PLEASE READ CAREFULLY BEFORE SIGNING – BY SIGNING THIS AGREEMENT YOU WILL GIVE UP CERTAIN RIGHTS, INCLUDING THE RIGHT TO SUE CLIMB YUKON ASSOCIATION. If you have any questions about this form, please ask before signing. This is a legal agreement between you (from now referred to as the “Participant”) and Climb Yukon Association. “Climb Yukon” and includes its board members, staff, volunteers, instructors, contractors, and any other people or organizations working with it. By signing this form, you agree to the following: 1. Activities This waiver covers all Activities with Climb Yukon. The term “Activities” includes, without limitation, climbing, bouldering, training, stretching, watching, volunteering, instructing, and anything else connected to Climb Yukon events or services. 2. Medical Fitness The Participant is responsible for making sure they are physically and mentally able to take part in the activities. The Participant should bring any medication they may need and share any necessary medical information with Climb Yukon. The Participant understands that Climb Yukon is not required to provide medical care, and that medical services may not be nearby or available during the activities. 3. Participant Behavior The Participant is responsible for their own behaviour. The Participant must not do anything—or encourage anyone else to do anything—that could cause harm or danger to themselves or others. The Participant is expected to act safely and responsibly at all times. 4. Assumption of Risk The Participant understands that participating in the Activities involves inherent risks and while it is impossible to contemplate all the risks involved in the Activities, some of the risks include accidents, bodily harm, injury, incapacitation, and/or death. The Participant voluntarily accepts and assumes all risks associated with the Activities, even if such risks arise from the negligence or fault of Climb Yukon or any other party. THE PARTICIPANT UNDERSTANDS THAT NEGLIGENCE INCLUDES THE FAILURE OF CLIMB YUKON TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT THE PARTICIPANT FROM THE RISKS, DANGERS AND HAZARDS OF THE ACTIVITIES. 5. Release of Liability To the fullest extent permitted by law, the Participant agrees to release, waive, discharge, and hold harmless Climb Yukon from any and all claims, damages, demands, lawsuits, damages, injuries, losses, costs, or expenses, including legal fees (each of these are referred to as a “Claim”) arising out of or related to the Participant’s involvement in the Activities, whether caused by the negligence, recklessness, or other acts of Climb Yukon or otherwise. The Participant understands that the words “release, waive, discharge and hold harmless” means that that the Participant will not sue Climb Yukon in the event of a Claim. 6. Indemnification The Participant agrees to indemnify and hold harmless Climb Yukon against any Claim sustained by the Participant or caused by the Participant during the course of the Activities. The Participant understands that the word “indemnification” means that if the Participant’s actions lead to a Claim, and Climb Yukon gets sued or has to pay for damages or legal costs, the Participant will cover those costs in full. 7. Emergency Situations In the event of an emergency, Climb Yukon will take reasonable steps to address the situation. The Participant grants permission to Climb Yukon to seek emergency medical treatment on their behalf in the event of injury or illness during the Activities. The Participant further acknowledges that in the event of an accident, rescue and medical treatment may not be available. 8. Following Instructions The Participant agrees to follow all the safety instructions and guidelines provided by Climb Yukon before and during the Activities. 9. No Alcohol or Drugs The Participant agrees not to use alcohol or illegal drugs before or during the activities. Climb Yukon may refuse participation to anyone they believe is impaired or otherwise unfit for the activity. 10. Governing Law Any dispute arising from this Agreement shall be resolved in the courts of the Yukon Territory and Canada, as applicable. 11. Consideration In exchange for signing this Agreement and agreeing to its terms, the Participant acknowledges receiving good and valuable consideration, specifically one dollar ($1.00), the receipt and sufficiency of which is hereby acknowledged. This consideration allows the Participant to take part in Climb Yukon’s Activities. 12. Severability If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions will continue in full force and effect. 13. Acknowledgment By signing below, the Participant confirms that: - They have had enough time to read this agreement.
- They understand and accept what it says.
- They had a chance to ask questions.
- They are signing it voluntarily.
MEDIA RELEASE I consent to the taking and use of photographs or video footage of myself, without compensation, for use by the Operator. This use includes but is not limited to use on climbyukon.net, social media pages, in newsletters and publications for distribution, and promotion for future events by the Operator and Providers, and other social media, media, and fundraising purposes. I further understand that this consent may be withdrawn by me at anytime, upon written notice.
FOR PARENTS/GUARDIANS OF PARTICIPANTS UNDER 19 YEARS OF AGE For and on behalf of a Participant of minority age, by signing where indicated below, I hereby certify that I am the parent/guardian with legal responsibility for the participant of minority age, and acknowledge the risks associated with the participation by the participant in Climbing Activities and I hereby consent to the participation of the minority age participant in Climbing Activities and agree for myself, my heirs, executors, assigns, and next of kin, to release, indemnify, and save harmless the Releasees from all liabilities, however arising, incident to the participation by the participant of minority age in Climbing Activities.
