Waiver & Release of Liability

Open Play • Birthday Parties • Community Events


This Waiver and Release of Liability ("Agreement") is entered into by the undersigned participant or parent/legal guardian on behalf of themselves and any minor child(ren) participating at Frolic & Lark Play Studio ("Frolic & Lark").

By signing this Agreement, you acknowledge that you have read, understood, and voluntarily agree to all terms contained herein.

This Agreement applies to participation in Open Play, birthday parties, private events, community events, and all other non-licensed childcare activities conducted at Frolic & Lark Play Studio.

1. Assumption of Risk

I understand that participation in an indoor playground involves inherent risks that cannot be completely eliminated. These risks include, but are not limited to:

• Slips, trips, and falls

• Climbing, jumping, crawling, and balancing activities

• Contact with play equipment

• Contact with other participants

• Bruises, cuts, scrapes, sprains, fractures, or other injuries

• Equipment failure despite reasonable inspection and maintenance

• Other injuries that may occur during normal active play

I voluntarily assume all risks associated with participation for myself and my child(ren).



2. Parent & Guardian Responsibilities

For Open Play, birthday parties, and community events, I understand that Frolic & Lark is not providing childcare.

I understand that I am solely responsible for actively supervising my child(ren) at all times while they are participating in Open Play or attending an event unless they are enrolled in a separately licensed childcare program operated by Frolic & Lark.

I agree not to leave the premises while my child is participating in Open Play.



3. Health Acknowledgment

I certify that I and my child(ren):

• Are physically able to participate.

• Will not participate while experiencing symptoms of a contagious illness.

• Have disclosed any medical conditions, allergies, or special considerations that could affect safe participation.

I understand that participation while ill may place others at risk.


4. Facility Rules

I agree that my family will follow all posted rules and staff instructions, including:

• Children must wear grip socks while using play equipment.

• Adults entering the play area must wear socks.

• Play equipment must be used only as intended.

• Children should use equipment appropriate for their age, size, and developmental abilities.

• Rough play, pushing, throwing objects, or unsafe behavior is prohibited.

• Food and beverages are permitted only in designated areas.

• Staff may stop unsafe play at any time.

I understand that failure to follow these rules may result in removal from the facility without refund.


 

 

5. Birthday Parties & Private Events

If I am hosting or attending a birthday party or private event, I understand that:

• Parents and guardians remain responsible for supervising their children.

• Frolic & Lark staff monitor the facility but do not provide childcare during parties.

• Party hosts are responsible for ensuring guests complete a waiver before participating in play.


6.    Release of Liability

To the fullest extent permitted by Oregon law, I voluntarily release, waive, and discharge Frolic & Lark Play Studio, its owner, employees, contractors, volunteers, affiliates, and property owners from any and all claims, demands, causes of action, damages, losses, or expenses arising from participation in activities at the facility, except where caused by gross negligence or willful misconduct.

This release applies to injuries, property damage, or other losses resulting from participation in Open Play, birthday parties, private events, community events, or other recreational activities.



7.    Indemnification

I agree to defend, indemnify, and hold harmless Frolic & Lark Play Studio, its owner, employees, contractors, volunteers, affiliates, and property owners from any claims, damages, liabilities, costs, expenses, or attorney fees arising from my actions or the actions of my child(ren) while participating at the facility, except where prohibited by law.


8. Medical Authorization

In the event of an accident or medical emergency, I authorize Frolic & Lark staff to obtain emergency medical care for myself or my child(ren) if I cannot be reached immediately.

I understand that every reasonable effort will be made to contact me or my emergency contact before treatment whenever practical.

I accept responsibility for any medical expenses incurred.

10. Personal Property

I understand that Frolic & Lark Play Studio is not responsible for lost, stolen, or damaged personal belongings brought into the facility.


11. Agreement

By signing below, I certify that:

12. Electronic Signature Acknowledgment

I understand that this Agreement may be completed using an electronic signature. I acknowledge that my electronic signature is legally binding and has the same force and effect as a handwritten signature.

I understand that this Agreement applies to participation in Open Play, birthday parties, private events, community events, and other applicable recreational activities at Frolic & Lark Play Studio. This Agreement will remain valid for future visits unless I revoke it in writing or a new version of this Agreement is presented for my signature.
