Assumption of Risk, Waiver and Release of Liability, Facility Conduct, and Medical AuthorizationNOTICE TO PARTICIPATING ADULTREAD THIS FORM COMPLETELY AND CAREFULLY. Basketball, athletic training, coaching, rebounding, demonstrating drills, assisting athletes, handling equipment, and entering active court or training areas involve risks of serious injury, permanent disability, paralysis, or death. This Agreement applies to an adult who enters or participates in active athletic areas as a coach, trainer, parent, guardian, team representative, volunteer assistant, or other authorized adult participant. A PERSON WHO REMAINS SOLELY A SPECTATOR IS NOT CONSIDERED A PARTICIPATING ADULT FOR PURPOSES OF THIS FORM. By signing this Agreement, you acknowledge and assume the risks described below and release certain claims, including claims arising from ordinary negligence, to the maximum extent permitted by Arizona law. 1. Consideration and Permission to ParticipateIn consideration of being permitted to enter restricted athletic areas of No Backboard Basketball Gym and to coach, assist, supervise, demonstrate, rebound, handle equipment, participate in drills, or otherwise engage in authorized activities described in this Agreement, I agree to its terms. Permission to access active court, training, athlete, or equipment areas and to engage in the covered Activities constitutes consideration for this Agreement whether access is paid, complimentary, team-based, invitation-based, volunteer, or otherwise authorized. Signing this Agreement does not guarantee access to any particular area or activity. No Backboard Basketball Gym may restrict or revoke access based on safety, conduct, scheduling, supervision, operational, insurance, or other legitimate facility requirements. 2. Covered ActivitiesThis Agreement applies whenever I participate in or assist with basketball or related athletic activity at No Backboard Basketball Gym, including without limitation: coaching athletes; conducting or assisting practices; training or instruction; rebounding; passing; demonstrating drills or techniques; participating in warmups; participating in scrimmages or demonstrations; supervising athletes in active training areas; moving or handling basketball equipment; setting up or removing training equipment; assisting with camps, clinics, leagues, showcases, or tournaments; entering the playing court or designated athlete areas; providing volunteer assistance; and reasonable activities incidental to the foregoing. Collectively, these activities are referred to as the “Activity.” The Activity may involve traditional basketball equipment and No Backboard Basketball equipment, including a smaller-aperture basketball rim without a backboard. 3. Released Parties“Released Parties” means: 1. No Backboard Basketball League, LLC, doing business as No Backboard Basketball League, and its officers, members, employees, contractors, volunteers, and agents; 2. Eduprize Schools Inc., as owner/landlord of the premises located at 1383 E Baseline Rd, Gilbert, Arizona 85233, and its applicable affiliates, officers, employees, and agents, solely with respect to use of the premises. 4. Acknowledgment and Assumption of RiskI understand that entering an active basketball or training environment exposes me to risks whether or not I personally intend to compete. Those risks include, without limitation: being struck by a basketball; player-to-player or player-to-adult collisions; falls on a hard playing surface; slipping, tripping, jumping, or landing injuries; sprains, strains, fractures, dislocations, cuts, and bruises; head injury and concussion; dental or facial injury; spinal injury, paralysis, catastrophic injury, and death; cardiac events, dehydration, heat illness, or aggravation of an existing medical condition; contact with rims, nets, support structures, walls, padding, furniture, cameras, or other equipment; injury while rebounding, passing, demonstrating, spotting, coaching, or assisting an athlete; injury while moving, setting up, or handling equipment; equipment or facility malfunction or failure; actions or omissions of athletes, coaches, officials, spectators, staff, or other persons; differences in athlete size, strength, speed, age, or skill; and emergency-response or first-aid decisions made under time pressure. I understand that active court areas can change quickly and that athletes may move at high speed without being able to avoid a coach, parent, or other adult who enters their path. I KNOWINGLY AND VOLUNTARILY ASSUME ALL INHERENT AND OTHER RISKS ASSOCIATED WITH THE ACTIVITY, BOTH KNOWN AND UNKNOWN, INCLUDING, TO THE MAXIMUM EXTENT PERMITTED BY ARIZONA LAW, RISKS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES. 5. Waiver and ReleaseIn consideration for being permitted to engage in the Activity, I, individually and on behalf of my heirs, estate, personal representatives, executors, administrators, and assigns, RELEASE, WAIVE, AND DISCHARGE the Released Parties from claims for bodily injury, personal injury, disability, death, or property damage arising out of or related to my participation in the Activity or my presence in active athletic or training areas, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, to the maximum extent permitted by Arizona law. This Agreement does not waive claims that cannot lawfully be released in advance. It does not purport to release gross negligence, intentional misconduct, willful or wanton misconduct, or other liability that applicable law does not permit to be released. 6. My Responsibility for Safe ConductI agree to: follow Gym safety rules and staff instructions; remain aware of active play around me; enter the court only when authorized; avoid obstructing active play; use equipment only as intended; immediately report damaged or unsafe equipment; promptly report injuries or significant incidents; wear appropriate footwear when participating on court; refrain from horseplay or unsafe conduct; and leave an active area when directed by Gym staff or event personnel. I will not participate while impaired by alcohol, illegal drugs, or another substance that materially affects safe judgment or movement. 7. Coaches and TrainersIf I am acting as a coach, trainer, or team representative, I understand that this Agreement covers my own personal participation and risk. It does not replace any separate: facility-use agreement; team agreement; independent-contractor agreement; certificate-of-insurance requirement; insurance obligation; indemnification agreement; background-screening requirement; athlete-waiver requirement; or other agreement between my organization and NBBL. I understand that each athlete must have the appropriate participation documentation on file before participating. I will not knowingly permit an athlete under my supervision to participate contrary to a known medical restriction or facility safety instruction. 8. Parents and Guardians Entering Athletic AreasIf I am a parent or guardian, I understand that signing an athlete’s participation consent for my child does not automatically cover my own physical participation. This Agreement applies when I personally enter active athletic areas or assist with activities such as: rebounding; passing; drills; demonstrations; equipment handling; court supervision; setup or teardown; or other hands-on participation. I understand that I may be required to remain in spectator areas unless authorized to enter an active athletic area. 9. No Assumption of Professional Coaching RoleA parent, volunteer, or other participating adult does not become an employee, professional coach, trainer, medical provider, or agent of NBBL merely by assisting during an Activity. No person may represent that they have authority to act for NBBL unless specifically authorized. 10. EquipmentI will not alter, adjust, move, climb on, hang from, disassemble, or modify basketball equipment, rims, support structures, cameras, flooring equipment, electrical equipment, or other facility equipment unless specifically authorized. If I am authorized to move or set up equipment, I agree to follow applicable instructions and use reasonable care. I will immediately stop using equipment that appears damaged, unstable, or unsafe and notify Gym personnel. 11. Supervision of MinorsIf I am responsible for supervising minors during an Activity, I agree to use reasonable supervision consistent with my role. I understand that Gym staff are not automatically responsible for continuously supervising every child present unless NBBL has expressly assumed that responsibility for a particular program. Parents and guardians remain responsible for minors outside the scope of an organized, supervised Activity. 12. Medical Authorization and Accident Medical Disclosure (P5)If I experience an injury or medical emergency, I authorize Gym personnel to: summon emergency medical services; provide basic first aid within the scope of their training; communicate relevant emergency information to first responders; and arrange emergency transportation when reasonably necessary. I understand that Gym personnel are not physicians and that this authorization does not guarantee the availability, adequacy, or success of treatment. I accept financial responsibility for medical care provided to me except to the extent another person or entity is legally responsible. Accident medical coverage disclosure (P5 — participating adult): Any participant accident medical coverage available through NBBL, if any, applies only to eligible participants under 18 years of age under the current policy schedule, is limited, may be excess to other insurance, and may not cover all losses. Participants aged 18 and older have no accident medical coverage under that schedule. This form is not insurance and does not guarantee coverage or benefits. I should maintain my own health insurance. 13. TBI / Concussion Acknowledgment (P3)I Agree TBI / Concussion Awareness and Return-to-Play Acknowledgment (required if coaching, training, or supervising players). I received, read, and understand the NBBL Concussion Awareness and Return to Play Policy available at https://nobackboardbasketballgym.com/assets/NBBL%20Concussion%20Awareness%20and%20Return%20to%20Play%20Policy.pdf. I understand that a suspected concussion requires immediate removal from activity and written licensed physician clearance before return to play on a later day. I will not knowingly permit an athlete under my supervision to participate contrary to a known concussion or medical restriction.
14 Privacy Policy Reference (P4)I acknowledge that NBBL maintains a Privacy Policy describing how personal information may be collected and used in connection with NBBL activities. The current Privacy Policy is available at https://nobackboardbasketballgym.com/assets/NBBL%20Privacy%20Policy.pdf (also available upon request from NBBL at info@nobackboardbasketballgym.com). 15. Personal PropertyI am responsible for my personal belongings. To the maximum extent permitted by law, NBBL is not responsible for ordinary loss, theft, or damage to unattended personal property unless caused by conduct for which liability cannot lawfully be disclaimed. I will not leave property where it creates a trip hazard or interferes with play, emergency access, or facility operations. 16. Property Damage and Intentional MisconductI am responsible, to the extent permitted by law, for property damage or injury caused by my intentional misconduct, reckless misuse of equipment, or knowing violation of facility rules. Nothing in this section requires me to indemnify a Released Party for that party’s own negligence unless expressly agreed in a separate written agreement and permitted by law. 17. Removal from Activity or FacilityNBBL may immediately remove or restrict me from an Activity or active athletic area for reasons including: unsafe conduct; fighting or threats; interference with athletes or officials; repeated rule violations; intoxication or impairment; unauthorized equipment use; harassment; refusal to follow reasonable safety instructions; or conduct that materially disrupts facility operations. Removal does not create a right to compensation or damages. Any refund, if applicable, is governed by the applicable registration, rental, team, or program terms. 18. Media Is SeparatePhotography, video recording, livestreaming, interviews, and other media activity may occur at the Gym. THIS AGREEMENT IS NOT A MEDIA OR LIKENESS RELEASE. Intentional use of my name, image, likeness, voice, or interview in NBBL promotional or commercial Media is governed by the applicable media release (Form 4 for coaches/IC/vendors; Form 2A if also an adult athlete). Incidental appearance in general event or crowd coverage may be subject to the General Media Notice (Form 5). 19. Governing Law, Severability, and Entire AgreementThis Agreement is governed by Arizona law. Venue for disputes relating to this Agreement shall be in Maricopa County, Arizona, except where applicable law requires otherwise. If any provision is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent legally permissible and the remaining provisions shall remain effective. This Agreement governs my personal participation, assumption of risk, release, and conduct while assisting with or participating in covered Activities. It does not replace separate team, contractor, facility-use, media, insurance, or commercial agreements. Electronic signatures and counterparts are permitted. PARTICIPATING ADULT ACKNOWLEDGMENTI AM 18 YEARS OF AGE OR OLDER. I HAVE READ THIS AGREEMENT. I UNDERSTAND THAT ENTERING AN ACTIVE BASKETBALL OR TRAINING AREA EXPOSES ME TO RISKS OF INJURY EVEN IF I AM COACHING, REBOUNDING, SUPERVISING, OR ASSISTING RATHER THAN COMPETING. I UNDERSTAND THAT THIS AGREEMENT AFFECTS LEGAL RIGHTS, INCLUDING CLAIMS INVOLVING ORDINARY NEGLIGENCE TO THE MAXIMUM EXTENT PERMITTED BY ARIZONA LAW. |
