AirSoft Experience - Participant Waiver

Read Carefully - This Affects Your Legal Rights

YOU MUST BE 18+ YEARS OLD TO SIGN A WAIVER FOR YOURSELF OR ON BEHALF OF A MINOR

In exchange for participation in the activity of airsoft shooting range organized by AIRSOFT GAME LLC, of 1 Edgell Road, Suite 5, Framingham, Massachusetts, 01701 and/or use of the property, facilities, and services of AIRSOFT GAME LLC, I agree for myself and (if applicable) for the members of my family, to the following:

1. Agreement To Follow Directions. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by AIRSOFT GAME LLC, or the employees, representatives, or agents of AIRSOFT GAME LLC.

2. Assumption of the Risks and Release. I recognize that there are certain inherent risks associated with the above-described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge AIRSOFT GAME LLC for injury, loss, or damage arising out of my or my family's use of or presence upon the facilities of AIRSOFT GAME LLC, whether caused by the fault of myself, my family, AIRSOFT GAME LLC or other third parties.

Players are expected to abide by all safety and game rules as posted and expressed by staff. Players listed herein will assume full responsibility for their actions or neglect to abide by set rules. These rules include but are not limited to:

a. Always wear safety glasses

b. Always point the muzzle in a safe direction

c. Always follow all instructions and cautions

d. Do not touch replicas without authorization

e. Always treat replicas as if they were loaded

f. Keep the replicas safe until ready to shoot

g. Always keep your finger off the trigger

h. No outside replicas are allowed

Airsoft Game LLC is not liable for any injury incurred by a player's failure to follow these rules nor allow a player within the field if they are not following the set rules

3. Photo & Video Release Consent. I agree, in accordance with applicable Massachusetts law, to the photographing, filming, or recording of my likeness and activities for use in promotional materials, advertising, and social media by AIRSOFT GAME LLC. These materials will be used solely for business purposes and within lawful limits. If I do not wish to appear in any images or videos, I will inform a staff member before participation.

4. Indemnification. I agree to indemnify and defend AIRSOFT GAME LLC against all claims, causes of action, damages, judgments, costs, or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of AIRSOFT GAME LLC.

5. Fees. I agree to pay for all damages to the facilities of AIRSOFT GAME LLC caused by any negligent, reckless, or willful actions by me or my family.

6. Medical Authorization. In the event of an injury to the above minor during the above-described activities, I give my permission to AIRSOFT GAME LLC or to the employees, representatives, or agents of AIRSOFT GAME LLC to arrange for all necessary medical treatment for which I shall be financially responsible. This temporary authority will begin on the date of signing the waiver and will remain in effect until terminated in writing by the undersigned or when the above-described activities are completed. AIRSOFT GAME LLC shall have the following powers:

a. The power to seek appropriate medical treatment or attention on behalf of my child as may be required by the circumstances, including without limitation, that of a licensed medical physician and/or a hospital;

b. The power to authorize medical treatment or medical procedures in an emergency situation; and

c. The power to make appropriate decisions regarding clothing, bodily nourishment and shelter.

7. Applicable Law. Any legal or equitable claim that may arise from participation in the above shall be resolved under Massachusetts law.

8. No Duress. I agree and acknowledge that I am under no pressure or duress to sign this agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this agreement if I so desire. I further agree and acknowledge that AIRSOFT GAME LLC has offered to refund any fees I have paid to use its facilities if I choose not to sign this agreement.

9. Enforceability. The invalidity or unenforceability of any provision of this agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this agreement or of any other applications of such provision, as the case may be. Such invalid or unenforceable provision shall be deemed not to be a part of this agreement.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS WAIVER, I AM GIVING CONSENT TO THE ABOVE IN ITS ENTIRETY AS WELL AS ANY FUTURE ALTERATIONS OR UPDATES TO THIS PLAYER WAIVER. I AM ALSO TAKING FULL LEGAL AND FINANCIAL RESPONSIBILITY FOR ALL PLAYERS LISTED WITHIN THIS WAIVER AND WILL BE HELD LEGALLY AND FINANCIALLY LIABLE FOR ANY AND ALL DAMAGES, INJURIES, INCIDENTS AND/OR FINES INCURRED BY ANY OF THE PLAYERS LISTED HEREIN.

Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.

Please note: the signer of this waiver is responsible and will be held liable for any and all damages, injuries, or costs incurred by the players herein during their stay within our facility.

If you are not the player's parent or court-recognized legal guardian, it is not recommended that you sign this waiver for the player(s) herein. This waiver stays on file for 12 months and remains in place regardless of your presence or knowledge of the player's attendance.
