Unk’s Lake Campground and Swimming Hole

WAIVER/RELEASE OF LIABILITY

Please read carefully before signing!

This is a release of liability and waiver of certain legal rights.

I, together with the child(ren) named below, for whom I and the parent/guardian, (Collectively the “Participants”) desire to use Unk’s Lake Campground and Swimming Hole facilities. This may include, but not limited to, use of the swimming area and anything related to it, campground, parking lot, office/store, pizza facility, and receiving instruction from Unk’s Lake Campground and Swimming Hole staff. On behalf of the Participants, I acknowledge and understand that swimming is a hazardous activity and that using Unk’s Lake Campground and Swimming Hole facilities inherently involves certain risks for the Participants. I recognize that these risks include, but are not limited to slipping on wet surfaces, tripping over obstacles, equipment malfunction, and injury resulting from the use of any Unk’s Lake Campground and Swimming Hole equipment, and drowning. I understand that these risks could lead to damage to property, personal injury, (Including, but not limited to orthopedic injuries, brain injuries, paralyzing injuries, drowning), and/or death. I acknowledge that Unk’s Lake Campground and Swimming Hole has made reasonable efforts to provide a safe swimming environment. I further acknowledge that it is extremely difficult for Unk’s Lake Campground and Swimming Hole (including lifeguards, or supervision, if on duty) to always supervise all participants. A consideration for the Participants use of Unk’s Lake Campground and Swimming Hole facilities, I hereby agree on behalf of all Participants as follows:

I will be solely responsible to supervise the Participants at all times while on the premises, whether or not the Participants are in the water under the supervision of a lifeguard. I also assume all risk and responsibility for the Participants while on the premises of Unk’s Lake Campground and Swimming Hole. I waive and release any and all claims the Participants have or may have, now or in the future against Unk’s Lake Campground and Swimming Hole, and any and all employees of Unk’s Lake Campground and Swimming Hole (collectively, the “Releasees”. I also release the Releasees of any and all liability, damage, loss, claims, actions, expense, cost, fees, and any injury that the Participants may sustain while on Unk’s Lake Campground and Swimming Hole premises. I intend this release to be construed broadly and include any liability, damages,loss, claims, actions, expense, costs, fees, and any injury allegedly caused by the Releasees’ negligence. Additionally, I agree to indemnify and hold harmless the Releasees from any and all liability resulting from the Participants use of Unk’s Lake Campground and Swimming Hole facilities.

In the event any person other than the name(s) listed below accompany, escort, and/or supervise (“Additional Participants”) to the child(ren) to the Unk’s Lake Campground and Swimming Hole facilities, I agree to obtain the signature of the Additional Participants to this waiver/release of liability. I agree to indemnify and hold harmless Releasees from any liability, damages, loss, claims, actions, expenses, costs, fee and any injury sustained by the additional Participants or as a result of the Additional Participants use of the Unk’s Lake Campground and Swimming Hole facilities.

In case of medical emergency, I authorize any authorized representative of Unk’s Lake Campground and Swimming Hole to have the Participants treated in any emergency (as determined at Releasees sole discretion) while on the Unk’s Lake Campground and Swimming Hole premises. Further, I agree to pay any and all costs, fees, expenses and bills associated with said medical care and/or related transportation.

This agreement will be effective and binding upon my heirs, next of kin, executors, administrators and assigns in the event of my death. If any portion of this waiver/release of liability shall be, for any reason, invalid or unenforceable, the remaining portion or portions shall nevertheless be valid, enforceable, and carried into effect. The parties agree to attempt to substitute for any invalid or unenforceable provision which achieves to the greatest extent possible the same effect as would have been achieved by the invalid or unenforceable provision.

I HAVE CAREFULLY READ THE ABOVE WAIVER/RELEASE OF LIABILITY . I HAVE HAD AN OPPROTUNITY TO ASK ANY QUESTIONS I HAVE ABOUT THIS WAIVER/RELEASE OF LIABILITY, AND VOLUNTARILY SIGN IT WITH FULL KNOWLEDGE OF ITS CONTENTS AND SIGNIFICANCE.

Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.
