RIVACY POLICY AND DATA USE AGREEMENT

By signing this waiver, Participant acknowledges and agrees that WachSquad Haven Legacy Co., LLC (“Organizer”) may collect, store, and use personal information provided in connection with participation in activities at WachSquad Haven.

Information Collected

Participant understands that the Organizer may collect the following information:

  • Full name, address, phone number, and email
  • Date of birth and age
  • Emergency contact information
  • Electronic signature and waiver acknowledgment
  • Participation history and event attendance
  • Photos, video recordings, and audio recordings

Purpose of Data Collection

Participant agrees that this information may be used for:

  • Liability protection and legal documentation
  • Safety, emergency response, and incident reporting
  • Event management and participant tracking
  • Communication regarding events, updates, or safety notices
  • Compliance with applicable laws and regulations

Data Storage and Security

Participant understands that:

  • Information may be stored electronically through third-party waiver platforms and internal systems
  • Reasonable measures will be taken to protect personal data, but no system is completely secure
  • Organizer is not liable for unauthorized access beyond its reasonable control

Third-Party Services

Participant acknowledges that third-party services (such as waiver platforms, email systems, or payment processors) may store or process their data. These services operate under their own privacy policies.

No Sale of Personal Information

Organizer does not sell personal information to third parties. Information is only used for operational, legal, and safety purposes.

Photography and Media

Participant acknowledges and agrees that:

  • Photos, videos, and recordings may be taken on the property
  • Such media may be used for marketing, promotional, or documentation purposes
  • Participant waives any right to compensation or ownership of such media

Data Retention

Participant understands that personal information and signed waivers may be retained for as long as necessary to:

  • Protect against legal claims
  • Comply with legal obligations
  • Maintain business records

Participant Rights

Participant may request access to or deletion of their personal information where permitted by law by contacting the Organizer directly. Certain information may be retained if required for legal or liability purposes.

Consent

By signing this waiver, Participant:

  • Consents to the collection and use of their information as described above
  • Acknowledges that submission of information is voluntary but required for participation
  • Understands that refusal to provide required information may result in denial of entry

READ CAREFULLY – THIS IS A LEGALLY BINDING AGREEMENT AND INCLUDES A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS


Review WachSquad Haven's Privacy Policy

1. INTRODUCTION

In consideration for being permitted to enter, access, observe, or participate in any activities at WachSquad Haven, a private ranch, recreational, training, and event property operated by WachSquad Haven Legacy Co., LLC (“Organizer”), the undersigned participant (“Participant”) agrees to the following terms.

This agreement applies to ALL activities, whether organized, supervised, unsupervised, incidental, or accidental.

2. ACKNOWLEDGMENT OF INHERENT RISKS

PARTICIPANT ACKNOWLEDGES THAT ACTIVITIES AT WACHSQUAD HAVEN ARE INHERENTLY DANGEROUS AND MAY RESULT IN SERIOUS INJURY OR DEATH.

Activities include, but are not limited to:

  • livestock handling and animal interaction
  • firearms use, shooting, and hunting
  • operation of machinery, tractors, tools, and equipment
  • off-road vehicles (ATVs, UTVs, Motorcycles, trucks, etc.)
  • water activities including, but not limited to, swimming and fishing
  • mixed martial arts, grappling, striking, and physical training
  • gym and strength equipment use
  • climbing, obstacle courses, and physical challenges
  • construction and building activities
  • camping and overnight stays
  • events, gatherings, and group activities
  • exposure to wildlife, insects, terrain, and weather

Risks include but are not limited to:

  • death, paralysis, or permanent disability
  • animal bites, kicks, trampling
  • firearm discharge or projectile injury
  • drowning
  • falls, collisions, and blunt force trauma
  • equipment malfunction or misuse
  • vehicle accidents
  • acts of other participants
  • negligent supervision or lack of supervision
  • environmental and weather hazards
  • Injury or death of Participant's animal, including as a result of defensive or protective actions taken to safeguard livestock


3. ASSUMPTION OF RISK

PARTICIPANT KNOWINGLY AND VOLUNTARILY ASSUMES ALL RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE ORGANIZER.

PARTICIPANT EXPRESSLY ASSUMES ALL RISKS RELATED TO BRINGING ANIMALS ONTO THE PROPERTY, INCLUDING INJURY, DEATH, OR LOSS OF SUCH ANIMALS, REGARDLESS OF CAUSE.

Participant expressly assumes all risks associated with alcohol or controlled substance use, including risks arising from impaired judgment or coordination.

 

4. TEXAS AGRITOURISM WARNING

WARNING: Under Texas law (Chapter 75A, Civil Practice and Remedies Code), an agritourism entity is not liable for any injury to or death of an agritourism participant resulting from an agritourism activity. An agritourism participant assumes the inherent risks of an agritourism activity.

 

5. TEXAS LIVESTOCK LIABILITY WARNING

WARNING: Under Texas law (Chapter 87, Civil Practice and Remedies Code), a livestock owner is not liable for injury to or death of a participant in livestock activities resulting from the inherent risks of livestock activities.

 

6. RELEASE OF LIABILITY

PARTICIPANT HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE WachSquad Haven, its owners, officers, employees, agents, volunteers, contractors, affiliates, and representatives (“Releasees”) from ANY AND ALL LIABILITY arising out of or related to participation.

This includes claims arising from:

  • NEGLIGENCE
  • PREMISES LIABILITY
  • EQUIPMENT FAILURE
  • ANIMAL BEHAVIOR
  • FIREARMS
  • WATER HAZARDS
  • ACTIONS OF OTHER PARTICIPANTS
  • LACK OF SUPERVISION
  • INJURY TO OR DEATH OF PARTICIPANT-OWNED ANIMALS
  • ACTIONS TAKEN TO PROTECT LIVESTOCK, INCLUDING USE OF FORCE

 

7. COVENANT NOT TO SUE

Participant agrees to NEVER initiate any lawsuit or claim against Releasees for any injury, damage, or loss arising from participation.

 

8. INDEMNIFICATION

Participant agrees to DEFEND, INDEMNIFY, AND HOLD HARMLESS Releasees from any claims, damages, or costs (including attorney fees) arising from:

  • Participant’s actions
  • Participant’s negligence
  • Injuries caused to others
  • Actions of minors under Participant’s supervision
  • Actions or behavior of Participant's animal
  • Any harm caused to livestock or other animals by Participant's animal

 

9. SUPERVISION DISCLAIMER

Participant acknowledges:

  • WachSquad Haven is NOT a supervised facility
  • Activities may occur WITHOUT supervision
  • Staff may NOT monitor all areas

Participant acknowledges that WachSquad Haven is not a supervised facility and that participants may engage in activities independently and at their own risk.


10. PARTICIPANT INTERACTION & CONTACT ACTIVITIES

Participant acknowledges that:

  • activities may involve physical contact
  • other participants may act negligently or unpredictably

Participant assumes ALL risks arising from:

  • physical contact
  • collisions
  • combat sports
  • shared equipment
  • firearms activities
  • vehicle use


11. THIRD-PARTY / GUEST LIABILITY

Participant agrees that Releasees are NOT responsible for injuries caused by other participants.

Participant releases Releasees from any claims involving participant-to-participant injury.

Participant agrees that Releasees are not responsible for any injury or damage caused by or to Participant's animal, including interactions with livestock or other animals.


12. FIREARMS AND WEAPONS ACKNOWLEDGMENT

Participant acknowledges:

  • firearms and ammunition may be present
  • hunting and shooting may occur
  • firearms are inherently dangerous

Participant agrees to follow all firearm safety rules and assumes all risks.


13. EQUIPMENT USE AND INSPECTION

Participant agrees:

  • all equipment is used at their own risk
  • to inspect all equipment before use
  • to report unsafe conditions


14. PROPERTY DAMAGE RESPONSIBILITY

Participant agrees to be financially responsible for ANY damage caused to:

  • buildings
  • land
  • fencing
  • equipment
  • vehicles
  • animals (including livestock loss, injury, or death caused by Participant or Participant's animal)


15. MEDICAL CONSENT

Participant:

  • authorizes emergency medical treatment
  • accepts all medical costs
  • acknowledges delayed emergency response in rural areas


16. COMMUNICABLE ILLNESS

Participant assumes all risks related to exposure to communicable diseases.


17. ALCOHOL AND CONTROLLED SUBSTANCE POLICY AND LIABILITY

Participant acknowledges that the use of alcohol or controlled substances increases the risk of injury, property damage, and death.

Participant agrees to the following:

LEGAL COMPLIANCE

  • Participant will comply with all applicable federal and Texas laws regarding alcohol and controlled substances.
  • NO PERSON UNDER THE AGE OF 21 may possess or consume alcohol on the property under any circumstances.
  • Participant agrees that Organizer has the right to verify age at any time.

ASSUMPTION OF RISK

  • Participant assumes FULL RESPONSIBILITY for any decision to consume alcohol or controlled substances.
  • Participant acknowledges that intoxication impairs judgment, coordination, and reaction time, especially in environments involving:
  • livestock
  • firearms
  • vehicles
  • water hazards
  • physical activity


PROHIBITED ACTIVITIES WHILE IMPAIRED

Participant agrees they will NOT engage in any of the following while under the influence of alcohol or controlled substances:

  • handling or being in proximity to firearms
  • operating vehicles, machinery, or equipment
  • handling or interacting with livestock or animals
  • participating in physical training, combat sports, or high-risk activities
  • swimming or entering water features


NO DUTY TO MONITOR OR INTERVENE

Participant acknowledges:

  • Organizer has NO OBLIGATION to monitor alcohol consumption or determine intoxication levels
  • Organizer has NO DUTY to prevent Participant from engaging in unsafe behavior
  • Organizer is NOT RESPONSIBLE for the actions of intoxicated individuals


REMOVAL AND DENIAL OF ACCESS

Organizer reserves the absolute right, at its sole discretion, to:

  • deny entry
  • remove any individual from the property
  • require immediate cessation of activities

for any reason, including suspected intoxication.

RELEASE AND INDEMNIFICATION

Participant agrees to:

  • RELEASE Organizer from any claims arising from alcohol or substance use
  • DEFEND, INDEMNIFY, AND HOLD HARMLESS Releasees from any damages, injuries, or claims caused by Participant’s intoxication 

 

18. CAMPING AND OVERNIGHT RISKS

Participant acknowledges additional risks:

  • wildlife
  • fire
  • weather
  • darkness
  • isolation


19. WATER HAZARD DISCLAIMER

Participant acknowledges:

  • drowning risk
  • hidden underwater hazards
  • no lifeguards


20. FORCE MAJEURE

Releasees are not liable for:

  • weather
  • natural disasters
  • wildlife
  • acts of God
  • equipment failure


21. PHOTOGRAPHY AND MEDIA RELEASE

Participant grants permission for use of:

  • photos
  • videos
  • recordings

for marketing and promotional purposes.


22. PARTICIPANT-OWNED ANIMALS (INCLUDING PETS, EQUINE, AND LIVESTOCK)

Participant acknowledges that ANY animal brought onto the property, including but not limited to dogs, cats, horses, cattle, or other livestock, is brought entirely at Participant’s sole risk and responsibility, regardless of species, size, or purpose.

Participant acknowledges and agrees to the following:

  • Participant assumes FULL AND ABSOLUTE RESPONSIBILITY for the behavior, control, and actions of their animal at all times.
  • Participant represents and warrants that any animal brought onto the property:
  • is properly trained and under control at all times
  • has no known dangerous or aggressive tendencies toward livestock, people, or other animals
  • will be restrained by leash, lead, crate, enclosure, or physical control at all times unless expressly authorized otherwise
  • Large animals (including but not limited to horses and cattle) must be handled only by competent and experienced individuals.
  • Participant is responsible for ensuring animals are properly restrained, contained, or controlled using appropriate equipment and handling practices standard for that species.
  • Failure of equipment, handling, or control does NOT shift responsibility from Participant.

Participant acknowledges and agrees to the following:

  • NO REPRESENTATION OF SAFETY IS RELIED UPON BY ORGANIZER. Any statement by Participant that an animal is “safe,” “trained,” or “will not harm livestock” is not relied upon by Organizer and does not limit Participant’s liability.
  • Organizer makes NO GUARANTEE regarding separation between livestock and Participant’s animal.
  • Livestock, wildlife, and working animals are present and may provoke or be harmed by Participant’s animal.
  • Participant acknowledges that all animals, regardless of training, temperament, or prior behavior, are inherently unpredictable, and Participant assumes all risks associated with that unpredictability.

LIVESTOCK PROTECTION AND LETHAL FORCE AUTHORIZATION

Participant expressly acknowledges and agrees:

  • Protection of livestock is a critical and non-negotiable priority of the property.
  • If Participant’s animal harasses, chases, injures, or threatens livestock, Organizer and/or property representatives have the absolute right to take immediate action, including lethal force, to stop the threat.
  • Participant consents in advance to such action and WAIVES ANY AND ALL CLAIMS arising from injury or death of their animal under such circumstances.

 

INDEMNIFICATION FOR ANIMAL-RELATED DAMAGE

Participant agrees to:

  • DEFEND, INDEMNIFY, AND HOLD HARMLESS Releasees from ANY claims, damages, losses, or costs arising from:
  • actions of Participant’s animal
  • injury to livestock, wildlife, or other animals
  • injury to persons caused by Participant’s animal
  • property damage caused by Participant’s animal
  • Be financially responsible for:
  • veterinary costs
  • livestock loss (including fair market value and breeding value)
  • consequential damages resulting from livestock injury or death

STRICT LIABILITY ACKNOWLEDGMENT

Participant agrees that responsibility for their animal applies REGARDLESS OF FAULT OR CIRCUMSTANCE, including but not limited to:

  • accidental escape
  • failure of tack, leash, fencing, enclosure, or equipment
  • handler error or loss of control
  • unexpected or aggressive animal behavior
  • reactions to livestock, wildlife, firearms, vehicles, or other stimuli

HUMAN SAFETY / SELF-DEFENSE AUTHORITY

Participant acknowledges that animals, including horses and livestock, may be unpredictable and dangerous.

Participant expressly agrees:

  • If any animal brought by Participant poses a threat of injury or harm to any person, including Organizer, family members, guests, or other participants, Organizer and/or property representatives have the immediate and unrestricted right to take any action deemed necessary to eliminate the threat, including use of force up to and including lethal force.
  • Participant consents in advance to such actions and WAIVES ANY AND ALL CLAIMS arising from injury or death of their animal resulting from such actions.
  • Participant agrees that no prior warning is required before such action is taken when a threat is perceived.

23. ENTRY REQUIREMENT

ALL individuals must have a signed waiver on file before entering the property.


24. ENTIRE AGREEMENT

This agreement represents the entire understanding between the parties.


25. SEVERABILITY

If any provision is invalid, all others remain enforceable.


26. GOVERNING LAW

This agreement is governed by the laws of the State of Texas.


27. BINDING EFFECT

This agreement is binding on Participant and their:

  • heirs
  • successors
  • assigns


28. ACKNOWLEDGMENT

BY SIGNING, PARTICIPANT:

  • HAS READ THIS AGREEMENT
  • UNDERSTANDS THE RISKS
  • VOLUNTARILY ACCEPTS ALL TERMS
