WAIVER OF CLAIMS AND INDEMNITY

1000028789 Ontario Inc. ("Fitcourts") and its directors, officers, committee members, shareholders, members, employees, volunteers, participants, contractors, agents and representatives, owners/operators are not responsible for any injury, personal injury, death, damage, property damage, expense, loss of income or loss of any kind suffered by me during, or as a result of, use of equipment or facilities, participating in events, the acts of others, the unavailability of emergency medical care, or caused in any manner whatsoever including, but not limited to, the negligence of the Organization.

I understand and acknowledge that participation in physical activity has foreseeable and unforeseeable inherent risks, hazards, and dangers that no amount of care, caution, or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis, and loss of life.

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization, and COVID-19 is extremely contagious. Fitcourts has put in place preventative measures to reduce the spread of COVID-19; however, the organization cannot guarantee that you will not become infected with COVID-19.

I am participating voluntarily with Fitcourts. In consideration of my participation, I hereby acknowledge that I am aware of the risks, dangers, and hazards associated with or related to Fitcourts, its facilities, and its programs.

I acknowledge and agree that I have the requisite skills, qualifications, physical abilities, and training necessary for the proper and safe use of the equipment and facilities. I acknowledge and agree that if I have any questions as to what skills, qualifications or training is necessary to properly use the equipment, or facility, or to participate in a program, I will direct such questions to Fitcourts. I further acknowledge and agree that any questions relating to my physical ability to properly use the equipment, facility, or to participate in programs will be determined by me in consultation with my physician, and I shall not rely on any statements or omissions from Fitcourts. If I believe the conditions of a facility, equipment or program to be unsafe, I will immediately discontinue further participation.


RELEASE OF LIABILITY AND DISCLAIMER

I do hereby agree to waive and relinquish all claims I may have against Fitcourts and its directors, officers, committee members, shareholders, members, employees, volunteers, participants, contractors, agents, and representatives.


I further agree to indemnify and hold harmless and defend Fitcourts and its directors, officers, committee members, shareholders, members, employees, volunteers, participants, contractors, agents, and representatives from any and all claims resulting from injuries, including damages and losses sustained by me and arising out of, connected with, or in any way associated with the facilities, equipment or activities of Fitcourts.

This release, waiver and indemnity is intended to be as broad and inclusive as is permitted by law of the Province of Ontario and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

I UNDERSTAND THAT THIS ABSOLUTE RELEASE OF LIABILITY, EVEN FOR THEIR OWN NEGLIGENCE, IS AN INTEGRAL REQUIREMENT AND PRE-CONDITION OF PARTICIPATION AT FITCOURTS FACILITIES.

I HAVE CAREFULLY READ THIS WAIVER, AND RELEASE AND FULLY UNDERSTAND ITS CONTENTS, AND THAT IT IS AN ABSOLUTE RELEASE AND I FREELY AND VOLUNTARILY ACCEPT ITS TERMS AND I ALSO UNDERSTAND IT IS BINDING UPON ME, MY HEIRS, SPOUSE IN INTEREST AND ASSIGNS.
