4PA Volunteer Liability Waiver and Agreement

By signing below, I, the volunteer (or volunteer’s legal guardian), acknowledge that entry into this agreement (“Agreement”) is in consideration of my participation as a volunteer of 4PA, and confirm my understanding and agreement to the following:

● I will comply with 4PA's volunteer policies, safety rules, conduct expectations, and other directions. I understand that 4PA does not tolerate bullying, harassment, threatening behavior, or violence of any kind. I understand that if I am not behaving like a decent human being, I may not be able to volunteer with 4PA.

● I understand that I am not an employee of 4PA and will not be paid for my participation nor will I receive any financial benefits (e.g,.health insurance, worker’s comp). I may, however, go home with a happy heart.

● Volunteering with 4PA has risks. These include, without limitation: heavy lifting, exertion, handling glass, drug paraphernalia (including needle sharps), rotten stuff, exposure to the elements, people with mental illness, steep terrain, and being in the presence of other humans. It’s conceivable that these risks include injury, illness, death, and property damage or loss, associated with 4PA facilities, clean-ups, or activities. I understand that even with health and safety protocols, I may still be exposed to COVID-19 or other infectious diseases. Life is risky, but so worth it.

● Sometimes, stuff happens. If I do get hurt, I authorize 4PA to provide first aid and arrange emergency medical services for me (including transport). I also understand that I am solely responsible for any costs related to my medical treatment and transport.

● I may have access to 4PA’s confidential information. At all times, during and after my participation, I agree to hold any such confidential information…(drum roll please!) in confidence. I will not disclose or use it except as 4PA expressly authorizes.

● I grant full rights to 4PA in any work products (reports, brochures, website content, photos, images, videos, or other materials or works) I may create in the course of volunteer activities, and any intellectual property rights in or derivatives of such materials. If you have a flash of genius while volunteering, lucky 4PA.

● I understand that 4PA may take photos or videos of me. I consent to allow 4PA to use my image, voice, name, and story, and images of any works (“Materials”) I create as a volunteer in digital and print media for fundraising, education, and other communications. 4PA may use these materials without obtaining my approval or paying me for such use. I grant 4PA all copyrights in and waive any legal claims relating to the Materials, including those relating to copyright, rights of publicity or privacy, defamation, or arising from any distortion, blurring, or alteration that may occur in the making, editing, or use of the Materials. Madonna was right- we are living in a material world (big sigh).

Awareness and Assumption of Risk

I understand the information above and acknowledge that these are risks associated with volunteering. I waive and release 4PA and its Parties (4PA directors, board members, officers, agents, employees, volunteers, and affiliates) from any and all liability, claims, costs, and expenses of any kind caused by or arising directly or indirectly from my presence at 4PA facilities and activities. I will not sue any of the 4PA Parties on the basis of these waived and released claims.
