ASSUMPTION OF RISK, RELEASE OF LIABILITY AND HOLD HARMLESS AGREEMENT

THIS IS A LEGAL DOCUMENT. READ IT CAREFULLY BEFORE SIGNING.

I wish to engage and/or participate in outdoor activities, including, but not limited to, shooting sports, archery sports, hunting, and/or ATV and golf cart riding (collectively the “Activities”) on property owned, leased or licensed by National Helice Sporting Complex, JDW Auto Investments, Justin Wright, and Clarence Cook.

I understand and accept that my engaging in or participating in any or all Activities exposes me to many risks and dangers. Some of the risks which may be present or occur include, but are not limited to death, serious neck, spinal or other bodily injuries which may result in complete or partial paralysis, brain damage, serious injury to my musculoskeletal system, and serious injury to other aspects of my general health and well-being. I also understand that the risks in engaging or participating in the Activities include not only the foregoing physical injuries, but also impairment of my future abilities to earn a living, to engage in business, social and recreational activities, and generally to enjoy life.

Understanding the risks mentioned above and understanding that the Activities may subject me to rigorous physical exertion, I hereby state that I am physically fit to participate in these activities.

In consideration of my being permitted to engage and/or participate in the activities, I agree to abide by and to cause my guests to abide by all rules and policies of National Helice Sporting, JDW Auto Investments, Justin Wright, and Clarence Cook related to the Activities.

In consideration of my being permitted to engage and/or participate in the Activities, and as a condition of the right to participate in the Activities, I personally assume all risks incident to such Activities. I also waive, release and forever discharge National Helice Sporting, JDW Auto Investments, Justin Wright, Clarence Cook and all of their employees, managers, members, partners, officers, directors, stockholders, contractors or agents (collectively, the “releasees”), from all liabilities, losses, damages or costs of any nature that may arise in connection with my travel to or from, engagement or participation in any or all Activities (including rescue activities associated with the Activities), whether caused by the negligence of the releasees or caused by some other means. I hereby agree not to file suit against any of the releasees. I agree to indemnify and hold the releasees harmless from all liabilities, losses, damages or costs of any nature that may arise in connection with my travel to or from or participation in any or all Activities, including rescue activities, whether caused by the negligence of the releasees, or others, or caused by some other means. The terms of this document shall bind me, my heirs, successors, assigns, and personal representatives.

I have not been required to engage or participate in any or all of the Activities. I have freely chosen to do so. Prior to signing this document, I have had an adequate opportunity to read and understand it, have had an opportunity to ask questions about it, and any questions I had have been answered to my satisfaction. I further state that I am 18+ years old and competent to sign this document.

This agreement shall be effective on a continuous basis beginning as of the date written below and shall cover and govern all Activities referred to herein from such date through the later of the third anniversary of such date.

In addition to the above, I agree to allow National Helice Sporting, JDW Auto Investments,

Justin Wright, and Clarence Cook to use any and all photographs and/or videos of the Activities, and/or the participants and guests for the purposes of advertising, and I hereby consent to such use.

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed under the laws of the State of Texas, and any disputes shall be resolved in the courts of Wichita County, Texas. Any dispute arising out of or relating to this Agreement shall be resolved through binding arbitration in accordance with the rules of the [Insert Arbitration Organization], and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Duration and Revocation

This Agreement remains in effect for three (3) years from the date signed unless revoked in writing by the Participant.

DAMAGE OR THEFT

I also agree that if I, or anyone in my group, cause damage or theft to any of the buildings, equipment, or property of National Helice Sporting, JDW Auto Investments, Justin Wright, and Clarence Cook, I and/or my group are financially responsible to repair or replace any damaged property or equipment, including any legal fees or collection expenses.

This release shall be fully binding permitted by law. If any provision of the release is found to be unenforceable, the remaining terms shall be enforceable.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND

I FULLY UNDERSTAND ITS TERMS AND UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS BY SIGNING IT AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
