Breaking Free Together agrees to provide “The Client” with divorce coaching services. 1. Privacy and Confidentiality Policy At Breaking Free Together, we are committed to respecting your privacy and maintaining confidentiality. All information you share with us will remain private and secure. Similarly, any guidance, advice, or communication provided to you by Breaking Free Together will also be treated with strict confidentiality. However, there are exceptions to this confidentiality policy: - Legal Requirements: If we are required by law to disclose information, such as responding to a valid subpoena or court order.
- Safety Concerns: If there is a serious and credible concern for your safety or the safety of others, such as in cases of self-harm, harm to others, or situations involving abuse or neglect.
Client data is securely stored and accessed only by authorized personnel. These exceptions are in place to comply with legal and ethical obligations while ensuring the safety and well-being of all parties involved. By engaging with Breaking Free Together, you acknowledge and consent to these terms. 2. Description of Services Starting on May 9, 2025, Breaking Free Together will provide coaching services to you, the Client. These services are designed to support you in navigating your divorce and co-parenting journey. Coaching services may include: - Strategy sessions to help plan and prioritize goals.
- Review of communication and documentation you provide.
- Guidance on co-parenting challenges and related issues.
- Emotional support throughout the process.
Paid tasks may also include: - Reviewing and providing feedback on communication and documentation you share.
- Email exchanges or coaching calls with you.
- Ongoing support with documentation and communication, as requested.
Please note that coaching services do not include legal advice, therapy, or representation. These services are tailored to provide guidance and support for your unique needs. 3. Client Responsibilities and Acknowledgments - Coaching Role: The Coach is not a licensed therapist, lawyer, or medical professional. Coaching services are intended to provide guidance and support but are not a substitute for therapy, legal counsel, medical treatment, or advice.
- Client Accountability: You are fully responsible for your actions, decisions, and outcomes based on the coaching process. Breaking Free Together and the Coach are not liable for any actions, inactions, or results—direct or indirect—arising from coaching services.
- Personal Responsibility: You are responsible for managing your own physical, mental, and emotional well-being and for making and implementing decisions in your life.
- Coaching Limitations: Coaching is not therapy and cannot diagnose, prevent, or treat any medical or mental health conditions.
- Professional Advice: Coaching is not a replacement for professional advice in legal, medical, or mental health matters. You agree to seek appropriate guidance from qualified professionals as needed.
4. Schedules and Fees - Payment Policy: Full payment is required before coaching services are provided.
- Payment is due at the time of booking via the Calendly and Paypal.
- Alternatively, an invoice will be emailed to you within 24 hours of the scheduled appointment.
- Payment must be received by the date of service and no later than the end of the appointment.
- Monthly plans are billed on the 1st of the month and must be paid within 5 days of receipt. If not paid, the monthly plan will be cancelled.
- Late Payments: A late fee of 5% of the outstanding balance may be applied for invoices unpaid beyond the 7-day grace period. No further services will be provided until your account is paid in full.
5. Cancellation and Rescheduling Policy - No Shows: No refunds will be issued for missed appointments.
- Cancellations: Cancellations must be made at least 24 hours before the scheduled appointment. Late cancellations may incur a $25 cancellation fee.
- Rescheduling: You can reschedule appointments using Scheduling tool at anytime before the 24-hour cancellation window closes.
- Consultation Policy:
- If you miss your initial consultation, you may re-schedule once.
- If you miss your second scheduled consultation, no further consultations will be granted.
- If a third consultation is scheduled after two missed appointments, Breaking Free Together reserves the right to cancel the appointment and notify you via the scheduling tool.
- Emergency Situations: In the event of a valid emergency, a one-time exception to the 24-hour cancellation policy may be granted at the discretion of the Coach. Proper documentation of the emergency is required for consideration.
6. Recording Policy Neither party may video record, audio record, screenshot, or distribute any part of the coaching engagement, including text-based communications, without the explicit, written consent of both parties. Such consent must be documented in a signed agreement prior to any recording or distribution. This policy is designed to protect the confidentiality and integrity of the coaching relationship. 7. Disclaimer and Indemnity - Disclaimer: Breaking Free Together is not a licensed therapist and does not provide counseling, therapy, psychoanalysis, or medical diagnoses. Coaching services are offered as guidance and support to help you make informed decisions. No guarantees or warranties, express or implied, are made regarding the outcomes or results of coaching.
- Indemnity: You agree to take full responsibility for your actions and decisions. You further agree to defend, indemnify, and hold Breaking Free Together harmless from any claims, losses, expenses, costs, or damages, including reasonable attorneys' fees, expert fees, and other costs of litigation.
- Third-Party Claims: This indemnity extends to third-party claims, such as actions taken by co-parents or other individuals as a result of advice or strategies discussed during coaching sessions.
8. Limitation of Liability To the maximum extent permitted by law, Breaking Free Together and its providers are not liable for any direct, compensatory, indirect, incidental, consequential (including lost profits or business opportunities), special, exemplary, or punitive damages arising from or related to coaching services. 9. Termination Policy Breaking Free Together is committed to providing a positive and supportive coaching experience. However, we reserve the right to terminate this agreement if: - The Client becomes abusive or difficult to work with.
- The Client violates the terms of this agreement.
- Breaking Free Together determines it cannot ethically or professionally continue the coaching relationship.
In such cases, written notice will be provided to you. 10. PayPal End-User Privacy Policy Breaking Free Together uses PayPal as its payment platform. By using our services, you agree to PayPal’s end-user privacy policy. (PayPal Privacy Statement ). 11. Moneris End-User Privacy Policy Breaking Free Together uses Moneris as its payment platform. By using our services, you agree to Moneris’s end-user privacy policy. (Privacy Statement | Moneris). 12. Calendly Privacy Policy Breaking Free Together uses Calendly as its scheduling platform. By using our services, you agree to Calendly’s end-user privacy policy. (Privacy Notice | Calendly). 13. Zoom Privacy Policy Breaking Free Together uses Zoom as its meeting platform. By using our services, you agree to Zoom’s end-user privacy policy. (Zoom Privacy Statement | Zoom). 14. Entire Agreement This agreement represents the entire understanding between Breaking Free Together and the Client. It replaces all previous oral or written agreements. Any amendments to this agreement must be made in writing and agreed upon by both parties. By signing below, you confirm that you have read, understood, and agreed to the terms outlined in this document.
