Charter Service Agreement, Terms & Conditions, and General Release of Liability Waiver

This agreement is made by and between Lake Area Transport Services LLC dba Ohio Party Bus (hereinafter referred to as “Ohio Party Bus”) whose principal place of business is located at 186 Lakeshore Dr W, Hebron, OH 43025 and the Client. It is expressly agreed by the above parties that this agreement is a contract of carriage of persons over public roads and highways. 

Wherefore, in consideration of the charter payment and fees, receipt of which is hereby acknowledged by Ohio Party Bus, it is expressly agreed as follows: 

SERVICE(S) PROVIDED: Ohio Party Bus shall transport up to a certain # of passengers as specified in the reservation and manifest as designated by the client. Said service shall have charter periods commencing on dates and times outlined in the reservation and manifest and no others. Service shall terminate on dates and times indicated in the reservation and manifest and no others. Ohio Party Bus shall provide no other service of any kind or manner than that described in reservation and manifest.

DRIVER REQUIREMENTS: Ohio Party Bus shall cause all vehicles to be operated only by a safe, careful driver, at least 26 years of age, who shall be properly licensed and insured, in accordance with all state and federal laws and regulations.

EQUIPMENT DAMAGE / EXCESS CLEANING: Client hereby agrees to pay a refundable security deposit as indicated in the booking reservation request and further compensate and satisfy Ohio Party Bus for any and all damages, any and all excess cleaning, and any and all bio-hazardous cleaning caused to any transport vehicle(s) by any person transported by Ohio Party Bus for the client, excluding the normal wear and tear associated with the cartage of said persons.

CONTROL OF TRANSPORTATION: Ohio Party Bus shall be the sole party responsible and authorized to make any and all decisions regarding any issues related to the transportation of persons pursuant to this agreement, including but not limited to, seating arrangements, equipment substitutions, routes, detours, rest stops, or any other matter related to such transport of persons.

LIABILITY FOR INJURY TO PERSONS OR PROPERTY: The client and their respective parties hereby acknowledge by signing this agreement that the client and their guests have executed a General Release of Liability Waiver, which will hold Ohio Party Bus harmless from any and all liability for personal injury or property loss that may occur due to negligent or voluntary acts by individual passengers. Each party understands that they are bound by its terms. This section applies only to voluntary acts by passengers. It does not diminish, reduce, or eliminate any other insurance liability obligations that may occur during the parties’ relationship.

ITINERARY: The parties hereby acknowledge that the charter itinerary provided with this agreement may contain more specific and detailed information and by reference, is considered an integral and binding part of the agreement.

AUTHORIZED REPRESENTATIVES: The Client acknowledges and agrees that any friend, family member, guest, event coordinator, or other person associated with the Client’s group who communicates with Ohio Party Bus staff or the driver regarding transportation details shall be deemed an authorized representative of the Client. Any such person shall have the authority to make binding decisions, including but not limited to, extending service time, modifying destinations, or approving additional services or stops.

AUTOMATIC CONTINUATION OF SERVICE: If transportation service continues beyond the originally contracted time due to direct request or continued use by the Client’s guests, representatives, or any party members, the service shall automatically continue at the published hourly rate, rounded up to the next full hour. The Client agrees that such continued use constitutes acceptance of additional billing under the same contract terms and conditions.

PAYMENT AUTHORIZATION: The Client authorizes Ohio Party Bus to charge the payment method on file for any additional time, mileage, or services used beyond the original booking period, as documented by GPS tracking, driver logs, or communication records. Unless a written objection is received within 24 hours of service completion, all extended service charges shall be considered accurate and authorized.

INDEMNIFICATION: The Client agrees to indemnify, defend, and hold harmless Ohio Party Bus, its owners, employees, affiliates, and agents from any claims, losses, or damages arising from actions, directions, or behavior of the Client’s guests, representatives, or event participants, including any instructions given to the driver or staff during the course of service.

WAIVER ACKNOWLEDGMENT: Failure of any passenger, guest, or participant to sign this waiver does not negate its enforceability. By entering or using any Ohio Party Bus vehicle or service, each passenger acknowledges acceptance of and agreement to all terms and conditions stated herein, whether signed electronically or not.
