IMPORTANT NOTICE WARNING: BY SIGNING THIS AGREEMENT, YOU MAY GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING A CLAIM OR LAWSUIT AGAINST JAD'S PARKOUR NOVA SCOTIA (“PKNS”) AND OTHER RELEASED PARTIES. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE SIGNING. This Agreement contains important legal provisions, including an assumption of risk, release of liability, waiver of claims, indemnification obligations, emergency medical authorization, and media release. For the purposes of this Agreement, Jad's Parkour Nova Scotia shall hereinafter be referred to as "PKNS." By signing this Agreement, the participant, or the parent/legal guardian where applicable, acknowledges that they have read, understood, and voluntarily agreed to its terms. 1. DEFINITIONS AND SCOPE OF ACTIVITIES This Agreement applies to participation in any activities organized, hosted, supervised, instructed, or provided by Jad's Parkour Nova Scotia, including but not limited to: - Parkour and freerunning;
- Movement training;
- Obstacle course and ninja-style training;
- Climbing, jumping, vaulting, balancing, rolling, running, and landing activities;
- Strength and conditioning;
- Physical education and athletic training;
- Recreational games and activities;
- Classes, workshops, camps, open gym sessions, competitions, demonstrations, performances, and events; and
- Any related physical, athletic, recreational, educational, or movement-based activities.
All such activities are collectively referred to in this Agreement as the "Activities." For the purposes of this Agreement, "Jad's Parkour Nova Scotia" and the "Released Parties" include, where applicable: - Owners and operators;
- Directors and officers;
- Employees;
- Instructors and coaches;
- Volunteers;
- Contractors;
- Agents and representatives;
- Affiliates and organizers;
- Facility owners and landlords;
- Sponsors; and
- Any other individuals or entities acting on behalf of Jad's Parkour Nova Scotia.
2. VOLUNTARY PARTICIPATION, HEALTH AND PHYSICAL CONDITION I acknowledge and agree that my participation in the Activities is entirely voluntary. I represent that I am, or that my participating child is, in suitable physical condition to participate in the Activities. I understand that it is my responsibility to determine whether I am physically and mentally capable of safely participating. I acknowledge that I am not aware of any medical, physical, or other condition that would prevent my safe participation in the Activities. If I have concerns regarding my ability to participate safely, I agree to consult a physician or other qualified healthcare professional before participating. I agree that I will not participate if I am under the influence of alcohol, recreational or illegal drugs, or any medication or other substance that may impair my judgment, coordination, reaction time, or ability to participate safely. I understand that I may stop participating at any time if I feel unable to continue safely. I agree to immediately inform an instructor, coach, employee, or representative of Jad's Parkour Nova Scotia if I: - Experience pain, illness, injury, dizziness, or unusual symptoms;
- Become aware of an unsafe condition;
- Believe that equipment may be damaged or unsafe; or
- Feel unable to safely continue participating.
I understand that Jad's Parkour Nova Scotia does not provide accident, medical, or dental insurance for participants, and I am responsible for obtaining any insurance or medical coverage that I consider necessary. 3. ACKNOWLEDGEMENT AND ASSUMPTION OF RISK I understand and acknowledge that participation in the Activities involves inherent and unavoidable risks. These risks may arise from my own actions or inactions, the actions or negligence of other participants or individuals, equipment or facility conditions, environmental conditions, unforeseen hazards, or circumstances that cannot reasonably be anticipated. I understand that the risks may include, but are not limited to: - Slips, trips, falls, and collisions;
- Falls from elevated surfaces, obstacles, platforms, climbing structures, or equipment;
- Improper, unsuccessful, or unexpected landings;
- Loss of grip, footing, balance, coordination, or control;
- Contact or collision with the ground, walls, structures, equipment, obstacles, instructors, spectators, or other participants;
- Equipment failure, malfunction, misuse, or improper use;
- Injuries resulting from physical exertion, fatigue, dehydration, dizziness, or reduced reaction time;
- Sprains, strains, bruises, cuts, abrasions, dislocations, fractures, muscle injuries, tendon or ligament injuries;
- Concussions and injuries involving the head, neck, spine, back, shoulders, limbs, joints, nerves, internal organs, or other parts of the body;
- Changes in blood pressure or other effects associated with strenuous physical activity;
- Exposure to environmental conditions or unforeseen hazards;
- Injuries resulting from the actions, omissions, or negligence of other participants or individuals;
- Damage to or loss of personal property;
- Serious injury, illness, permanent disability, paralysis, or death; and
- Other known and unknown risks associated with physical and athletic activities.
I understand that no amount of instruction, supervision, equipment, warning, or safety procedures can completely eliminate all risks associated with the Activities. I freely, knowingly, and voluntarily accept and assume all risks associated with participation in the Activities, whether such risks are known or unknown, foreseeable or unforeseeable. 4. RULES, SAFETY INSTRUCTIONS AND PARTICIPANT CONDUCT I agree to follow all reasonable rules, policies, procedures, safety guidelines, instructions, and directions established by Jad's Parkour Nova Scotia. I understand that instructions may be communicated verbally, in writing, through demonstrations, signage, or other reasonable means. I agree to: - Follow instructions provided by instructors, coaches, and staff;
- Use equipment only as instructed and for its intended purpose;
- Respect other participants, instructors, coaches, employees, and staff;
- Conduct myself in a safe and responsible manner;
- Immediately report unsafe conditions or equipment concerns when reasonably possible;
- Avoid attempting movements, skills, or obstacles beyond my reasonable ability or skill level;
- Respect designated activity areas and facility rules; and
- Exercise reasonable care for my own safety and the safety of others.
I understand that failure to follow safety instructions or rules may increase the risk of injury. Jad's Parkour Nova Scotia reserves the right to refuse, suspend, discontinue, or terminate my participation if, in its reasonable judgment, my conduct is unsafe, disruptive, reckless, or presents a risk to myself or others. Removal from an Activity may occur without refund where permitted by applicable policies or law. 5. EQUIPMENT AND FACILITY USE I understand that the Activities may involve the use of obstacles, climbing structures, platforms, mats, rails, bars, walls, and other training equipment or facilities. I agree to: - Use equipment and facilities only as instructed;
- Use equipment only for its intended purpose;
- Visually inspect equipment before use when reasonably possible;
- Immediately report damaged, malfunctioning, or unsafe equipment;
- Avoid attempting movements or obstacles beyond my ability;
- Follow all posted and communicated facility rules; and
- Respect designated activity and restricted areas.
I understand that Jad's Parkour Nova Scotia cannot guarantee that every possible hazard will be identified or eliminated. 6. RELEASE OF LIABILITY AND WAIVER OF CLAIMS In consideration of being permitted to participate in the Activities, I, on behalf of myself and, where applicable, my heirs, executors, administrators, personal representatives, assigns, successors, and estate, hereby voluntarily: RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS Jad's Parkour Nova Scotia and the Released Parties from any and all claims, demands, actions, causes of action, proceedings, liabilities, damages, costs, expenses, or losses arising out of or relating to my participation in the Activities. This release applies to any claim relating to: - Personal injury;
- Illness or disease;
- Emotional or psychological injury;
- Property damage or loss;
- Permanent disability;
- Paralysis;
- Death; or
- Any other loss, injury, or damage arising from participation in the Activities.
This release includes claims arising from the negligence of the Released Parties, to the fullest extent permitted by applicable law. I understand that by signing this Agreement, I may be giving up certain legal rights, including the right to bring a lawsuit or claim against Jad's Parkour Nova Scotia or the Released Parties for injuries, losses, or damages arising from participation in the Activities, to the fullest extent permitted by law. 7. INDEMNIFICATION AND HOLD HARMLESS I agree to indemnify, defend, and hold harmless Jad's Parkour Nova Scotia and the Released Parties from and against claims, demands, liabilities, damages, costs, expenses, or legal fees arising from or relating to: - My participation in the Activities;
- My actions or omissions;
- My failure to follow applicable rules, policies, or instructions;
- Any breach of this Agreement;
- Any injury or damage caused by me to another person or property; or
- Claims brought by third parties arising from my conduct or participation.
Where I am signing on behalf of a minor participant, this obligation also applies, to the fullest extent permitted by law, to claims arising from the minor participant's actions or omissions. 8. PERSONAL PROPERTY AND THIRD-PARTY CLAIMS I understand that I am responsible for my personal belongings and property while participating in the Activities. To the fullest extent permitted by law, Jad's Parkour Nova Scotia and the Released Parties are not responsible for the loss, theft, or damage of personal property brought onto the premises or used in connection with the Activities. I also acknowledge responsibility for injury or damage caused to another person or property as a result of my actions or conduct, subject to applicable law. 9. EMERGENCY MEDICAL CARE In the event of an accident, injury, illness, or medical emergency, I authorize Jad's Parkour Nova Scotia and its representatives, where reasonably necessary, to obtain or arrange emergency medical assistance for me. Where applicable, I also authorize emergency medical assistance for my participating minor child. I understand that: - Emergency assistance may be limited by the circumstances of the situation;
- Staff and instructors are not responsible for diagnosing medical conditions;
- I am responsible for medical, transportation, and related expenses arising from emergency assistance, except where otherwise required by law.
10. PHOTO, VIDEO AND MEDIA RELEASE I understand that photographs, videos, audio recordings, or other media may be captured during Activities. Subject to my selection below, I grant Jad's Parkour Nova Scotia permission to photograph, film, record, or otherwise capture my image, likeness, voice, name, and/or performance, or that of my participating minor child. With my consent, Jad's Parkour Nova Scotia may use such media for legitimate purposes, including: - Promotional materials;
- Advertising and marketing;
- Social media;
- Websites;
- Educational materials;
- Publications;
- Documentation of Activities; and
- Other business-related purposes connected with Jad's Parkour Nova Scotia.
I understand that I will not receive payment or other compensation for the authorized use of such media. To the fullest extent permitted by law, I release Jad's Parkour Nova Scotia from claims relating to the authorized use of such media, including claims relating to privacy, publicity, or similar rights. MEDIA CONSENT
11. PARTICIPANTS UNDER 19 YEARS OF AGE If the participant is under 19 years of age, this Agreement must be completed and signed by the participant's parent or legal guardian. By signing on behalf of a participant under 19 years of age, the parent or legal guardian confirms that they: - Are the participant's parent or legal guardian;
- Have the legal authority to enter into this Agreement on behalf of the participant;
- Have read and understood this Agreement;
- Understand the nature and risks of the Activities;
- Have explained the nature and risks of the Activities to the participant, where appropriate;
- Voluntarily consent to the participant's involvement in the Activities;
- Accept and assume the risks associated with the participant's participation; and
- Agree to the terms of this Agreement on behalf of themselves and, to the fullest extent permitted by law, the participant.
I understand that instructors, coaches, and staff may provide instruction and supervision but cannot guarantee the safety of any participant at all times. 12. PARTICIPANT ACKNOWLEDGEMENT By signing this Agreement, I confirm that: - I have carefully read this entire Agreement.
- I understand the nature of the Activities and the risks involved.
- I understand that participation is voluntary.
- I understand that participation may result in serious injury, illness, permanent disability, paralysis, death, or property damage.
- I voluntarily accept and assume the risks associated with participation.
- I agree to follow all applicable rules, policies, and safety instructions.
- I understand that this Agreement contains a release of liability and waiver of certain legal rights.
- I understand that I am responsible for providing accurate information relevant to my safe participation.
- I have had the opportunity to ask questions about this Agreement before signing.
- I understand the legal effect of this Agreement.
- I am signing this Agreement freely and voluntarily without pressure or coercion.
13. GOVERNING LAW AND JURISDICTION This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Nova Scotia and the applicable laws of Canada. To the extent permitted by law, any legal proceeding arising from or relating to this Agreement or the Activities shall be brought before the applicable courts of the Province of Nova Scotia. 14. SEVERABILITY If any provision of this Agreement is found to be invalid, illegal, unenforceable, or contrary to applicable law, that provision shall be modified, limited, or severed only to the minimum extent necessary. The remaining provisions of this Agreement shall continue in full force and effect. 15. ENTIRE AGREEMENT This Agreement constitutes the entire agreement and understanding between the participant and Jad's Parkour Nova Scotia concerning the matters addressed herein. I acknowledge that I have not relied upon any representation, statement, promise, or agreement not specifically contained in this document. Any amendment or modification to this Agreement must be made in writing and acknowledged by Jad's Parkour Nova Scotia where applicable. 16. CONTINUING EFFECT AND SURVIVAL This Agreement applies to participation in Activities organized or provided by Jad's Parkour Nova Scotia during the applicable period of participation, subject to applicable law and any updated agreements required by Jad's Parkour Nova Scotia. Any provision of this Agreement intended by its nature to continue after participation in an Activity shall survive the completion of that Activity. PARTICIPANT DECLARATION AND SIGNATURE I confirm that I have carefully read and understood this Agreement. I understand that participation in the Activities involves inherent risks and that I may suffer serious injury, illness, permanent disability, paralysis, death, or property damage. I understand that by signing this Agreement, I may be giving up certain legal rights, including the right to bring claims against Jad's Parkour Nova Scotia and the Released Parties, to the fullest extent permitted by applicable law. I voluntarily agree to the terms of this Agreement and freely accept the risks associated with participating in the Activities. PARENT / LEGAL GUARDIAN CONSENT REQUIRED FOR PARTICIPANTS UNDER 19 YEARS OF AGE I am the parent or legal guardian of the participant identified in this Agreement. I confirm that I have read and understood this Agreement, including the provisions concerning assumption of risk, release of liability, waiver of claims, indemnification, emergency medical care, and media consent. I voluntarily consent to the participant's involvement in the Activities and agree to the terms of this Agreement on behalf of myself and, to the fullest extent permitted by applicable law, the participant. FINAL ACKNOWLEDGEMENT By signing this Agreement, the participant and/or parent or legal guardian confirms that they have had sufficient opportunity to read and understand this Agreement before signing. They acknowledge that they understand its contents and legal effect and are entering into this Agreement freely and voluntarily.
