RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFICATION AGREEMENT

I have voluntarily elected to use and, if applicable, to allow the minor child(ren) identified below and all minor children under my supervision, to use Inflatable World Treasure Valley facilities and equipment located at 1133 W Chinden Blvd, Meridian ID 83646. In consideration of being allowed to enter the play area, use the inflatable equipment or to participate in any party and /or program / or other services provided by MWMW Events LLC or its employees or agents at said location, or any other location within the State of Idaho, I represent, acknowledge and agree as follows:

GENERAL RELEASE

I acknowledge and agree that this Agreement covers and is intended to release and provide other benefits, legal protections, and consideration to MWMW Events LLC, and their respective and collective agents, owners officers, managers, shareholders, affiliates, volunteers, employees, and all other persons or entities acting in any capacity on their respective or collective behalf (collectively, “IW”). By acknowledging/agreeing to signing your name you are consenting to the use of your electronic signature in lieu of an original signature on paper.

RELEASE OF POTENTIAL INJURIES

I acknowledge and agree that use of inflatables, play structure and other equipment at Inflatable World facility and that participating in inflatable jumping, climbing, and obstacle courses as well as other activities is inherently dangerous. I acknowledge and agree that any injuries due to the refusal of wearing socks or water shoes is at my own risk and a direct result of not following the instructions provided by the park.The above mentioned risks include serious physical or emotional injury, paralysis, death, damage to myself, the Child, and /or third parties, and damage to personal property of any or all such parsons. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity, which I further agree is for recreational purposes and completely voluntary. I acknowledge and agree that, while the activities that take place at Inflatable World Treasure Valley are monitored generally by Inflatable World Treasure Valley employees, it is not feasible for such employees to monitor the activities and actions of all customers at all times or all customers simultaneously. Furthermore, Inflatable World Treasure Valley employees have difficult jobs to perform. They seek safety, but the are not infallible. They might be unaware of a participant’s health or abilities. They may give incomplete warnings or instructions, and the equipment being used might malfunction.

a. I acknowledge and understand that there are risks associated with participation in Inflatable World Treasure Valley activities, the use of the play area, and any inflatable equipment. The risks include but not limited to: contusions, fractures, cuts, scrapes, burns, paralysis, or death.

b. I, for myself, and the participant(s) named, willingly assume the risks associated with participation and accept that there are risk that may arise due to other participants.

c. I agree that the Participant(s) named, and I shall comply with all stated and customary terms, safety signs, and verbal instructions as conditions for participation.

d. I, for myself, and the Participant(s) named, our heirs, and representatives agree to hold harmless and indemnify the owner of Inflatable World Corp. its officers, directors, associates, managers, and employees from any and all injuries, liabilities or damages from participation.

e. I am of physical ability to participate and am legally competent to understand and complete this agreement. I hereby execute this agreement without coercion.

INDEMNIFICATION AGREEMENT

I, on behalf of myself and the Releasing Parties, hereby agree to hold harmless, defend and indemnify Inflatable World (and the other Released Parties) from any and all claims made by me (or any Releasing Party) arising from injury or loss due to my/our participation in the Activities. This applies both to claims arising from the inherent risks of the Activities or the ordinary negligence of Inflatable World Treasure Valley (or any Released Parties).

MEDIATION AND ARBITRATION

In the Event of a legal issue, I agree to engage in good faith efforts to mediate any dispute that might arise. If I fail to request to mediate or fail to mediate prior to litigating in court, any attorney fees rights I have are waived. Should the issue not be resolved by mediation, I agree that all disputes, controversies or claims arising out of my participation in the Event shall be submitted to binding arbitration. The cost of such action shall be shared equally by the parties.

I AGREE TO ALL THE ABOVE MENTIONED: GENERAL RELEASE, RELEASE OF POTENTIAL INJURIES, INDEMNIFICATION AGREEMENT, MEDIATION AND ARBITRATION.
