LIKENESS RELEASE AND CONSENT AGREEMENT

Heighten Your Performance, LLC, a Michigan limited liability company doing business as LoMI Studios (“LoMI Studios”) desires to use the likeness, name, and social media usernames of the individual named below (“I”or“me”).

For good and valuable consideration, the receipt and sufficiency of which I hereby acknowledge, I irrevocably grant LoMI Studios my permission and the right to photograph me, and to use all photographic or other images taken of me (collectively, “Images”) according to the terms of this Likeness Release and Consent Agreement (“Agreement”).

I hereby irrevocably permit, authorize, and license LoMI Studios and its affiliates, successors, licensees, agents, and assigns (collectively, “Authorized Persons”) to use and the Images, either separately or together and either in whole or in part, and my own name and social media usernames, and all materials created by or on behalf of the Authorized Persons who incorporate any of the foregoing (“Materials”) for the purpose of marketing LoMI Studios in any format or platform now existing or hereafter created without further consent from or any compensation to me. LoMI Studios is and shall be the exclusive owner of all rights in the Images and Materials. 

THIS AGREEMENT PROVIDES LOMI STUDIOS WITH YOUR ABSOLUTE AND UNCONDITIONAL CONSENT, WAIVER, AND RELEASE OF LIABILITY, ALLOWING LOMI STUDIOS TO USE YOUR LIKENESS, NAME, AND SOCIAL MEDIA USERNAMES AS SET OUT ABOVE. BY SIGNING, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD ALL THE TERMS OF THIS AGREEMENT AND THAT YOU ARE GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE LOMI STUDIOS.

By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
