INDEMNIFICATION, ASSUMPTION OF RISK, WAIVER OF LIABILITY AND RELEASE

IN CONSIDERATION of being permitted to participate in any way in Ice Skating Activities (defined below), I/We, as participant(s) or if participant(s) is/are a minor(s), as parent and guardian of the minor participant(s), my personal representatives, assigns, heirs, and next of kin (herein referred to as “I/We”):

ASSUMPTION OF RISK: I/We am/are aware that ice skating involves inherent risks, dangers, and hazards, which can result in serious personal injury or death. I/We am/are also aware that ice skating rinks, equipment, and arenas contain dangers that can cause serious injury or death. I/We hereby freely agree to assume and accept all known and unknown risks of injury arising out of the Ice Skating Activities, the use of The Woodlands Township Ice Rink (herein referred to as “the Arena), and the use of any related equipment and facilities (collectively, the “Ice Skating Activities”). I/We recognize and acknowledge that risks of ice skating can be greatly reduced by taking lessons, abiding by all established rules and regulations for the Arena, and using common sense. I/We hereby agree and understand the contagious nature of COVID-19 and voluntarily assume the risk(s) of participating in the programs, services, events or facilities operated by The Woodlands Township which include the risk of becoming exposed to or infected by COVID-19.

RELEASE AND WAIVER OF CLAIMS AGREEMENT: For allowing me/us to participate in Ice Skating Activities in the Arena, on behalf of myself, and my personal representatives and heirs, by participating in the Ice Skating Activities, I/We hereby agree to the fullest extent permitted by law as follows:

  1. WAIVE ANY AND ALL CLAIMS that I/We, on behalf of myself, my personal representatives and heirs, have or may have against The Cynthia Woods Mitchell Pavilion, Spectrum Catering, Concessions and Events dba Spectrum Events (hereinafter referred to as “Spectrum”), and The Woodlands Township, their respective directors, agents, officers, members, volunteers, and employees as well as any sponsors and advertisers along with any of their affiliates, agents, representatives, assigns, successors, officers, directors, shareholders, and employees, and any affiliates or subsidiaries of such entities, any successors and assigns of such entities, and any officers, directors, shareholders, and/or employees or associates of such entities (collectively, the “Released Parties”) arising out of, or in any way related to, the Ice Skating Activities.
  2. TO RELEASE and hold harmless the Released Parties from and against any and all liability and/or claims associated with any loss, damage, injury, death, cost, or expense that I/We (or my personal representatives and heirs) may suffer arising out of or related to Ice Skating Activities, from any cause whatsoever, including, but not limited to, negligence or breach of contract on the part of the Released Parties associated with the operation, supervision, design or maintenance of the Arena.
  3. TO INDEMNIFY AND HOLD HARMLESS the Released Parties from and against any and all claims, damages or causes of action (whether brought on by myself, my personal representatives, and/or heirs) including, but not limited to, those associated with litigation expenses, attorney’s fees, loss, liability, damage, or costs, which may be incurred as a result of any claim arising out of my/our participation in the Ice Skating Activities within the Arena.

I/WE HAVE READ AND FULLY UNDERSTAND THESE TERMS AND UNDERSTAND THAT I/WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO THE TERMS AND HAVE AGREED TO IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE. I/WE UNDERSTAND AND ACKNOWLEDGE THAT MY/OUR RELEASE IS INTENDED TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ANY AND ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY OF THE TERMS HEREIN ARE HELD TO BE INVALID, THE BALANCE OF THESE TERMS, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

MEDIA RELEASE

I further agree pictures taken of me and/or the registrant during the Ice Skating Activities may be used by The Woodlands Township for promotional purposes in a variety of marketing materials, including, but not limited to, print advertisements, flyers, brochures, news releases, social media or The Woodlands Township’s website. I hereby release and discharge The Woodlands Township, its officers, employees, agents, representatives, and affiliates/subsidiaries from any and all claims and demands arising out of or in connection with the use of the photographs or videos, including without limitation to any and all claims for libel, defamation, invasion of privacy, and any other personal and/or property rights.

PHYSICAL/MENTAL FITNESS ACKNOWLEDGEMENT

I/We certify that I/We am/are physically and mentally fit to participate in the Ice Skating Activities and that I/We have no known medical conditions that would prevent me from safely participating. I/We acknowledge and agree that I/We have read and fully understand the terms of this release, will comply with all rules, regulations, instructions, and guidelines, and that I/We voluntarily agree to these terms and conditions set forth herein.
