PLAY AND PONDER LIABILITY RELEASE WAIVER

KIDS-TIME LLC - DBA, PLAY AND PONDER LIABILITY RELEASE WAIVER

By signing this waiver, I, the undersigned, as the parent or legal guardian of the minor participant(s), acknowledge and agree to the following terms and conditions for entry into the Play and Ponder play area:

General Rules & Policies

1. Shoes are not permitted in the play area. All adults and children must wear socks at all times. Grippy socks are mandatory for kids and strongly recommended for parents. Socks are available for purchase.

2. Parents and guardians are responsible for their children and must remain on-site with them at all times. Play and Ponder employees are not responsible for children during open play sessions, events, or parties. We will have additional staff supervision for camps and Parent Night Out.

3. No outside food or drinks are allowed in the play area. Closed water bottles are permitted. All food and beverages purchased from the Play and Ponder lounge must be consumed in the designated snack area. Food served in our facility is provided by a third-party vendor and is sold "as is" without any modification or guarantee by Play and Ponder. Any concerns or issues related to food quality, preparation, or service should be directed to the third-party vendor.

4. No aggressive or unsafe behavior is tolerated. Disruptive or dangerous behavior may result in removal from the facility.

5. Health & Safety: Children exhibiting visible signs of illness (such as fever, coughing, or runny nose) will be asked to leave and may not return until they are symptom-free.

6. For the health and safety of all, visitors may be asked to leave if they are visibly ill, including symptoms of COVID-19. If you have a reservation for open play or a party, we will allow one complimentary rescheduling to accommodate your health needs.

7. Security Cameras are in use throughout the facility for safety purposes.

8. Damages: I agree to pay for any damages caused by myself or my child due to willful actions, neglect, or recklessness.

9. No birthday parties or similar gatherings are allowed during open play hours unless a reservation is made for a private event.

Storage of Personal Belongings

1. Storage Shelf: Play and Ponder offers a designated shelf area and lounge space for guests to store personal belongings, including bags, coats, and cold-weather jackets. No wet items are allowed inside the play area, especially during rainy or damp days. Play and Ponder is not responsible for any lost, stolen, or damaged items stored in the designated shelf or lounge area.

Alcohol Service Disclaimer

1. Alcoholic beverages (beer, wine, and spritzers) are served only in the designated lounge area. Alcoholic drinks will only be served by OLCC-certified staff. The consumption of alcohol is strictly prohibited in the play area. Play and Ponder adheres to all OLCC regulations and state laws.

Injury Disclaimer

Play and Ponder is not responsible for any injuries that may occur as a result of running, falling from railings, climbing rocks, or using slides within the play area. These activities carry inherent risks, and participants engage in them at their own risk.

Loss or Damage Disclaimer

1. Play and Ponder is not responsible for any lost, stolen, or damaged items brought into the facility, including those stored in the designated shelf area. Guests are encouraged to keep their personal belongings with them at all times or utilize the provided storage.

2. We will collect all lost and found items and store them safely. If not claimed within 2 weeks, we will clean, donate, or dispose of them.

Assumption of Risk

I understand that using the Play and Ponder facilities involves inherent risks, including, but not limited to, the risk of injury, illness, property damage, bodily harm, or even death. I voluntarily assume all risks associated with participation in activities at Play and Ponder.

Release of Liability

By signing this waiver, I hereby release, discharge, and hold harmless Play and Ponder, KidsTime LLC, its owners, employees, agents, and representatives from all liability, claims, demands, actions, or causes of action arising from the use of the Play and Ponder facilities, including any personal injury, illness, damage, loss, or death sustained by me or the minor(s) under my care.

Health and Safety During COVID-19

1. I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I and any minor children in my care may be exposed to or infected by COVID-19 while visiting Play and Ponder. This exposure could result in personal injury, illness, permanent disability, or death.

2. I attest that neither I nor any minors under my care are experiencing symptoms of COVID-19 (fever, cough, difficulty breathing, etc.).

3. I agree to follow all COVID-19-related policies, including any infection prevention procedures set forth by Play and Ponder or local health authorities.

Indemnification

I agree to indemnify and hold Play and Ponder harmless from any claims, lawsuits, or expenses that may arise as a result of my or my child’s participation in activities at the facility.

Arbitration

Any disputes arising out of or relating to this waiver shall be resolved through mediation, and if necessary, by arbitration under the laws of the state of Oregon.

Acknowledgement

I certify that I have read, understood, and voluntarily agree to the terms and conditions outlined above. I also acknowledge that I am responsible for the actions of the minor(s) under my care. This waiver applies to all future visits to Play and Ponder.
