Hold Harmless, Release of Liability & Assumption of Risk Agreement

In consideration for being permitted to participate in any motorcycle tour, event, or activity organized by Moto Odyssey LLC, the participant, on behalf of themselves, their heirs, executors, administrators, successors, and assigns, hereby agrees to the following:

1. Release & Hold Harmless

The participant agrees to indemnify, defend, and hold harmless Moto Odyssey LLC, and all officers, employees, contractors, tour guides, volunteers, and agents from any and all claims, demands, causes of action, damages, losses, liabilities, or expenses arising out of or related to:

Any injury, accident, or death occurring while participating in or traveling to/from any Moto Odyssey LLC tour or activity.

Any negligence by third parties, including other motorists, riders, or members of the public.

Any hazardous road conditions, whether known or unknown (including potholes, gravel, debris, animals, weather, construction, or detours).

Any conflicts or altercations involving the public or other participants.

2. Mechanical Responsibility

The participant warrants that their motorcycle (or rental motorcycle) is in excellent mechanical condition, roadworthy, and appropriate for the tour’s length, terrain, and demands. They accept full responsibility for maintaining the motorcycle throughout the tour.

3. Assumption of Risk

The participant understands that motorcycling is an inherently dangerous activity involving significant risk of injury or death. The risks referenced in this agreement are representative and not exhaustive, and the participant voluntarily chooses to participate with full knowledge and acceptance of all such risks.

TERMS & CONDITIONS

Tour Operator: Moto Odyssey LLC, P.O. Box 7, Colchester, CT 06415

Tour Booking Forms & Waivers: By signing the booking form and Hold Harmless Agreement, the participant agrees to all terms and conditions herein. No participant may join a tour without fully executed documents.

Reservations & Deposits: A non-refundable deposit of $500.00 is required at the time of booking to reserve a place. The remaining balance is due 59 days prior to departure. Failure to pay the balance may result in cancellation and application of the cancellation fees.

Tour Inclusions: Tours may include motorcycle transport, double or queen-occupancy hotel/motel accommodations (single occupancy available for an additional fee), some meals, a support vehicle (if included for that specific tour), professional tour guide(s), and select sightseeing fees. Items of a personal nature are not included.

Baggage: Moto Odyssey LLC assumes no responsibility for lost, damaged, or delayed baggage. All luggage handed over for daily transport is at the participant’s own risk. Limit: One bag per person.

Cancellation & Refund Policy:

  • 60+ days before departure: Deposit forfeited
  • 59–45 days before departure: 70% of tour cost forfeited
  • Less than 45 days before departure: 100% of tour cost forfeited

No exceptions will be made for any reason. Trip cancellation insurance is strongly recommended.

Discretionary One-Year Hold Policy (At Moto Odyssey LLC’s Sole Discretion): Moto Odyssey LLC may, at its sole discretion, offer a one-time, one-year credit hold for riders who are unable to attend a destination tour due to extraordinary circumstances. This credit may be applied to a future Moto Odyssey LLC tour within 12 months of the original tour start date. This option is not guaranteed, is not automatic, and is granted only at the exclusive discretion of Moto Odyssey LLC. Administrative or rebooking fees may apply. Credits have no cash value and are non-transferable. Moto Odyssey LLC reserves the right to decline a reschedule request for any reason.

Tour Cancellation by Moto Odyssey LLC: If Moto Odyssey LLC cancels the tour, customers will be notified immediately. Moto Odyssey LLC may offer to operate the tour at an adjusted price if minimum participation is not met. If customers decline, all payments will be refunded. Moto Odyssey LLC is not responsible for additional costs incurred due to cancellation (airfare, hotels, transfers, etc.). Once a tour begins, no refunds will be issued for early withdrawal or inability to complete the tour.

Alterations to Schedule: Weather, seasonal changes, or circumstances beyond control may require adjustments to accommodations, routing, or daily schedule. No refunds will be issued for such changes.

Verbal Changes: No verbal modifications are valid unless confirmed in writing by Moto Odyssey LLC.

Minimum Participants: Moto Odyssey LLC may cancel a tour up to 30 days prior to departure if fewer than 12 riders have booked and paid in full.

Insurance Requirements: Motorcycle insurance is mandatory for all riders participating in any Moto Odyssey LLC tour. Participants are strongly encouraged to carry travel insurance, medical insurance, accident insurance, and trip cancellation insurance.

Traffic Laws & Group Riding Rules: Failure to comply with traffic laws or group riding guidelines may result in immediate removal from the tour without refund.

Alcohol & Substance Use Policy: Alcohol or drug use while riding is strictly prohibited.

Alcohol Use: For the safety of all participants, no alcohol consumption is permitted until the official riding day has fully concluded, as determined by Moto Odyssey LLC.

Participants must ensure that any alcohol consumed after riding does not impair their ability to safely operate a motorcycle the following day. Moto Odyssey LLC reserves the right to remove any participant from the tour, without refund, if their ability to ride safely is in question due to alcohol use.

Zero Drug Policy: To protect the safety of all riders, guides, and members of the public, Moto Odyssey LLC enforces a strict zero-tolerance drug policy.

Moto Odyssey LLC reserves the right, at its sole discretion, to:

  • Remove any participant from the tour immediately and without refund
  • Deny continued participation for safety reasons
  • Require emergency medical evaluation if impairment is suspected

Participants acknowledge that non-compliance with this policy constitutes a material breach of the tour contract and may result in dismissal from the tour with no compensation or refund. 

I acknowledge that Moto Odyssey LLC’s tour policies, safety requirements, and participation rules are publicly posted on the company’s website and booking platform, and I agree to comply with all such policies as a condition of participation.
