WAIVER AND RELEASE OF LIABILITY

I, hereby acknowledge and agree to the following terms and conditions before renting and operating a dirtbike provided by Dirt Bike Connection:

1. Assumption of Risk: I understand that operating a dirtbike involves inherent risks and dangers, including but not limited to accidents, collisions, falls, and injuries, some of which may result in serious injury or death.

2. Safety Equipment: I agree to wear all required safety equipment, including a helmet, gloves, goggles, and appropriate protective clothing while operating the rented dirtbike.

3. Maintenance and Inspection: I will inspect the rented dirtbike before use and report any damage or issues to Dirt Bike Connection. I understand that the dirtbike is provided in good working condition, but I am responsible for its care and maintenance during the rental period.

4. Damage Responsibility: I acknowledge that I am solely responsible for any damages, losses, or theft of the rented dirtbike that occur during my rental period. This includes any repair or replacement costs incurred by Dirt Bike Connection due to damages caused by my use of the dirtbike.

5. Release of Liability: In consideration of being allowed to rent and operate a dirtbike from Dirt Bike Connection, I hereby release and discharge Dirt Bike Connection, its owners, employees, and agents from any and all claims, demands, actions, or causes of action, whether for personal injury, property damage, or otherwise, arising out of my rental and use of the dirtbike.

6. Indemnification: I agree to indemnify and hold Dirt Bike Connection harmless from any claims or lawsuits brought against them by third parties as a result of my use of the rented dirtbike.

7. Insurance: I understand that Dirt Bike Connection does not provide insurance coverage for any injuries or damages that may occur during the rental period. I am encouraged to obtain my own insurance coverage if desired.

8. Age and Experience: I certify that either (i) I am of legal age to rent and operate a dirtbike, or (ii) I am the parent or legal guardian of a minor participant and have the authority to execute this Agreement on the minor's behalf. I acknowledge that dirtbike riding is an inherently dangerous activity and that participants may have varying levels of experience, including no prior experience. I agree that the participant will operate the dirtbike only within their abilities, follow all instructions and safety rules provided, and assume all risks associated with participation, including any training or coaching provided.

9. Legal Jurisdiction: This release of liability waiver shall be governed by and construed in accordance with the laws of the state of Texas, and any legal action arising out of or related to this agreement shall be filed in the courts of the stateof Texas.

I have carefully read and understood this Waiver and Release of Liability, and I voluntarily agree to its terms and conditions.

IMPORTANT: All riders must also sign 3 Palms Action Park’s waiver before entering the track.
