GUEST LIABILITY WAIVER  

I. RELEASE FROM LIABILITY 

As a guest to Running Water Hunting, LLC, I, including my minor children and immediate family members, do waive, release, and hold harmless the owners of Running Water Hunting, LLC from any liability that I/We might otherwise incur in connection with injury, death or loss due to the use of the land or facilities, regardless of whether said liability is a result of injury to my person or possessions, provided that said injury or harm does not result from intentional misconduct.  

II. ASSUMPTION OF RISK 

Further, I am aware that the property to which I am a guest is largely unimproved land, and that both man-made and natural hazardous conditions may exist which may be considered dangerous. I hereby release the above-mentioned parties and Owners from any duty to disclose to me those conditions, and also release the aforementioned parties from any duty owed to me or anyone I may cause or allow to come onto the land or facilities, to discover and repair those conditions. Realizing that said dangerous conditions might exist or come to exist, I totally assume the risks of any activities that I, or anyone I cause to come onto the property might pursue.  

Specifically, if hunting, I agree to abide by all game laws and assume all attendant risks with such a dangerous activity, whether those risks arise from the use of firearms, bows or other weapons used by myself or others, or that arise from natural, artificial or man-made conditions existing on the property, including, but not limited to the use of any elevated hunting platform, or tree-stand. Moreover, if I choose to ascend or use any elevated hunting platform or tree-stand, I assume all risks and assume such platform or tree-stand is not safe. I further agree to wear an approved safety harness where appropriate; and check to insure that all tree-stand straps and attachments are secure and in good-working condition before ascending or leaving the ground. Moreover, I also assume totally the risks attendant from all other activities I may engage in, including, but not limited to the use of recreational vehicles, archery, swimming, wading, shooting, ATV’s, etc.  

III. INDEMNIFICATION 

This Agreement shall be at no cost to the Owners. I, hereby agree to indemnify and save the above-mentioned Owners harmless from any loss, costs, claims, or demands including all attorney's fees and costs associated therewith, and arising out of, my exercise of the rights under this license. I further understand that I am voluntarily giving up important legal rights by agreeing not to sue or cause suit to be filed, or to be a party in a lawsuit against the Owners of the above-mentioned property.
