MADWORLD HAUNTED ATTRACTION WAIVER



  Madworld Haunted Attraction (MADWORLD) is an indoor/outdoor trail that you walk through with a group for the reasons of experiencing fright, monsters chasing you, and pure horror. You will encounter different kinds of creatures and characters in the woods whom are present to scare you the best way they know how. In our family fun zone (day time events section) you will experience a jumping pillow, haybale maze, tractor rides, face painting, along with other outdoor activities where you could be seriously injured. Being in the woods, you will also encounter trees, leaves, foliage, bushes, small hills, ruts, stumps, roots, weeds and possible slippery areas. There is also a possibility of spiders, ants, snakes, and other various varmints being present. Madworld Haunted Attraction has taken precautions to rid the woods of these certain things for your personal safety and the safety of the actors. But even so, you are still at risk of all the things stated above and Madworld Haunted Attraction and/or the property owners cannot be held liable or responsible. I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Madworld Haunted Attraction, its employees, owners, or any affiliates thereof. 

   I am fully aware of the unusual risks involved and hazards connected with this activity, including, but not limited to the attractions at Madworld Haunted Attraction and family fun zone (day time events). I hereby elect to voluntarily participate in said activity with full knowledge that said activity may be hazardous to me and my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY, DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, as a result of being engaged in such an activity, WHETHER CAUSED BY NEGLIGENCE OF RELEASEES OR OTHERWISE.

   I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage or costs, including court and attorney fees that they may incur due to my participation in said activity, WHETHER CAUSES BY NEGLIGENCE OF RELEASEES or otherwise.

   It is my express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENENANT NOT TO SUE the above-named RELEASEES. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of South Carolina.

   Madworld Haunted Attraction is a very intense and aggressive haunt. This means, our actors are very aggressive with their roles. The monsters are not supposed to touch you and have been advised not to, but you may brush up on their costumes or come in contact with some of the sets. You may also be accidentally touched. When this happens, you may also get fake blood or certain colored stains on your clothes or apparel. If this happens, Madworld Haunted Attraction and/or the property owners cannot be held liable or responsible. You give up the right to sue or press charges.

*Photo Release: Please understand that there are cameras taking pictures and videos constantly. By signing this, you also agree to have your picture taken and used as marketing material in commercials, flyers, and any various other promotionals.

ASSUMPTION OF RISK AND RELEASE OF LIABILITY RELATING TO CORONAVIRUS/COVID-19 (this “Agreement”)

Coronavirus (COVID-19) has been declared a worldwide pandemic by the World Health Organization. Coronavirus is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend physical “social” distancing and have, in many places, prohibited the assembly of large groups (usually of ten or more people).

You acknowledge that Madworld Haunted Attraction (MADWORLD) has taken measures to reduce the potential spread of the coronavirus within the facility. However, MADWORLD cannot guarantee that you, your guests, or your family will not be exposed to or become infected with the coronavirus. You understand that by accessing the facility, you may be putting you, your guests, and/or your family at increased risk for contracting the coronavirus. You further acknowledge that individuals with health conditions such as heart disease, cancer, or diabetes may be more likely to suffer more severe symptoms as a result of contracting the coronavirus.

By signing below, you (referred to below as “I”) understand, acknowledge, and agree to the following statements:

  • I assume the risk that I, my guests and/or my child(ren) may be exposed to or become infected with the coronavirus and that such exposure and/or infection may result in personal injury;; illness, causing mild symptoms such as fever or body aches, or more severe complications, such as pneumonia or organ failure; permanent disability or death; and
  • I understand that the risk of exposure to or infection with the coronavirus may result from the acts, omissions, or negligence of myself or others, including but not limited to, the employees, owners, and other customers of MADWORLD and
  • I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself, my guests, or my family (including, but not limited to personal injury, disability, or death), illness, damage, ,loss, claim, liability, or expense (including, but not limited to medical bills, attorneys’ fees, and court costs), of any kind that I, my guests, and/or my family may experience or incur in connection with my access to the facility or the attractions provided by MADWORLD (collectively, “Claims”); and
  • I hereby release, covenant not to sue, discharge and hold harmless MADWORLD and each’s employees, agents, owners, representatives, and affiliates (collectively, “Releasees”), of and from all Claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or related to my access to the premises or participation in the attractions provided by MADWORLD, whether arising out of negligent or grossly negligent acts or omissions of any Releasee or otherwise, and whether any coronavirus infection or exposure occurs before, during, or after access to the facility in any of the attractions provided by MADWORLD; and
  • I understand that by signing this release, I am waiving any and all Claims, including those Claims that may be unknown to me, or which I do not suspect to exist at this time. IF I AM A RESIDENT OF CALIFORNIA, I HEREBY EXPRESSLY WAIVE ALL RIGHTS, BENEFITS, AND PROTECTIONS I MAY HAVE UNDER CALIFORNIA CIVIL CODE SECTION 1542, WHICH READS AS FOLLOWS:
  • A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
  • I understand and agree that this Agreement shall be in addition to, and not in lieu of, any other assumption of risk provisions or releases of liability. Such assumption of risk agreements and releases shall remain fully intact.
  • If any provision of this Agreement is held to be unenforceable, then this Agreement will be deemed amended to the extent necessary to render the otherwise unenforceable provision, and the rest of the Agreement, valid and unenforceable. If a court or arbiter declines to amend this Agreement as provided herein, the invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of the remaining provisions, which shall be enforced as if the offending provision had not been included in this Agreement. Releasees are third-party beneficiaries to this Agreement and shall have the right to enforce this Agreement as if Releasees were a party hereto.
  • I ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT, HAVE BEEN GIVEN THE OPPORTUNITY TO REVIEW ITS TERMS WITH MY LEGAL COUNSEL, AND AM VOLUNTARILYI GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE MADWORLD FOR CLAIMS, WHETHER KNOWN OR UNKNOWN, ARISING OUT OF THE ACTIVITIES.

By signing this waiver, you understand and agree to the terms and conditions stated above.
