SNOWBOWL ZIP LINE TOUR AGREEMENT, ACKNOWLEDGEMENT OF RISK AND LIABILITY RELEASE

n consideration for the right to use the facilities and to participate in the Zip Line Tour at Montana Snowbowl (MSB, Inc.), I am aware of and acknowledge that there are inherent risks participating in the Zip Line Tour as it requires physical effort on my part including walking on uneven and rocky terrain, climbing and descending stairs and platforms, landing and jumping off elevated platforms, traveling at high speeds suspended high above the ground. Falls and sprains may occur as well as the potential for other kinds of bodily injury and emotional stress (fear of heights) including serious injuries such as paralysis and death. This list of risks is not complete and other unknown or unanticipated risks may be encountered. 

My participation is voluntary and I warrant that I am in adequate physical condition to participate and I do not have medical conditions that maybe aggravated by this activity such as heart disease, high blood pressure, neck or back problems, other joint and muscular-skeletal problems, motion sickness or dizziness, pregnancy or other conditions that may cause a problem on the tour. 

I agree that this agreement and acknowledgement shall be governed by and interpreted solely in accordance with Montana law, including the Montana Recreation Responsibility Act, Title 27, Chapter 1, Part 7, MCA. Any litigation involving the parties to this Agreement shall be brought solely in Montana State or Federal Courts. 

I acknowledge that I have the opportunity and it is my responsibility to inspect and assess these risks. I agree to assume all these risks and to release, hold harmless and indemnify MSB, Inc., its agents and employees from claims or liability for any damage or personal injury to myself and all others named on this contract that may result from participating in the Zip Line Tour and the use of these facilities and activities including claims based on negligence.  I grant full permission to Snowbowl and the event sponsors to use any photographs, video, recordings or any other record for any purpose.

By signing this document you may be waiving your legal right to a jury trial to hold the provider, MSB,Inc., legally responsible for any injuries or damages resulting from risks inherent in this recreational opportunity or for any injuries or damages you may suffer due to provider’s ordinary negligence that are the result of the provider’s failure to exercise reasonable care.
