Chesapeake Boating Academy - Private On-Water Instruction

 Information, Waiver and Photo Release Forms

Welcome to Chesapeake Boating Academy (“CBA”). Please review and sign the waiver. Please also complete the questions at the end so we can provide the best instruction possible during your private lesson. 

I. Legal Compliance:

Participation in this course requires physical stamina, motor coordination, and mental alertness. The undersigned hereby attests that they have no known physical or mental limitations and has not used any form of alcohol, prescription or non-prescription drugs that could impair their performance in this course. Participants under 18 years of age must have this form signed by a parent or guardian. Each person aboard the vessel during the lesson must sign an individual waiver.

Participants acknowledge that boating occurs in a dynamic marine environment involving vessel movement, wakes, weather conditions, and wet surfaces. Participants voluntarily assume all risks associated with their physical ability to safely board, move about, and participate in activities aboard a vessel. Chesapeake Boating Academy, its Captains, instructors, contractors, and agents shall not be responsible for injuries resulting from a participant’s physical condition, balance limitations, mobility limitations, dehydration, seasickness, fatigue, or undisclosed medical conditions.

Chesapeake Boating Academy (“CBA”) upholds all relevant laws and regulations. Participants must comply with U.S. Coast Guard (USCG) requirements, including age restrictions, safety equipment, and state laws.

Private on-water instruction may occur on navigable waters of the United States and therefore constitutes maritime activity subject to federal admiralty and maritime jurisdiction. This agreement shall be governed by the General Maritime Law of the United States and, where not inconsistent, the laws of the State of Maryland and the Commonwealth of Virginia.

The Instructor-Captain should be added to the boat owner's insurance policy as an “Additional Operator.” Chesapeake Boating Academy (“CBA”) will provide the Captains credentials that can then be forwarded to the insurance company. Please provide proof that the Captain has been added on as an “Additional Operator” on the insurance policy. Once obtained, please email training@boatingacademy.net proof of the captain on the policy as an additional operator.

Boat owner further agrees to indemnify and hold harmless Chesapeake Boating Academy, its Captains, instructors, contractors, employees, and agents from any claims, losses, damages, or liabilities arising from the ownership, maintenance, condition, or operation of the vessel used during instruction.

II. Protocols:

Scheduling: Sessions can be scheduled at mutually convenient times, subject to instructor availability. Generally, Chesapeake Boating Academy will send over a list of dates and times that Captains are available. Once there is an agreed upon date and time, it will be added to the schedule.

Rescheduling/Cancellation: Sessions may be rescheduled due to inclement weather or unforeseen circumstances. Cancellations require a minimum of 7 days notice. We understand that things can happen, please call Chesapeake Boating Academy at 410-829-5057 to discuss if there is a last minute cancellation needed. Safety Briefing: Our certified instructors will conduct a thorough safety briefing before each session, covering emergency procedures, onboard equipment, and best practices.

Communication: Clear communication between the instructor and participants is crucial. Please follow all instructions promptly for a safe and effective learning experience.

Under maritime law and long-standing maritime custom, the Captain of a vessel has full authority over vessel operations and safety decisions. The Instructor-Captain has full authority during the lesson and participants agree to follow all instructions immediately. Failure to comply may result in termination of the lesson without refund if the Captain determines conditions are unsafe.

Fee Structure: Payment is due in full before the start of the private on-water instruction session. 

  1. Up to 30’ Boat: $550 for private on-water training - 3 hour minimum

       a.$150 an hour for each additional hour

  2. 31’- 40’ Boat: $600 for private on-water training - 3 hour minimum

       a. $175 an hour for each additional hour

  3. 41’ - 50’ Boat: $650 for private on-water training - 3 hour minimum

       a. $200 an hour for each additional hour

  5. Travel Time for Instructor: Travel to and from your vessel's location is billed at .70 cents per mile. The round trip cost is based on the start and end location for the assigned Captain. 

Student to Instructor Ratio: Chesapeake Boating Academy’s (“CBA”) 3 Hour Private instruction is not to exceed 4 students.

Participants acknowledge that docking practice, close-quarters maneuvering, and emergency vessel handling exercises may involve inherent risk of vessel contact or equipment damage and agree that Chesapeake Boating Academy and its Captains shall not be liable for damage to participant-owned vessels or equipment during instruction.

Weather: Private on-water instruction will be canceled for weather if the wind is in excess of 20 knots and/or if there is thunder and lightning. Generally we will not reschedule for intermittent light rain, but if the rain is heavy and reduces visibility, we will cancel and reschedule.

The Instructor-Captain retains sole discretion to determine whether weather or sea conditions are safe to conduct or continue instruction.

III. USCG Requirements:

Participants are responsible for meeting USCG requirements for their vessel including safety gear and complying with age restrictions for the specific watercraft.

Chesapeake Boating Academy provides instructional services only and does not assume responsibility for vessel compliance, mechanical condition, or regulatory deficiencies of participant-owned vessels.

IV. Boat Owner/Client Responsibilities:

The owner of the vessel should ensure that the vessel is in good working order prior to the start of the lesson.

Boat owners will be responsible for paying for on-water assistance if the vessel breaks down during the lesson.

Boat owners represent that the vessel used for instruction is seaworthy, properly maintained, and compliant with applicable federal and state boating laws.

It is strongly recommended that all people buy a TowBoatUS Saltwater Membership prior to the lesson. In the event of an unforeseen breakdown, a professional, local towboat can be called to get your boat safely back to the dock or ramp. CBA’s sister company, TowBoatUS Kent Narrows is offering $50 off on new BoatU.S. Saltwater Memberships. Normally $215, with our discount you only pay $165 for a 1 year BoatUS Saltwater Membership. Boat owners will be responsible for paying for on-water assistance if the vessel breaks down during the lesson if the owner does not have marine assistance towing membership or endorsement on their insurance policy.

V. Waiver of Subrogation and Insurance Protection

If instruction occurs aboard a participant-owned vessel, the vessel owner agrees that their vessel insurance policy shall be primary for any loss or damage occurring during instruction. Vessel owner further agrees that their insurance carrier shall waive any right of subrogation against Chesapeake Boating Academy, its Captains, instructors, contractors, agents, or affiliated personnel for claims arising from the operation of the vessel during instruction.

WAIVERS:

Participation in this course requires physical stamina, motor coordination, and mental alertness.

Participants acknowledge that boating activities involve inherent risks including vessel collision, slips and falls on wet surfaces, falling overboard, propeller hazards, docking accidents, equipment malfunction, marine traffic, and changing weather conditions which may result in serious injury, disability, property damage, or death. The participants voluntarily assume all such risks.

VI. Legal Release Assumption of Risk, Waiver and Covenant Not to Sue Agreement

In consideration of Chesapeake Boating Academy (“CBA”) furnishing services, equipment, and/or curriculum to enable me to participate in the Boating Course, I agree as follows:

The term “Course Providers” includes Chesapeake Boating Academy, its owners, Captains, instructors, employees, contractors, vessel owners, marinas, agents, and affiliated personnel.

VII. Indemnification and Hold Harmless Agreement

I agree to hold harmless, defend, and indemnify the Boating Course Providers from any and all claims.

This indemnification includes claims brought by third parties, vessel owners, passengers, insurance companies, or other participants arising from my participation in boating instruction and includes reimbursement of reasonable attorneys’ fees and legal costs.

VIII. Limitation of Liability

To the fullest extent permitted by law, the maximum liability of Chesapeake Boating Academy, its Captains, instructors, employees, contractors, and affiliated personnel for any claim arising out of participation in instruction shall not exceed the total amount paid for the training session.

IX. Waiver of Jury Trial

Participant and Chesapeake Boating Academy knowingly and voluntarily waive the right to trial by jury in any legal proceeding arising out of or relating to participation in boating instruction.

X. Maritime Arbitration Clause

Any dispute, claim, or controversy arising out of participation in boating instruction shall be resolved through binding arbitration in the State of Maryland in accordance with the rules of the American Arbitration Association.

By participating in private on-water instruction with Chesapeake Boating Academy, I acknowledge and agree to the following:

I understand the inherent risks associated with boating and will follow all safety instructions provided.

To my knowledge I am in good physical and emotional health equivalent to the demands of this outing.

I release Chesapeake Boating Academy, its Captains, and affiliated personnel from any liability for personal injury, property damage, or other claims arising from my participation.

I confirm that my vessel meets all USCG and state regulations and requirements and will comply with all relevant laws and regulations during the instruction session.

This agreement is intended to be as broad and inclusive as permitted by applicable maritime law and state law. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment of Agreement and Single Signature Binding Clause

By signing below, the Participant acknowledges that they have carefully read this entire document and understand that it contains important legal rights and obligations

The Participant acknowledges that this agreement applies to all sections contained within this document whether or not each section is individually signed or initialed.

The Participant further acknowledges that a single signature below constitutes acceptance and agreement to all terms, conditions, releases, waivers, indemnifications, and acknowledgments contained in this entire document.

The Participant confirms that they are signing this agreement voluntarily and understand that they are releasing certain legal rights, including the right to bring certain legal claims against Chesapeake Boating Academy, its Captains, instructors, contractors, agents, affiliated personnel, vessel owners, and Course Providers.

If the Participant is signing on behalf of a minor, the parent or legal guardian acknowledges that they have the legal authority to do so and agree to indemnify and hold harmless Chesapeake Boating Academy and its personnel from any claims brought on behalf of the minor.

Consent and Release for Use of Image, Voice and/or Name

I, the undersigned, hereby grant to Chesapeake Boating Academy (“CBA”), the right and permission to use my name, image, photograph, voice, likeness and/or personal information, in connection with motion pictures, sound recordings, photographs, publications and/or other media, including use on a website, without further notice to me and for consideration which I hereby acknowledge. I shall have no right of approval and no claim arising out of the use, alteration, distortion or illusionary effect, or use in any composite form, of my image, likeness, voice, name or personal information.

In connection with participation in a Boating Course, Captain, Course Operator, or affiliate may take photographs and video of the PARTICIPANT and BOAT. The PARTICIPANT agrees that Chesapeake Boating Academy (“CBA”)shall have:

  1. The unlimited right and permission to use, distribute, publish, exhibit, digitize, broadcast, display, and reproduce PARTICIPANT’s likeness, name, picture, and voice (“Likeness”) anywhere in the world for any purpose including, without limitation, advertising and trade, in connection with the Boating Course and other services offered by Chesapeake Boating Academy;
  2. Sole ownership and sole authority over the content of any advertisements, promotions and other materials which may contain PARTICIPANT’s Likeness; and;
  3. All ownership rights, including copyright and all other intellectual property rights of any advertisement, promotions, and any other materials produced by Chesapeake Boating Academy or at the before mentioned direction. 

The PARTICIPANT hereby irrevocably authorizes Chesapeake Boating Academy (“CBA”) to edit, alter, copy, exhibit, publish or distribute any image, audio, and/or video with PARTICIPANT’s Likeness for any lawful purpose. The PARTICIPANT will receive no notice of the use of the Likeness, and has voluntarily agreed to have his/her picture taken and/or voice recorded and waives the right to inspect or approve the finished product, including any written or electronic copy. Additionally, the PARTICIPANT waives any right to any claim of royalties, consideration, or other compensation and any other claims (including, without limitation, claims based upon invasion of privacy, defamation, or right of publicity) arising out of or related to the production, exhibition, or other use of the images, audio, and/or video captured.
