Oldest City Surf School - Surfboard Rental Agreement and Waiver

I, hereby agree to rent a surfboard from Oldest City Surf School. I acknowledge and accept the inherent risks associated with surfing and agree to the following terms and conditions:

  1. Assumption of Risk: I understand that surfing involves inherent risks, including but not limited to, the risk of injury from falls, collisions, currents, waves, marine life, and other surfers. I voluntarily assume all risks associated with surfing and waive any claims against Oldest City Surf School, its instructors, employees, and affiliates for any injury, loss, or damage arising from my participation in surfing activities.
  2. Equipment Responsibility: I agree to inspect the surfboard for any damage or defects before use. I will use the rented surfboard in a safe and responsible manner. I am responsible for returning the surfboard in the same condition as it was rented, normal wear and tear excepted. I understand that I am liable for any damage to the surfboard incurred during the rental period, including repair or replacement costs.
  3. Safety Guidelines: I agree to abide by all safety guidelines and instructions provided by Oldest City Surf School staff. I will not surf in restricted areas, surf under the influence of drugs or alcohol, or engage in reckless behavior that may endanger myself or others.
  4. Indemnification: I agree to indemnify and hold harmless Oldest City Surf School, its owners, instructors, employees, and affiliates from any claims, liabilities, damages, or expenses arising from my use of the rented surfboard, including but not limited to personal injury, property damage, or loss.
  5. Release of Liability: In consideration of being permitted to rent a surfboard from Oldest City Surf School, I hereby release, waive, discharge, and covenant not to sue Oldest City Surf School, its owners, instructors, employees, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while using the rented surfboard.
  6. Agreement Binding: I understand that this agreement is binding upon myself, my heirs, assigns, legal representatives, and any other persons claiming by, through, or under me.

I acknowledge that I have read and fully understand the terms of this Surfboard Rental Agreement and Waiver, and I voluntarily sign it of my own free will.
