Avise La Fin Firearms Training LLC – Liability Waiver Agreement

WHEREAS, in return for instruction firearms, use of premises, and for other good and valuable

consideration, the receipt and sufficiency of which is hereby acknowledged,


I,

hereby agree to the following Liability Waiver Agreement (“Agreement”) with

Avise La Fin Firearms Training LLC in its entirety and I acknowledge that I have fully read and

understand this Liability Waiver Agreement prior to signing this document. The parties hereto agree as

follows:

1. All references to “Avise La Fin Firearms Training LLC” throughout this Agreement hereby includes:

Avise La Fin Firearms Training LLC, Ryan Kennedy individually and doing business as Avise La Fin

Firearms Training LLC, and any employees, instructors, directors, officers or agents of Avise La Fin

Firearms Training LLC, whether or not expressly stated herein.

2. Participant agrees to indemnify, hold harmless and defend Ryan Kennedy, Avise La Fin Firearms

Training LLC, and any of its employees, directors, officers or agents, from any and all fault, liabilities,

costs, expenses, claims, demands or lawsuits arising out of, related to or connected with: the discharge

or firearms; the course of instruction; Participant’s participation in the course of instruction; the range,

buildings, and premises used for the course of instruction (hereinafter the “Premises”); Participant’s

presence on or use of said Premises; and any and all acts or omissions of the undersigned parties. And

should any such claim, demand or lawsuit arise or be asserted in any way whatsoever related thereto,

whether arising under the laws of the United States or of any State, or under any theory of law or equity,

the undersigned will indemnify, hold harmless and defend Avise La Fin Firearms Training LLC, from

any and all costs, expenses or liability including, but not limited to, the cost of any settlement or

judgment made or rendered against Avise La Fin Firearms Training LLC whether individually, jointly,

or in solido with the undersigned, together with all costs of court and other costs or expenses incurred

in connection with any such claim, demand or lawsuit, including attorney’s fees.

3. Participant is at least 18 years of age, mentally competent, medically able and legally permitted to possess

and use firearms. To the extent Participant is a minor, the parent or guardian listed below gives Participant

permission to participate in an Avise La Fin Firearms Training LLC’s event under the conditions stated

within and signs on behalf of Participant. The individual signing below gives the General Release freely

and knowingly with full understanding of its content and effect.

4. Avise La Fin Firearms Training LLC will allow Participant entry into the course after Participant signs

this Agreement. Participant acknowledges that the course, though beneficial is not a necessity and that

similar courses are offered by other entities. Participant is under no physical or economic compulsion from

Avise La Fin Firearms Training LLC to engage in this particular course or to sign this waiver.

5. Participant will follow all directions given by Avise La Fin Firearm Training LLC for the duration of

the course. Participant acknowledges that such directions are vital for the safety of all course

participants. Failure to follow directions from the instructor may result in Participant’s ejection from the

course without refund of any monies paid to Avise La Fin Firearms Training LLC for Participant’s

attendance.

6. Participant expressly acknowledges that training with live ammunition is inherently dangerous and that

there is no possible way that Avise La Fin Firearms Training, LLC, its employees, or its agents can

provide a totally safe environment for the course. Participant acknowledges that attending and

participating in the course will enhance Participant’s exposure to risk of injury occasioned by

carelessness of any and/or all individuals associated with the course. The Participant risks serious bodily

injury and harm that includes a risk of death and/or dismemberment. Participant hereby assumes the risk

of any and all injury that may result in participation of the course/training.

7. Participant hereby absolves Avise La Fin Firearms Training LLC, (including Ryan Kennedy and/or

associates and/or agents) harmless from any sort of injury or damage experienced by Participant in

taking the course/training. Participant expressly waives any and all rights and causes of action

Participant may have for compensation at law and equity, including negligence, from Avise La Fin

Firearms Training LLC in such event that the Participant is injured and shall indemnify the same.

8. Participant does not have any physical injuries or restrictions that would limit or prevent Participant

from participating in this training and Participant will inform the instructor(s) upon arrival to the facility

or training venue of any change or injury regardless of nature or occurrence.

9. Participant understands that any photographic, video, or other electronic imagery produced as a result

of this class is for the sole purpose of Avise La Fin Firearms Training LLC in their advertising and

promotional uses. Participant hereby gives permission to Avise La Fin Firearm Training LLC to use any

images and video/audio recordings of Participant for the above mentioned purposes.

10. Participant certifies that he/she is not a fugitive from justice, or under indictment. Participant is legally

permitted to possess and use firearms, ammunition, and other related equipment (“firearms”), whether

as part of an Avise La Fin Firearm Training LLC event or otherwise, and is capable of using firearms

safely. Participant is responsible for determining the requirements of all applicable laws as they may

relate to ownership, possession and use of firearms, and remaining compliance with such requirements.

Participant will follow the policies, procedures and rules of the venue and Avise La Fin Firearms

Training LLC range rules, including the policies, procedures and rules of the venue where an Avise La

Fin Firearms Training, LLC event takes place. Avise La Fin Firearms Training LLC reserves the right

to revoke Participant’s right to participate in an Avise La Fin Firearms Training LLC event at any time

for any reason.

11. Participant certifies he/she has not been convicted or arrested for any criminal offense in which

Participant could have been sentenced to one (1) year or more of incarceration. Participant is not

currently on formal, informal, or summary probation/parole for any reason. Participant is not currently

under the influence of an over-the-counter or prescription drug that would impair my judgement of

physical ability to safely operate a firearm (real or simulated). Finally, Participant is not currently under

adjudication or under any Court’s jurisdiction for mental incompetence.

12. Participant understands the hazards of coronavirus and similar infectious diseases and accepts full

responsibility for self-compliance with the most recent CDC guidelines. Notwithstanding the risks

associated with infectious disease, which are readily acknowledged, Participant hereby willingly

chooses to participate, acknowledging and fully assuming the risk of illness or death arising from

participating in the activities, arising from or out of, or relating to, directly or indirectly, the infection of

coronavirus or any other illness or injury.

13. The parties hereto agree that should any dispute arise out of this Agreement or between the parties

pursuant to this Agreement, any dispute shall be resolved by the laws of the Commonwealth of

Pennsylvania and that the courts of the Commonwealth of Pennsylvania shall have sole jurisdiction over

any such matter.

14. This Liability Waiver Agreement will continue in effect even after termination of Participant’s

participation in an Avise La Fin Firearms Training LLC event. This instrument binds the undersigned

and his/her executers, administrators, assignees or heirs. By signing below, Participant acknowledges

and agrees to the above terms and conditions.
