FIRST FRC TEAM 151 TOUGH TECHS ACKNOWLEDGMENT AND ASSUMPTION OF RISK & RELEASE AND INDEMNITY AGREEMENT
AND CODE OF CONDUCT

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE SIGNING. 

All participants must sign this document. For participants under 18 yrs. of age, one or both parent(s)  or legal guardian(s) must also sign. Throughout this document,  participants under 18 years. of age will be referred to sometimes as "minor" or "child" and parent(s) and legal guardians collectively as "parent(s)".

As used below, "FRC TEAM 151'' shall mean Nashua's FRC TEAM  151 - Tough Techs, and its officers, directors, employees, assigns, and agents, including any third party designated and approved by FRC TEAM 151 at any time (including, without limitation, volunteer coaches, student mentors and parent volunteers). As used below,  "Participant" shall mean any coach,  student,  mentor, teacher, or volunteer involved in an FRC TEAM 151-sponsored activity, which activities may include, but are not limited to, FRC TEAM 151 group meetings (without regard to location or the number of participants who attend), field trips, demonstrations, community outreach, and competitive events.


In consideration of the acceptance of my or my minor child's participation in any FRC TEAM 151 activity, I acknowledge and agree as follows:

ACKNOWLEDGEMENT AND ASSUMPTION  OF RISK

I understand and acknowledge that the activity in which I or my minor child am/is being permitted to participate, and in which I or my minor child voluntarily engage(s), bears certain risks that could result in injury, death, illness, or property damage to Participant, fellow participants, onlookers, or others. Among these risks are the following:

  1. The nature of the activities themselves: These activities may include, but are not limited to, working with small plastic blocks or other small materials that could present a choking hazard, working with electrical components, working with various kinds of tools (including, but not limited to, hand tools, power tools, and soldering equipment), working with woodworking equipment (including but not limited to, chop saws, drill presses, jigsaws), working with metalworking equipment (including but not limited to milling equipment, drill presses, and lathes), working around stored energy (including, but not limited to, batteries, compressed air, and springs), working with flying projectiles, driving robots which may exceed the weight or size of the participant, working with carpentry and construction materials, and being in the vicinity of any and all of these activities:
  2. the condition of equipment used in these activities:
  3. the potentially careless or reckless acts of others, including, but not limited to, co-participants, fellow competitors, onlookers, MakeItLabs members, MakeItLabs guests, and MakeItLabs visitors;
  4. Travel to other locations for purposes which may include, but are not limited to, research, construction, testing of equipment, demonstration and competition;
  5. first aid, emergency treatment, or other services rendered; and
  6. consumption of food or drink.

I understand and acknowledge that the above list is not complete or exhaustive, and that other risks, known or unknown, identified or unidentified, may also result in injury, death, illness or property damage.


I understand that FRC TEAM 151, its coaches, mentors, and volunteers cannot assure Participant's safety or eliminate these risks. The leaders of these activities are volunteers. They are not paid professional coaches or teachers. In all activities, participants share in the responsibility for their own safety. The participant is voluntarily participating with knowledge of these risks.


Therefore, I, as Participant or as a parent of child Participant, assume and accept full responsibility for the inherent and other risks of these activities (both known and unknown), and for any injury, damage, death, or other loss suffered by Participant resulting from those. 


I acknowledge further that when I invite friends or family members to observe any FRC TEAM 151 sponsored activity, regardless of location, I am exposing them to the same risks of injury, damage, death, or other loss that my co-participants and other onlookers are exposed to, and I assume and accept full responsibility for their exposure to such risks. 


RELEASE AND INDEMNITY AGREEMENT

To the fullest extent permitted by applicable laws, I hereby voluntarily release and forever discharge FRC TEAM 151 from any and all liability, claims, demands, actions, or rights of action that may arise from my or my minor child's participation in FRC TEAM 151 sponsored activities, including, but not limited to such claims as may arise from the negligent act or acts or omissions of FRC TEAM 151, including claims for negligent supervision,


I hereby waive any claim or cause of action which I may now or hereafter have against FRC TEAM 151 arising from my or my minor child's participation in any FRC TEAM 151 sponsored activity or use of TEAM 151 equipment or facilities, including any claim for attorney's fees and/or costs, and I agree that neither I nor anyone acting on my behalf shall sue, assert or otherwise maintain a claim against FRC TEAM 151 for any injury, illness, death, damage to property or other loss suffered by me or my child as the result of participation in any FRC TEAM 151 sponsored activity or use of FRC TEAM 151  equipment or facilities.


I further agree to indemnify ("indemnify" meaning protect by reimbursement or payment) and hold harmless FRC TEAM 151 against any and all claims brought by or on behalf of me, any member of my family, or any other person accompanying me or my minor child to any FRC TEAM 151-sponsored activity which are in any way connected with my or my child's participation in these activities or use of FRC TEAM 151 equipment or facilities. 


This Release and Indemnity Agreement includes any losses caused or alleged to be caused, in whole or in part, by the negligence of FRC TEAM 151 and includes claims for personal injury, property damage, wrongful death, breach of contract or otherwise. 

ADDITIONAL RELEASES

In the event I or my minor child should sustain injuries or illness while involved in any FRC TEAM 151 sponsored activity, I hereby authorize FRC TEAM 151 or its agent to administer, or cause to be administered, such first aid or other medical treatment as may be necessary under the circumstances, to include treatment by a physician or hospital of FRC TEAM 151 's choice, as necessary. I understand that each participant is responsible for his/her own insurance. FRC TEAM 151 does not provide medical insurance coverage for participants.


I hereby grant to FRC TEAM 151 the right to photograph, videotape, and/or record Participant during any FRC TEAM 151 sponsored activity. I further grant to FRC TEAM 151 the right to use such photographs, videotapes, and recordings in all media and in all forms and for all purposes, including without limitation, advertising and other promotions for FRC TEAM 151, without compensation to Participant or any limitation whatsoever.


I further grant FRC TEAM 151 the right to use or release the Participant's name to accompany photographs, videotapes, and/or recordings, or for any other press release or publicity purpose, whether or not the participant's photograph is part thereof, in all media, including any team website, without limitation. 

ACKNOWLEDGEMENT OF EFFECT OF THIS AGREEMENT

I understand and acknowledge that by signing this document I am giving up certain legal rights and/or possible claims that I might otherwise assert or maintain against FRC TEAM 151, including specifically, but not limited to, rights arising from FRC TEAM 151's acts, omissions, and/or negligence. I understand and agree that if I sign this agreement on behalf of my minor child, I will be giving up the same rights for said minor as I would be giving up if I signed this document on my own behalf. 


I expressly understand and agree that this agreement is intended to be as broad and inclusive as permitted by law and shall be governed by and construed under the laws of the State of New Hampshire without regard to conflicts of laws principles. Venue for any legal actions arising out of or in connection with this agreement shall be in Hillsborough County, New Hampshire, and Jurisdiction shall be vested exclusively in the District Court in and for Hillsborough County, New Hampshire, or, if appropriate, in the Federal District Court for the District of New Hampshire. I agree that in the event that any clause or provision of this Agreement shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Agreement. This agreement shall be effective and binding upon me, my personal representatives, assigns, heirs, and next of kin. 


I understand that this is the entire agreement between me and FRC TEAM 151, its agents or employees, and it cannot be modified or changed in any way by the representations or statements of any FRC TEAM 151 officer, director, agent, or participant, or by me. 

My signature below indicates that I have read this entire document, understand the words and language in it, and agree to be bound by its terms. I have knowledge of the potential dangers incidental to preparing for and participating in FRC TEAM 151 activities and any questions about potential risks and dangers have been answered to my satisfaction. 


Team 151 Tough Techs Code of Conduct Guide

Safety

  • Safety is our 1st priority. Along with safety training, members must always wear safety goggles in work areas. Ultimately, members are responsible for their safety and the safety of those around them. 

Attendance / Punctuality 

  • Team members are expected to arrive approximately 10 minutes early so the team can start on time.
  • We ask parents to be respectful of the volunteer mentors and pick up their students on time.

Cell phones

  • We ask that members not use mobile devices during robotics other than to communicate with parents, do team business, or research technical info.

Commitment

  • Members are expected to attend on days to which they have committed.
  • We understand that family, personal, and health issues arise. Please inform the team via Slack if you are unable to attend as planned.
  • School, homework, and studying always come first. 
  • Everyone has different levels of commitment to the team, which is okay as long as attendance is consistent and communicated.

Communication

  • Team members are expected to check Slack daily.

Cleanliness

  • We strive to leave work areas and event venues better than we found them. 

Gracious Professionalism

  • Respect - for team members, mentors, parents, sponsors, MakeItLabs, etc.
  • Honesty and Integrity
  • Teamwork / Team building - all team members work alongside all team members. Help the team grow by befriending, helping, and guiding new members

Spirit

  • Wear your team shirt, participate in the team’s social media, and use positive language about the team.

Attendance Requirement

  • 40% of meetings during the pre-season, September-December.
  • 40% of meetings during the build season, January-February.
  • Report every absence in the Slack # attendance channel prior to the meeting if possible.


Failure to meet the attendance requirements may result in the loss of membership on the team. Our primary objective is to ensure that all team members are adequately prepared for the challenges of the build season. While we strive to accommodate individual circumstances, it is essential to note that such accommodations must be initiated by the student or their family. Commitments on scheduled meeting days will not be negotiable due to the demanding nature of our team's activities.
