CART RENTAL AGREEMENT

WITH  WAIVER, HOLD HARMLESS AND RELEASE

The undersigned desires to rent a  motorized cart (similar to a golf cart) for purposes of using the cart as a means of transportation around the sporting course and property at the Keystone Clay’s, LLC sporting clays facility. In exchange for the opportunity to rent said cart, and the opportunity to make use of the same, the undersigned agrees as follows:

 

1. The undersigned will at all times drive only within the pathways and driveway areas set out on the property for use by said carts;

 

2. That the undersigned assumes all risks relating to the use of the cart; and

 

3. That the undersigned accepts the responsibility to make sure the cart will be safely driven at all times, and fully accepts the responsibility for any and all accidents or damages which may be caused by the failure to use in a safe manner or to drive the cart safely.

 

4. Should any damages or injuries be caused as a result of the use of the cart rented by the undersigned, the undersigned agrees to be fully responsible for and liable for any and all damages and injuries caused thereby, and the undersigned also agrees to release, indemnify and hold harmless Keystone Clays, LLC, including it’s members, employees, officers, volunteers and associates (including it’s Landlord DDH Rolling Hills Farm, LLC), of and from all claims, suits, and damages (property and injuries) which may result out of or from the use of said rented cart.
