Participant Waiver, Assumption of Risk & Release of Liability

Please read carefully. This document affects your legal rights.

Welcome to Afterglow Roller Skate Co.

Our goal is to create safe, inclusive, and joyful skating experiences where everyone feels welcome. Before participating, please read this agreement carefully.

By signing below, you acknowledge that you understand and agree to the following

1. Assumption of Risk

I understand that roller skating and participation in Afterglow Roller Skate Co. activities involve inherent risks.

These risks include, but are not limited to:

• Slips, trips, and falls

• Collisions with other participants or objects

• Equipment failure or misuse

• Uneven pavement or skating surfaces

• Weather-related conditions at outdoor events

• Sprains, fractures, head injuries, or other serious injuries

• Permanent disability or death

I understand that these risks exist even when reasonable precautions have been taken. I voluntarily choose to participate and accept all known and unknown risks associated with my participation.

2. Physical Fitness

I confirm that I am physically able to participate in roller skating activities. I understand that I am responsible for participating within my own abilities and will stop skating if I feel unsafe or unwell.

3. Alcohol and Drug Policy

I agree that I will not participate while impaired by alcohol, cannabis, illegal drugs, or any medication that may affect my judgment, balance, coordination, or ability to skate safely. I accept full responsibility for any consequences resulting from skating while impaired.

4. Protective Equipment

I understand that Afterglow Roller Skate Co. strongly recommends the use of helmets and protective equipment, including wrist guards, knee pads, and elbow pads. Where protective equipment is optional, I understand that choosing not to wear it is my own decision and I accept the additional risks involved.

5. Rental Equipment

If I am renting skates or protective equipment from Afterglow Roller Skate Co., I agree that:

• I will inspect the equipment before use.

• I will immediately report any concerns or damage.

• I will use the equipment only as intended.

• I will return all equipment after use.

• I understand that improper use of rental equipment may increase my risk of injury.

6. Community Code of Kindness

I agree to:

• Treat others with kindness and respect.

• Follow all safety instructions.

• Skate responsibly and within my ability.

• Respect personal space.

• Help create a positive experience for everyone.

I understand that unsafe, aggressive, discriminatory, abusive, or inappropriate behaviour may result in my removal from an event without refund.

7. Release of Liability

To the fullest extent permitted by the laws of Ontario, I release and forever discharge Afterglow Roller Skate Co., its owners, directors, employees, volunteers, contractors, sponsors, event partners, municipalities, property owners, and insurers from any and all claims, demands, actions, damages, losses, costs, expenses, or liabilities arising out of or relating to my participation. This includes claims arising from negligence, except where prohibited by law.

8. Indemnification

I agree to indemnify and hold harmless Afterglow Roller Skate Co. and the Released Parties from any claims, damages, costs, or expenses arising from my actions or failure to follow safety instructions during participation.

9. Emergency Medical Care

In the event of an emergency, I authorize Afterglow Roller Skate Co. to seek emergency medical treatment on my behalf if I am unable to provide consent. I understand that I am responsible for any resulting medical expenses.

10. Photography & Video

During events, photographs or video may be taken for promotional purposes.

11. Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable laws of Canada.

12. Acknowledgement

By signing below, I acknowledge that:

• I have carefully read this agreement.

• I understand its contents.

• I understand that I am giving up certain legal rights.

• I sign this agreement voluntarily.

• I am at least 18 years of age, or I am the parent or legal guardian signing on behalf of a minor participant.

 By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
