WAIVER & RELEASE 

NOTICE: THIS IS A LEGALLY BINDING AGREEMENT

1. I fully understand and appreciate the dangers, hazards and risks inherent in a firing range, including the inherent risks associated with the use and misuse of firearms including but not limited to injury, physical injury, serious injury, serious physical injury, disability, permanent disability, disfigurement, permanent disfigurement, emotional distress, severe emotional distress and death.

2. I acknowledge and understand that I will be voluntarily engaging in activities that involve the discharging of firearms which may result in the risk of injury, physical injury, serious injury, serious physical injury, scarring, loss of important bodily function, permanent disability, or death, and may cause severe social or economic losses due to not only my own actions, inaction or negligence, but also to the action, inaction or negligence of others or conditions of the premises or of any equipment used. Further, I acknowledge that there may be other risks not known to me or not reasonably foreseeable at this time and I further agree to waive any and all claims and/or causes of actions whether known or unknown in consideration of using the Center Target Indoor Range.

3. I assume all the foregoing risks and accept personal responsibility for any and all damages following such injury, serious injury, serious physical injury, disability, permanent disability, disfigurement, permanent disfigurement, emotional distress, severe emotional distress or death. I am currently NOT under the influence of alcohol or drugs.

4. I release from, waive and discharge any and all actions, claims, or demands that I, my assignees, heirs, guardians or legal representatives now have or hereafter have for any and all damage or losses that I may suffer including but not limited to injury, physical injury, severe injury, severe physical injury, disfigurement, permanent disfigurement, disability, permanent disability or death or damages related to any of the aforementioned caused or alleged to be caused in whole or in part by the acts, omissions or negligence of Center Target Indoor Range, LLC; Center Target Firearms, LLC; Center Target Greater Defense, LLC; 4C Holdings, LLC; William Joe Robinson I; William Joe Robinson II; Sheena Rae Robinson and any of their heirs, assigns, agents, associates, subsidiaries, shareholders, directors, officers and/or employees arising out of my use of the Center Target Indoor Range. I further agree to indemnify and hold harmless the aforementioned parties for any and all claims herein released.

tand and agree that if I am pregnant or may be pregnant, shooting on the range or being present inside the range can be detrimental to the health of an unborn child and If I choose to enter into the range, I am solely responsible per items 3 and 4 above for any injury to the unborn child or issues caused with the pregnancy as a result of my actions.

6. I agree to comply with all the laws of the Commonwealth of Kentucky regarding the use and possession of firearms. I am NOT a convicted felon or currently under a domestic violence court order.

7. I have NEVER BEEN adjudicated as a mental defective OR committed to a mental institution by a court, board, commission, or other lawful authority.

8. I understand and agree that this waiver and release contains the entire agreement among the parties with respect to the subject mater hereof. No representation, inducements, promises or agreements, oral or otherwise, which are not embodied herein shall be of any force or effect.

9. I understand and agree that the language of this release shall not be interpreted in favor or against any Party as the drafter of this release.

10. I understand and agree that no provision, wording, term or otherwise within this waiver and release is meant to conflict with any other provision, wording or term and is only meant to supplement this waiver and release for a broader reading.

11. I understand and agree that in the event that any term, wording, provisions or otherwise within this waiver and release is found to be invalid, illegal or incapable of being enforced then the term, wording, provision or otherwise shall be excluded only to the extent of such invalidity, illegality or un-enforceability and all other terms, wording, provisions or otherwise shall remain in full force and effect.

I HAVE CAREFULLY READ THE ABOVE WAIVER AND RELEASE OF LIABILITY AND FULLY UNDERSTAND THAT I GIVE UP SUBSTANTIAL RIGHTS BY SIGNING IT AND I DO SIGN IT VOLUNTARILY. I AGREE TO PARTICIPATE KNOWING THE RISKS AND CONDITIONS INVOLVED AND DO SO ENTIRELY OF MY OWN FREE WILL.

ADDITIONAL PARENTAL RELEASE FOR MINORS

Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.

12. If I am signing this agreement as a parent or guardian of a child under the age of 18, so that the child may be able to enter the range or make use thereof, then I AGREE TO INDEMNIFY AND HOLD HARMLESS Center Target Indoor Range, LLC; Center Target Firearms, LLC; Center Target Greater Defense, LLC; 4C Holdings, LLC; Williams Joe Robinson I; William Joe Robinson II; Sheena Rae Robinson and their heirs, assigns, agents, associates, subsidiaries, shareholders, directors, officers and/or employees FROM ANY AND ALL LIABILITIES, CLAIMS, DEMANDS OR CAUSES OR ACTION BROUGHT BY OR ON BEHALF OF THE CHILD FOR INJURIES AND DAMAGES ARISING OUT OF THE USE OF THE RANGE, OR MY CHILD’S PRESENCE AT THE RANGE, THAT IS ALLEGED TO HAVE BEEN CAUSED BY THE ACTS, OMISSIONS or NEGLIGENCE OF any of the aforementioned parties. Further, on behalf of the minor(s) identified on this form, as to whom I am the legal parent or guardian, generally and specifically, I hereby and forever, generally and specifically release and discharge and agree to indemnify and hold harmless Center Target Indoor Range, LLC; Center Target Firearms, LLC; Center Target Greater Defense, LLC; 4C Holdings, LLC; Williams Joe Robinson I; William Joe Robinson II; Sheena Rae Robinson and their heirs, assigns, agents, associates, subsidiaries, shareholders, directors, officers and/or employees from any and all liabilities, claims, demands or causes of action that the minor(s) may have against the range for any and all injuries and/or damages that may be incurred while using the range or while on the range premises.

13. [PARENTS OR GUARDIAN OF MINORS ONLY] I agree to instruct the minor participant to the above warnings and conditions and their ramifications, and consent to the minor’s participation. I further agree that the minor is bound by all provisions of this waiver to the fullest extent of the law. The following people may bring my minor child to the range and are responsible for my minor child while participating on said range:
