Austin Sports Center (ASC) Waiver of Liability, Assumption of Risk, Indemnity Agreement, & Media Release


Review ASC Privacy Policy

This Waiver and Release of Liability (the “Agreement”) is entered into by the undersigned adult participant or the parent/legal guardian of a minor participant (collectively, “Participant”), in favor of the Junior Volleyball Association of Austin (“JVAA”), Austin Sports Center (“ASC”), Austin Juniors Volleyball Club, LLC (“AJV”), and their respective affiliates, directors, officers, members, employees, contractors, agents, volunteers, and representatives (collectively, the “Released Parties”).

1. RELEASE AND WAIVER OF LIABILITY

In consideration of being permitted to access or use the facilities, equipment, services, and participate in any events, practices, programs, or activities offered by or affiliated with the Released Parties (collectively, the “Activities”), I hereby, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, voluntarily and knowingly RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Released Parties from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or relating to any loss, damage, illness, exposure (including to viruses), personal injury, disability, or death, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

2. ASSUMPTION OF RISK

I understand and acknowledge that participation in the Activities involves inherent risks, including physical injury, illness, permanent disability, emotional distress, or death. These may result from, among other causes, the use or misuse of equipment, physical contact, slips, or falls. I voluntarily assume full responsibility for any and all risks of injury, illness, or death associated with participation, even if arising from the negligence of the Released Parties.

3. INDEMNIFICATION

I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from any and all claims, causes of action, damages, costs, expenses, or liabilities (including attorney’s fees) arising out of or relating to (i) my participation or that of my minor child in the Activities; (ii) my or my minor child’s presence on or use of the facilities; or (iii) any act or omission by me or my minor child, including claims based on negligence of any of the Released Parties.

4. MEDICAL TREATMENT

I authorize the Released Parties to obtain or provide emergency medical care that may be deemed necessary for me or my minor child, and I agree to be financially responsible for such care.

5. RULES, REGULATIONS, AND REMOVAL

I understand and agree to abide by all facility and program rules includes the Rules and Regulations posted in the facility and on the ASC website (https://www.austinsportscenter.com/asc/about/#rulesandsafety) and acknowledge that the Released Parties may remove any Participant for behavior deemed unsafe, inappropriate, or in violation of such rules.

6. FIREARMS AND WEAPONS POLICY

Notice pursuant to Texas Penal Code:

  • 30.06 – Concealed Handguns Prohibited: A person licensed under Subchapter H, Chapter 411, Government Code (Concealed Handgun Law), may not enter this property with a concealed handgun.
  • 30.07 – Openly Carried Handguns Prohibited: A person licensed under Subchapter H, Chapter 411, Government Code, may not enter this property with a handgun that is carried openly.

7. MEDIA RELEASE

I hereby grant the Released Parties permission to use my and/or my child’s likeness, image, voice, and appearance in photographs, video recordings, or other media for promotional, educational, or commercial purposes, without compensation or prior notice. I waive any rights of review or approval, and release all claims against the Released Parties related to such use.

 8. SEVERABILITY

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 9. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any legal action shall be brought exclusively in a court of competent jurisdiction located in Travis County, Texas.

 ACKNOWLEDGMENT OF UNDERSTANDING

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND ACKNOWLEDGE THAT BY SIGNING, I AM GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I SIGN THIS AGREEMENT VOLUNTARILY AND INTEND FOR IT TO BE A COMPLETE RELEASE OF LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

FOR PARTICIPANTS UNDER 18 YEARS OF AGE: 

I certify that I am the parent or legal guardian of the minor named below and that I have the legal authority to enter into this Agreement on their behalf. I understand and agree that by signing this Agreement, I am waiving rights on behalf of the minor and myself.
