Weekend Within Retreat

Terms & Conditions

 

By submitting the online booking request as to the Weekend Within Retreat (“Retreat”), you are agreeing to be bound by the Terms and Conditions (“Terms”) set forth herein including, without limitation, the cancellation policy and limitation of liability. These Terms affects your rights and designate the governing law and forum for the resolution of any and all disputes.

 

Retreat Fee

Subject to any bWithin-authorized coupons, the fee to participate in the Retreat is One Thousand Five Hundred Dollars ($1500.00) (“Retreat Fee”). The Retreat Fee includes programming and workshops on January 25, 2025 and January 26, 2025; meals, snacks, coffee and tea during the Retreat hours; a workbook guide to support the programming and workshops; and welcome gift. The Retreat Fee does not cover the costs in connection with any accommodations/lodging; transportation to and from the Retreat space; meals and beverages outside of the Retreat hours; and alcohol.

 

Deposit

At the time that you submit your online booking request, you must also submit a deposit in the amount of Three Hundred Dollars ($300.00) (“Deposit”). The Deposit is non-refundable, subject to the foregoing sole exception. After receiving your booking request and Deposit, the Retreat Hosts will provide you with a Release of Liability, Waiver and Assumption of the Risk (“Waiver”) for your review and acceptance. Your booking request will be deemed complete upon the Retreat Hosts’ receipt of the signed Waiver. Failure to review and accept the Waiver within seven (7) days from the submission of your booking request will void your booking request. In this event, the Deposit will be returned to you. 

You may book the Retreat by providing the Deposit until January 1, 2025. Thereafter, payment of the Retreat Fee, in full, is required to be submitted together with the online booking request. 


Retreat Fee Balance

The remaining balance of the Retreat Fee in the amount of One Thousand Two Hundred Dollars ($1,200.00) (“Retreat Fee Balance”) is due on or before January 2, 2025. In the event that the Retreat Fee Balance is not paid as set forth herein, the Retreat Hosts will have the discretion to treat your booking request as cancelled by you and to re-sell the Retreat place. You acknowledge and agree that in this event, you forfeit any rights to receive a refund of the Deposit, in whole or in part.

 

Third Party Payment Processor

All payments in connection with the Retreat Fee must be made via credit card utilizing bWithin’s third party payment processor, SquareSpace. Please note that SquareSpace is an independent third party and in no way related to or affiliated with bWithin. In that regard, prior to submitting any payments or information via SquareSpace, you are responsible for reviewing the terms and conditions and privacy policies in connection with same. You shall not submit any payments via SquareSpace if you do not agree to any of its policies.

 

Cancellation by You

We understand that circumstances may rise which affect your ability to attend the Retreat after your booking request has been completed. If you need to cancel the booking request, you must provide written notice so that it is received by bWithin before January 2, 2025, via email to bianca@b-within.com  and  lynn@lynnmull.com.

If bWithin receives the cancellation notice prior to January 2, 2025 and the Retreat Fee has been paid in full, you may elect to either: (i) receive a refund of fifty percent (50%) of the Retreat Fee Balance actually received by the Retreat Hosts from you; or (ii) request that the amount of the Retreat Fee Balance paid by you is credited towards the fees in connection with your participation in a future retreat held by bWithin and/or Lynn Mull (“Alternate Retreat”). If you elect to receive a credit to an Alternate Retreat, you acknowledge and agree to use the credit for an Alternative Retreat taking place within one year from the Retreat start date, and you are responsible for any additional fees and/or costs in connection with same.

If bWithin fails to receive your cancellation notice prior to January 2, 2025, you acknowledge and agree that you are responsible for the Retreat Fee in full, and where the Retreat Fee already has been paid in full, you are not entitled to a refund of the Retreat Fee, in whole or in part. Notwithstanding the foregoing, you may submit a written request to bWithin and Lynn Mull via email, as set forth above, to transfer your booking to another individual. Such request shall be determined by the Retreat Hosts, in their discretion, and, without limitation, is also conditioned on the Retreat Hosts receiving your written request on or before January 17, 2025: (a) the individual’s full name, email address, telephone number and any other information so requested by bWithin; and (b) the individual’s signed Waiver.

 

Cancellation by the Retreat Hosts

Confirmation of your booking request does not necessarily mean that the Retreat is confirmed to run. In order for the Retreat to take place, we require a minimum of six (6) participants. We reserve the right to cancel the Retreat for any reason, but will not cancel the Retreat less than thirty (30) days before the Retreat start date except for Force Majeure. Where the Retreat is cancelled by the Retreat Hosts for any reason, not attributed to your fault, you may elect to: (a) receive a credit of any amounts provided by you in connection with the Retreat Fee to be utilized towards another retreat hosted by bWithin and/or Lynn Mull, which is taking place within one (1) calendar year from the Retreat’s start date; or (b) receive a full refund of the Retreat Fee actually received by the Retreat Hosts (less the above-mentioned non-refundable fees and costs). Under no circumstances are the Retreat Hosts responsible for any incidental or consequential losses that you may have incurred as a result of booking the Retreat, such as, without limitation, non-refundable transportation, accommodations and/or lodging costs, loss of earnings or loss of enjoyment. 

 

Force Majeure

The Retreat Hosts assume no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an act of God or any other force majeure condition, including, without limitation, fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to the Retreat facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by the Retreat Hosts that impact negatively on, or hamper, their abilities to fulfill any of their contractual conditions (“Force Majeure”). In the circumstances amounting to Force Majeure, we will not be required to refund any monies to you, although if we can recover any monies from our suppliers, we will refund these to you less our non-refundable fees. Subject to any refunds, we may elect to provide the retreat virtually, or offer a credit to attend the next retreat offered by bWithin and/or Lynn Mull.

 

Information Provided In Connection with the Retreat

You acknowledge and agree that any information you provide in connection with the Retreat and/or as requested by the Retreat Hosts including, without limitation, any medical conditions, underlying health problems and/or food allergies, will be accurate, true, complete and current.


COVID-19 Policy

Although COVID-19 may not be considered as imminent of a health risk as it was at the start of the pandemic, we believe it consistent with our values that we offer a safe space for retreat participants. In that regard, if you are exhibiting COVID-19 symptoms at any time prior to or during the Retreat, we may request that you undergo a COVD-19 test and provide proof of a negative test to participate and/or continue to participate in the Retreat. If you test positive for COVID-19 prior to the start of the Retreat, you must inform the Retreat Hosts of same, and you will not be permitted to attend the Retreat. In that regard, you may elect to receive a credit of the Retreat Fee actually received by bWithin to a future retreat offered by bWithin, or obtain a full refund, less any non-refundable fees. In addition and depending on the circumstances at the time of the Retreat such as a spike of COVID-19 cases, we reserve rights to require that all retreat participants provide proof of a negative COVID-19 test within seventy two (72) hours of the Retreat’s start date, as a condition of participating in the Retreat.

In addition, while we may take certain precautions to minimize the risk of becoming infected with COVID-19, you acknowledge and agree that exposure to COVID-19 or other illnesses is an inherent risk of traveling and participating in group activities, that cannot be controlled or eliminated by the Retreat Hosts. Therefore, if you choose to participate in the Retreat, you agree that you are assuming the risk that you may be exposed to COVID-19 or other illnesses and that such exposure can lead personal injury, illness, permanent disability, or death. You also acknowledge that such injuries may occur in a manner that is not foreseeable at the time you make your booking. 

 

No Alcohol or Drugs

You understand that consuming and/or being under the influence of alcohol or drugs during the Retreat and/or while participating in any of the Retreat programming and/or workshops may have adverse effects and is strictly prohibited, subject to the sole exception set forth below. You acknowledge and agree that if the Retreat Hosts have a reasonable basis to believe that you are under the influence of alcohol or drugs, the Retreat Hosts reserve the right to not allow you to participate in the Retreat and/or Retreat programming and/or workshops. In this case, you acknowledge and agree that you are not entitled to a refund or reimbursement of any fees including, without limitation, the Retreat Fees, in whole or in part. Notwithstanding the foregoing, you may bring and consume alcohol during the dinner portion of the retreat on January 25th.

 

Name and Likeness License

You understand that during the Retreat, you may be photographed, videotaped and/or your voice or words may be recorded. You hereby grant the Retreat Hosts all right, title and interest to use your name, image, likeness, photography, statements and/or voice, either alone or accompanied by any other material, for marketing and promotional purposes including, without limitation, on the Retreat Hosts' respective website, social media accounts, blogs, newsletters and/or press releases.


Right to Exclude/Terminate

The Retreat Hosts reserve rights to terminate these Terms and/or exclude you from participating in any or all of the Retreat programming if the Retreat Hosts determine, in their discretion, that you are engaging in behavior and/or conduct during the Retreat that is endangering or appears likely to endanger the health or well-being of yourself or any third party including, without limitation, other Retreat participants. Without limitation, this includes any conduct on your part that may be viewed as threatening, intimidating, harassing, abusive, offensive, racist or otherwise discriminatory. Where the Retreat Hosts exercise their rights as set forth herein, the Retreat Hosts are under no obligation to refund or reimburse you any of the Retreat Fee or any other costs and expenses you incurred in connection with your anticipated participation in the Retreats, and you waive any and all rights and claims in connection with same.

 

Services Modification

In the event that it is impracticable to offer any of the Retreat programming and/or workshops and/or other services in connection with the Retreat, the Retreat Hosts reserve rights to replace such programming, workshops and/or services with alternative programming, workshops and services as determined by the Retreat Hosts, in their discretion.


Governing Law; Jurisdiction

You acknowledge that these Terms shall be governed by the laws of the State of Connecticut, without regard to conflicts of law principles, and you hereby submit to the jurisdiction of the courts of the State of Connecticut, with venue in County of Fairfield, for the resolution of any dispute arising in connection with the Retreat, these Terms and/or the Waiver.


Entire Agreement; Severability

These Terms, along with the Waiver, constitute the entire agreement between the Parties and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to the Retreat. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

 

Privacy Policy

Prior to submitting any personal information through the website, please review our Privacy Policy at the top of this document for purposes of understanding our policies in connection with the collection and processing of certain personal information. Your acceptance of these Terms acknowledge that you have read and understood our Privacy Policy.

 

Limitation of Liability

You acknowledge and agree that the Retreat Hosts will not be held liable for any indirect, incidental, special, consequential or exemplary damages arising from any claim in connection with the Retreat. Without limitation, under no circumstances are the Retreat Hosts responsible for any incidental or consequential losses that you may have incurred as a result of the booking of the Retreat, such as, without limitation, non-refundable transportation, accommodations and/or lodging costs, loss of earnings or loss of enjoyment. In addition, any other damages that are recoverable in connection with such claim shall be limited to the Retreat Fee.
