ASSUMPTION OF THE RISK AGREEMENT


WHEREAS, in consideration of the use of the shooting range and facilities operated by SC Gun Store, LLC d/b/a The Gun Store, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Undersigned agrees to the following:

I. The Undesigned hereby acknowledges and agrees to have voluntarily applied to use the shooting range and facilities operated by The Gun Store. It is understood and acknowledged that the use of a shooting range in which others, as well as the Undersigned, are engaged in shooting activities involves inherent extreme hazards, dangers, and risks. The Undersigned represents that he/ she is physically able, emotionally stable, and fully competent to participate in training and shooting activities and that he/ she freely, knowingly, and voluntarily assumes the risks of participating in such activities, including the risks of property damage, bodily harm and death.

This Release of Liability/ Agreement to Use the range and other facilities for any and all purposes is the entirety of the terms. There will be no change or exception unless placed in writing and signed by all parties.

2. The Undersigned affirms that he/she has and will refrain from being under the influence of alcoholic beverages or medications that might impair judgment prior to, and during shooting sports activities. Further, the Undersigned affirms that he/she understands the possession and influence of unlawful drugs is expressly prohibited on The Gun Store property, and that any person(s) who, strictly by our observations, appear to be under the influence of alcohol or unlawful drugs or emotionally unstable, shall be denied access to any part of the shooting range facility.

3. The Undersigned affirms, under penalty of law and perjury, that he/she can legally possess or rent a firearm and that he/ she has no criminal or mental background that restricts the Undersigned from such possession. The Undersigned acknowledges that certain ammunition is restricted on this range and that he/she may not use steel or aluminum case armor piercing, steel core, incendiary, tracer or reloaded ammunition outside of manufacturers' specifications- If such is used, any damages resulting from such use may be billed directly the Undersigned.

4. The Undersigned acknowledges, understands and agrees to follow all shooting range and facilities rules and directives along with proper firearm safety and handling.

5. The potential risk of injury from activity and weaponry involved in shooting is significant including the potential for permanent disability and death, and while particular protective equipment and personal discipline will minimize the risk, the risk of serious injury does exist. The Undersigned understands the assume complete liability for their actions while on the premises and engaged in the use or visiting the location. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of those people released from liability below and assume full responsibility for my participation.

6. In the event I observe an unusual or unnecessary hazard during my participation, I will bring the condition to the attention of the range officer(s) or another official immediately.

7. I understand and agree this Release of Liability is effective each and every shooting or viewing activity for which I participate hereafter until such time as I notify the released parties in writing of my intention to withdraw such waiver. I, for myself and on behalf of my heirs, hereby release and hold harmless The Gun Store, the owners and lessors of premises, their officers, officials, agents and/ or employees ("Releasees", with respect to any and all injury; disability, death or loss or damage to person or property, whether caused by the negligence of the Releasees.

8. In the event an action is brought against The Gun Store, whether brought in law or equity, the parties agree the proper venue and jurisdiction is the Court of Common Pleas in Horry County, South Carolina. The parties waive the right to bring the action in any other court. If litigation or a dispute arises as a result of any action contemplated specifically or involving the use of The Gun Store premises, the user of the facility agree to mediate the issue by a certified mediator in South Carolina prior to filing any lawsuit or action of any type against The Gun Store or any of its owners or employees.

9. I am fully aware of risks, hazards connected with being on the premises and participating in the gun range, and I am fully aware that there may be risks, hazards unknown to me connected with being on the premises and participating in the gun range, and I hereby elect to voluntarily participate in the gun range, to enter upon the above named premises and engage in activities knowing that conditions may e hazardous or may become hazardous or dangers to me and my property. I voluntarily assume full responsibility for any risks of loss, property damage or persona injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of my being a participant in the gun range, whether caused by the negligence of releasee's or otherwise.

I further hereby agree to indemnify and save and hold harmless the releasee's and each of them, from any loss, liability, damage or costs they may incur due to my participation in the gun range, whether caused by the negligence of any or all of the releases, otherwise.

10. By signing this instrument, the Undersigned affirms that he/she has read, understands, and will comply with the requirements as set for the herein, and does hereby agree to defend, indemnify, and hold The Gun Store, its shareholders, officers, managers, assigned, heirs or employees harmless from any act or omission for which the undersigned and/ or he/her minor guests is/ are directly or indirectly responsible. This instrument binds the Undersigned and his/her executors, administrators assignees or heirs. I have read this Release of Liability and Assumption of Risk Agreement, fully understanding its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement. No oral representation, statements of inducements, apart from the foregoing written agreement have been made.
