Car Rental Agreement

This Car Rental Agreement ("Agreement") is entered into by and between Hawaiian Island Cruisers LLC, (“Lessor") and the undersigned individual ("Lessee").

5. Terms and Conditions:

a. The Lessee agrees to return the vehicle in the same condition as it was at the commencement of the rental period. If vehicle is excessively dirty a $150 fee will be issued.

b. The Lessee is responsible for all traffic violations and fines incurred during the rental period.

c. Smoking and pets are prohibited in the rental vehicle. A $200 fine is issued for smoking of ANY substances in the vehicle.

d. The Lessee is responsible for all fuel expenses. The vehicle should be returned with the same level of fuel as at the start of the rental period.

e. Vehicle shall not be used for any off-roading. A $500 fine will be issued for breaking this term. Vehicles are equipped with GPS tracking so Lessor will know if vehicle is taken to a location that has not been authorized.

f. The Lessee is responsible for any damage to the vehicle, excluding normal wear and tear.

g. Lessee must have received preauthorization from Lessor if vehicle is to be taken up Mauna Kea. Lessee is responsible to use low gear while driving down Mauan Kea. It is very important that Lessee understand the need to drive safe while going downhill. Instead of using the brakes to slow the vehicle down on a steep grade, use what is known as “engine braking” using 1st or 2nd gear (Low Gear) and avoid damaging or overheating the vehicle brakes. Lessee is responsible of break damages and towing expenses in Mauan Kea area. Make sure you use Low gear and brakes judiciously.

h. Keys: Loss/Lockout is Lessee’s responsibility.

i. Broken glass, unless caused by an actual accident with another vehicle at fault, is the responsibility of the Lessee.

j. Vehicle to be returned to specified location by date and time specified in reservation. There is no grace period on vehicle return. Any vehicle returned after the indicated return time will be charged to Lessee at the maximum daily rate.

k. Absolutely no refunds, except for repeated mechanical failure.


Vehicle will not be used or operated by anyone:

a. Who is under 21 years of age;
b. Who is not listed as an additional driver on the rental agreement;
c. To carry persons or property for hire;
d. In any race, test, or similar type contest or activity;
e. In a careless or negligent manner;
f. Under the influence of alcohol or narcotics;
g. Outside Hawaii Island;
h. For any illegal purpose or in the commission of a crime;
i. If vehicle is obtained from lessor by fraud or misrepresentation;
j. Other than on paved roads, or graded private roads or driveways;
k. Who loads vehicle beyond its rated capacity;
l. Who allows more passengers than the vehicle has seat belts for, or is designed to carry;
m. Who drives it with a trailer attached.

PROHIBITED USE OF THE VEHICLE VIOLATES THIS AGREEMENT, VOIDS ALL LIABILITY AND OTHER INSURANCE COVERAGE, MAKES LESSEE RESPONSIBLE FOR ALL LOSS OR DAMAGE TO OR CONNECTED WITH VEHICLE, REGARDLESS OR CAUSE, INCLUDING BUT NOT LIMITED TO LESSOR’S EXPENSES, INCLUDING LOSS OF USE.

Insurance:

a. The Lessor provides insurance coverage options are available at an extra cost. If Lessee declines this option, Lessee’s own insurance will cover Lessee, anything that Lessee’s coverage does not cover, Lessee will be responsible for.

b. The Lessee is responsible for any deductibles outlined in the insurance policy.

Governing Law:

This Agreement shall be governed by the laws of the State of Hawaii.
