RELEASEES. I agree that if any term set forth in this document is found to be unenforceable, such term shall be deemed severed from this document and the remainder of the document shall remain in full force and effect.

4. Third Party Liability: You acknowledge and agree that you are solely responsible for all property damage or bodily injury arising out of or relating to your use and operation of the Equipment and that the Organization provides no liability protection or insurance to you or to any Participants. You agree to defend, indemnify, and hold harmless Organization and its or their officers, directors, employees, and agents for all Claims arising out of or resulting from your use and/or operation of the Equipment. You further assume all risk involved in the use and/or operation of the Equipment and acknowledge the inherent and natural hazards and perils of boating waterways.

5. Notice of Loss or Damage: You agree to immediately report any accident, loss, or damage to the Equipment to the Organization's Use agent, and further agree to cooperate and provide written or oral statements to the Organization or its or their designated representative as reasonably requested by the Organization or its or their designated representative. You must not incur any expenses in the event of breakdown without the express permission of the Organization.
