BASE Waiver and Rules In consideration of the services of Big Sky Community Organization, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as “BSCO”), I hereby agree to release, indemnify, and discharge BSCO, on behalf of myself, my children, my parents, my heirs, assigns, personal representatives and estate as follows: 1. I acknowledge that all activities at BSCO/BASE, including, but not limited to, climbing/bouldering on or being near an artificial climbing/bouldering wall, using fitness equipment, using climbing equipment, ascending ropes, physical presence at BSCO/BASE, using belay equipment, using auto belay device, using a locker room, and/or participating in yoga and/or fitness classes entail known and anticipated risks that could result in physical or emotional injury, paralysis, death or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. I understand that all activities at BSCO/BASE, including, but not limited to, climbing/bouldering or being near an artificial wall, using fitness equipment, using climbing equipment, using belay equipment, using auto belay device, slacklining, rappelling, bouldering, ascending ropes, using a locker room, physical presence at BASE, using fitness training equipment and/or participating in yoga and/or fitness classes are inherently dangerous and cannot be considered safe. The risks include, among other things: falling off the wall; loose, spinning, and/or damaged artificial holds; holds broken off or falling from the wall; equipment failure; falling to the ground, on other users, or being fallen on by other users; abrasions from the walls, ropes, pads or the floor; belay and or belayer failure; climbing out of control or beyond one’s personal limits; the negligence of other climbers, visitors, participants, or other persons who may be present; musculoskeletal injuries and/or over training; head injuries; cardio respiratory stress; or my own negligence. Furthermore, BSCO/BASE employees have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant’s fitness or abilities. They may give inadequate warnings or instruction, and the equipment being used might malfunction. 2. I expressly agree and promise to accept and assume all the risks existing in the activities at BSCO/BASE. My participation in these activities is purely voluntary, I am fully aware of all risks affiliated with the activities at BSCO/BASE, and I elect to participate in spite of the risks. 3. I expressly agree and promise to accept and assume all the risk existing in the usage of personal climbing equipment at BSCO/BASE. 4. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless BSCO/BASE from any and all claims, demands, or causes of action, which are in any way connected with my participation in these activities. My participation in these activities or my use of BSCO/BASE’s equipment or facilities, including any such claims which allege negligent acts or omissions of BSCO/BASE. 5. Should BSCO/BASE or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs. 6. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have. 7. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in these activities, I may be found by a court of law to have waived my right to maintain a lawsuit against BSCO/BASE on the basis of any claim from which I have released them herein. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms. Rules & Regulations: General: 1. Passholders 11 years and younger must be accompanied by an adult. Passholders must be 12 years or older to be unaccompanied in BASE. BASE staff is not responsible for the supervision of children outside of a monitored BASE program. 2. Everyone must check-in at the BASE desk upon entering. 3. BASE is a substance free building during the hours of operation. 4. BASE is a bully free zone and those in BASE are asked to practice kindness in all interactions and sportsmanship in all activities. 5. For your safety, no running in SPark and other lobby areas. 6. This facility is a family-friendly environment. We ask that you always dress appropriately and avoid the use of inappropriate language. 7. The facility doors will be locked for entry 30 minutes prior to closing. 8. Ski boots, work boots and/or muddy shoes are not allowed in the facility. 9. Smoking, tobacco, and vape products are not allowed in or around the facility. 10. Report any damaged or broken equipment to staff. 11. BASE and the BSCO reserves the right to use photographs, videotaped images, quotes/comments, and name for publicity and educational purposes in any and all publications and media without limit or reservation. 12. Bicycles, rollerblades, skateboards, scooters are not permitted inside BASE. 13. The use of the climbing wall, Fitness Center, and HIVE is prohibited while under the influence of drugs and alcohol. Fitness Center and HIVE 1. Do not drop free weights or allow weight stacks to slam. 2. For your safety, you must be 14 years of age to use the Fitness Center equipment. 3. Proper attire is required while participating in fitness programs, using the HIVE and fitness center. Proper attire is defined as shirt, pants/shorts, and athletic shoes. 4. Hanging on rims or nets is strictly prohibited. Violators will be asked to leave the facility. 5. All equipment must be used according to the directions posted on the machine or as directed by the Fitness & Wellness staff. 6. Re-rack all free weights after you have finished using them. 7. Be courteous of others when using Fitness Center equipment and allow others to rotate in while using weight equipment.
Fees and Registration: 1. The use of BASE is a privilege of our community and participants are expected to be good citizens and respect the rights of others. Individuals who engage in unacceptable or irresponsible behavior may have their access to the facility revoked, suspended or modified indefinitely. 2. BASE merchandise is nonrefundable. 3. BASE reserves the right to: a. Revoke or suspend a membership or program/class/gym participation. b. Enforce necessary community center cleanup if the situation warrants that repercussion. c. Be closed on & around major holidays and for deep cleaning needs. 4. All BASE passes BASE passes are nontransferable and nonrefundable. BASE does not provide refunds retroactively for any cancellation requests. BASE does not issue refunds if you do not use your pass. No exceptions. 5. All annual passes are under a 1-year contract, billed monthly. If you choose to cancel your BASE pass you will be charged a $250 cancellation fee. The Annual Membership will automatically renew once your year contract has been fulfilled. 6. Be advised that BSCO reserves the right to send any unpaid balance to a third-party collection agency.
7. If you choose to cancel the 3- or 6-month pass you will be required to pay the remaining months you owe. 8. BASE reserves the right to modify pass rates, modify the schedule of fees and fee structure, and adjust the rules and regulations.
