ASSUMPTION OF RISK AND WAIVER OF LIABILITY

The health and safety of our Members and Guests is our highest priority. While our Policies and Rules are designed to protect you, Church Club, LLC ("the Club") cannot remove all risk, or otherwise guarantee or promise that you will not sustain any injuries or damages associated with your use of our pickleball courts, equipment, services, activities, products, facilities, or premises.

Assumption of Risk. Guest acknowledges that participation in athletic activities, including but not limited to pickleball, involves inherent risks including serious injury, disability, or death. Guest voluntarily assumes all risks associated with use of Club facilities and participation in Club activities.

Waiver and Release. Guest, on behalf of themselves and their heirs, executors, administrators, guests and assigns, hereby RELEASES, WAIVES, DISCHARGES, and COVENANTS NOT TO SUE the Club, its owners, officers, managers, employees, agents, contractors, and insurers (collectively “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any injury, including death, that may be sustained by Guest while in, around, or upon Club premises, while participating in any Club activity, or otherwise in any way relating to the Club, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.

Personal Property.  Guest, as a condition of invitation to use the Club facilities by a Member, assumes sole responsibility for their personal property. Guest acknowledges and understands that Club shall not be responsible for any loss or damage to any personal property which Guest may use or store on the Club premises, whether in lockers or elsewhere. Guest also acknowledges and understands that the Member shall be liable for any property damage at the Club, or at any activity or function operated, organized, arranged or sponsored by the Club, which Guest may cause. Guest agrees that Club may charge the cost of any such damage to the Member’s Club account.

Indemnification. Guest agrees to INDEMNIFY and HOLD HARMLESS the Released Parties from any loss, liability, damage, or costs, including attorney fees, that any Released Party may incur in connection with Guest's use of Club facilities, or in any way arising out of the Club, whether caused by the negligence of Club staff , Guest, other members or otherwise.

Medical Emergency. Guest authorizes the Club to obtain emergency medical treatment on Guest's behalf if necessary. Guest is responsible for all costs associated with such treatment.

I have read and understand the language contained herein, and acknowledge my consent to the terms of this ASSUMPTION OF RISK AND WAIVER OF LIABILITY.

I certify that I am at least 18 years of age. I understand that no person under 18 years of age is permitted to use the Club facilities.

If I choose to consume alcoholic beverages on the premises, I certify that I am at least 21 years of age and will provide valid identification upon request.
