Release

PLEASE READ THIS RELEASE CAREFULLY, as it is a legal release, hold harmless, assumption of risk, waiver, and covenant not to sue agreement ("Release"). In consideration of the State of Wyoming allowing me to participate in the youth activity sponsored by the State of Wyoming, Department of State Parks and Cultural Resources, Division of State Parks, Historic Sites and Trails "State Parks" ("Event"), including any or all of the Event's activities located on land administered by State Parks, I agree as follows: 

As a participant in the Event (including any of the Event's activities), I recognize and acknowledge that I am participating in a "recreational opportunity under the Wyoming Recreation Safety Act (Wyo. Stat.§ 1-1-121, et seq., the "Act") and therefore, under the Act, assume certain inherent risks in the recreational opportunity. In addition, I recognize and acknowledge that there are non-inherent risks of physical injury, including death, and I agree that I, on behalf of myself, my personal representatives and my heirs, hereby assume all inherent and non-inherent risks and all responsibilities, and agree to release the State of Wyoming, Department of State Parks and Cultural Resources, Division of State Parks, Historic Sites & Trails, and all of their officers, employees and agents (hereinafter collectively referred to as the "State") from any and all injuries, losses, damages, and/or death that may arise out of my participation in the Event (including any or all of the Event's activities) including those injuries, losses, damages and/or death caused by the State's negligence or any other person's negligence or any other cause. 

I understand that photographs and video may be taken by the State for future promotion of the Event. I agree that by participating in the Event that the State has permission to use my image, picture, name, likeness, voice, biographical material, or performance to appear on or in any media, including but not limited to print, audio/visual, web page, electronic, film, video or broadcast. I agree that I shall not receive any compensation of any kind as a result of the use of my image, picture, name, likeness, voice, biographical material, or performance. 

Further, in consideration of the State allowing me to participate in the Event, I agree as follows: 

As a participant in the Event, I, my personal representatives and my heirs agree to hold harmless, release, and indemnify the State from any and all claims, suits, or causes of action for bodily injury, property damage, or other damages, including death which may arise out of or be caused by my participation in the Event, including any or all of the Event's activities. This Release shall, in all respects, be governed by and interpreted, construed and enforced in accordance with the laws of the State of Wyoming. The State of Wyoming, Department of State Parks and Cultural Resources, Division of State Parks, Historic Sites & Trails and their employees expressly reserve sovereign immunity and specifically retail all immunity and all defenses available to them as sovereigns pursuant to Wyo. Stat.§ 1-39-104(a) and all other applicable law. 

I HAVE READ THIS RELEASE, AND BY SIGNING BELOW, I AGREE IT IS MY INTENTION TO ASSUME ANY AND ALL RISKS AND RESPONSIBILITIES AND RELEASE THE STATE FROM ANY AND ALL LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, OF WRONGFUL DEATH ARISING OUT OF MY PARTICIPATION IN THE EVENT INCLUDING THOSE INJURIES, LOSSES, DAMAGES OR DEATH CAUSED BY THE STATE'S NEGLIGENCE OF ANY OTHER PERSON'S NEGLIGENCE OR ANY OTHER CAUSE. 

FURTHER, BY SIGNING BELOW, I AGREE IT IS MY INTENTION TO ACCEPT LEGAL RESPONSIBILITY AND PAY FOR ANY LOSS FOR CLAIMS OR LAWSUITS AGAINST THE STATE ARISING OUT OF OR CAUSED BY MY PARTICIPATION IN THE EVENT, INCLUDING ANY OR ALL OF THE EVENT'S ACTIVITIES. 

I have had the opportunity to ask questions about this Release and I understand its terms and meaning, and sign it knowingly, willingly, and voluntarily. If the participant is under 18 years old, the parent or legal guardian must sign this Release for the minor. By signing below I agree that I am the parent or legal guardian of the minor child referenced below. I further agree that my child and I are both bound by the terms of this Release.
